TAHOE CROSS-COUNTRY SKI AREA AGREEMENT AND RELEASE AND DISCLAIMER OF LIABILITY
In consideration of Tahoe Cross-Country Ski Area (“Tahoe XC”) and Tahoe Cross Country Ski Education Association (“TCCSEA”) agreeing to allow the use of its facility and/or agreeing to rent athletic equipment to me I hereby agree to all of the following:
1. Release and Indemnification. I understand that the use of the Tahoe XC/TCCSEA property & programs, hereafter and throughout referenced as TXC, and all land subject to TXC’s concession agreement as depicted and described on TXC’s Trail Maps, located in the Highlands Community Center property, whether for mountain biking, hiking, cross-country skiing, snowshoeing, roller skiing and/or other similar summer or winter activities involve inherent risks of bodily injury, death or property damage and that I may be exposed to inclement weather, mountainous terrain, rocks, cliffs, streams, marshes, lakes and other natural and/or manmade hazards during my participation in the aforementioned activities and/or classes or programs in which I participate. I further understand that bodily injuries, death or property damage are a common and ordinary occurrence of the foregoing sports, activities and programs and I freely and voluntarily assume those risks. I further understand there are other objects, equipment failure, surface and environmental conditions consisting, among other things, of extreme weather conditions as well as other risks which in combination with my actions can cause very severe or occasional fatal injury. To the fullest extent allowed by law, I agree to RELEASE, DEFEND AND INDEMNIFY TXC, their associates, owners, agents and employees from any and all liability or damage or injury to myself or to any person or property while participating as a season passholder, using rental sports equipment, or further participating in any event or program located on property. I agree to be bound by this agreement even if such damage or injury is due to TXC negligence.
2. Assumption of Risk. I agree to assume all risks of bodily injury, death or property damage and to release from liability and refrain from suing TXC, its associates, owners, agents and employees regardless of the cause.
3. Rule Compliance. I agree to comply with all rules and regulations posted by TXC with respect to the use of its property. It is the intention of this release and waiver of liability form to exempt and relieve TXC from liability for personal injury, property damage or wrongful death caused by TXC’s negligence and/or my use of TXC’s property and/or equipment and/or my participation in any event or program held on TXC property. In this regard I acknowledge that I have been fully and completely advised of the potential hazards involved and/or described in this agreement and that I am fully aware of the legal consequences of signing this agreement.
4. Photographic Release. I understand that photographs or video recording may be taken of me or my family during my participation and/or utilization of TXC property. I give TXC permission to use any such material for advertising or in promotional materials.
5. Medical Release. I, either as the participant and/or parent or legal guardian for selected participant, hereby make and appoint the TXC staff my true and lawful attorney for me in my name to perform any emergency medical care hereinafter set down as fully as I might if personally present with full power of substitution and revocation. I am hereby ratifying and confirming my entire said attorney should do or cause to be done by virtue of this power and assume all financial responsibility for the same. I authorize said attorney to authorize any and all medical and hospital care and treatment deemed necessary by a duly licensed physician for the health and well-being of either myself or my child named above.
6. Consent and Release of Parent or Guardian. My child is fit to participate in TXC programs/events, and I consent to my child’s participation. I HAVE READ AND I UNDERSTAND THE ABOVE CONDITIONS AND RELEASE OF LIABILITY. Whether caused by the negligence of the released parties or others, I PROMISE NEVER TO SUE TAHOE CROSS-COUNTRY SKI AREA and/or TAHOE CROSS-COUNTRY SKI EDUCATION ASSOCIATION, OR ANY RELEASED PARTY on my behalf, or on behalf of my child, regarding any claim arising from my child’s participation in this program or event.
7. Electronic Signature Agreement. By selecting the “I Accept” button, you are signing this Agreement electronically. I agree my electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting “I Accept” I consent to be legally bound by this Agreement’s terms and conditions. I further agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide TXC instructions via Ski Club Pro, Square, and any/all other digital platforms or in accessing or making any transaction regarding any agreement, acknowledgement, consent terms, disclosures or conditions constitutes your signature (hereafter referred to as “E-Signature”), acceptance and agreement as if actually signed by me in writing. I also agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and TXC. I also represent that I am authorized to enter into this Agreement for all persons who own or are authorized to access any of my accounts and that such persons will be bound by the terms of this Agreement. I further agree that each use of my E-Signature in obtaining a service constitutes my agreement to be bound by the terms and conditions of the TXC Disclosures and Agreements as they exist on the date of my E-Signature.
With my electronic acceptance, I agree to give TXC permission to forward its e-newsletter to me so I can learn more about TXC updates, events and sales. I may opt out at any time. TXC will not sell or share your email address.
ACUERDO DEL AREA DE ESKI DE FONDO TAHOE CROSS COUNTRY Y LIBERACIÓN DE RESPONSABILIDAD
En consideración del Área de Esquí de Fondo Tahoe Cross Country (“Tahoe XC”) y de la Asociación Educativa de Esquí de Fondo Tahoe Cross Country (“TCCSEA”) acordando permitirme el uso de sus instalaciones y/o acordando alquilarme equipo deportivo, yo, por el presente acepto todo lo siguiente:
1. Liberación e indemnización. Entiendo que el uso de la propiedad & programas de XC/TCCSEA de Tahoe, en lo sucesivo y a lo largo referido como TXC, y todo terreno sujeto al acuerdo de concesión de TXC’s como es representado y descripto en los mapas de senderos de
TXC, ubicados el la propiedad del Centro Comunitario Highlands, ya sea para el ciclismo de montaña, montañismo, esquí de fondo, uso de raquetas de nieve, patinaje en esquíes, y/u otras actividades similares de verano o invierno implican riesgos inherentes de lesiones corporales, muerte o daño a la propiedad y que puedo estar expuesto a las inclemencias del tiempo, terreno montañoso, rocas, acantilados, arroyos, lagos, pantanos y a otros riesgos naturales y/o hechos por el hombre durante mi participación en las actividades previamente mencionadas y/o clases o programas en los que participo. También entiendo que las lesiones corporales, muerte o daño a la propiedad son una ocurrencia común y ordinaria de los deportes y actividades mencionados, y asumo esos riesgos libre y voluntariamente. Además, entiendo que existen otros objetos, fallos del equipo, condiciones ambientales de la superficie y medioambientales consistentes, entre otras cosas, en condiciones climáticas extremas como también otros riesgos que en combinación con mis acciones pueden causar lesiones muy severas u ocasionalmente fatales. Hasta donde la ley lo permita, estoy de acuerdo en EXIMIR, DEFENDER E INDEMNIZAR a TXC, sus asociados, dueños, agentes y empleados de cualquier y toda responsabilidad o daño o lesión a mi mismo o cualquier persona o propiedad mientras participe como titular de un pase de temporada, utilice equipo deportivo de alquiler, o participe en cualquier evento o programa ubicado en la propiedad. Acepto estar obligado por este acuerdo incluso si dicho daño o lesión se debe a la negligencia de TXC.
2. Asunción de riesgos. Acepto asumir todo riesgo de herida corporal, muerte o daño a la propiedad y eximir de responsabilidad y abstenerme de demandar a TXC, sus asociados, dueños, agentes y empleados independientemente de la causa.
3. Cumplimiento de normas. Estoy de acuerdo en cumplir con todas las normas y regulaciones publicadas por TXC con respecto al uso de su propiedad. Es la intención de este formulario de liberación y renuncia de responsabilidad eximir y liberar a TXC de la responsabilidad por lesión personal, daño a la propiedad o muerte errónea causada por la negligencia de TXC y/o mi uso de la propiedad o equipo de TXC y/o mi participación en cualquier evento o programa sostenido en la propiedad de TXC. En este aspecto, reconozco que he sido total y completamente informado de los peligros potenciales involucrados y/o descritos en este acuerdo y que soy plenamente consciente de las consecuencias legales de firmar este acuerdo.
4. Autorización fotográfica. Entiendo que se pueden tomar fotografías o grabaciones de video de mí o de mi familia durante mi participación y/o utilización de la propiedad de TXC. Doy permiso a TXC para usar dichos materiales para publicidad o en materiales promocionales.
5. Autorización Medica. Yo, ya sea como participante y/o padre o guardián legal del participante seleccionado, por la presente hago y nombro al personal de TXC mi verdadero y legítimo apoderado en mi nombre para llevar a cabo cualquier atención médica de emergencia que se establezca en lo sucesivo, tan plenamente como podría hacerlo si estuviera presente personalmente, con pleno poder de sustitución y revocación. Por la presente ratifico y confirmo
todo lo que dicho apoderado debería hacer o lograr que se haga por virtud de este poder y asumo toda responsabilidad financiera por el mismo. Autorizo a dicho apoderado a que autorice todos y cada uno de los cuidados y tratamientos médicos y hospitalarios considerados necesarios para la salud y bienestar tanto mío como el de mi hijo/a nombrado/a anteriormente por un médico debidamente acreditado.
6. Consentimiento y autorización del padre o guardián. Mi hijo/a es apto para participar en los programas/eventos de TXC, y doy consentimiento para que mi hijo/a participe. HE LEÍDO Y COMPRENDIDO LAS CONDICIONES Y LIBERACIÓN DE RESPONSABILIDAD ANTES MENCIONADOS. Ya sea causado por la negligencia de las
partes exentas o de otros, PROMETO NO DEMANDAR NUNCA AL ÁREA DE ESQUÍ DE FONDO TAHOE CROSS COUNTRY, y/o a la ASOCIACIÓN EDUCATIVA DE ESQUÍ TAHOE CROSS-COUNTRY, O A CUALQUIER PARTE EXEMPTA EN MI NOMBRE, o en nombre de mi hijo/a, con respecto a cualquier reclamo que surja por la participación de mi hijo/a en este programa o evento.
7. Acuerdo de firma electrónica. Al seleccionar el botón “acepto,” usted está firmando este acuerdo electrónicamente. Estoy de acuerdo con que mi firma electrónica sea el equivalente legal de la firma manual en este acuerdo. Al seleccionar “acepto” consiento estar legalmente obligado por los términos y condiciones de este acuerdo. Además, acepto que el uso de un teclado, ratón u otro dispositivo para seleccionar un elemento, botón, ícono o acto/acción similar, o para proporcionar de otro modo instrucciones de TXC a través de Ski Club Pro, Square, y cualquier/todas las demás plataformas digitales o al acceder o realizar cualquier transacción en relación con cualquier acuerdo, reconocimiento, términos de consentimiento, divulgación o condiciones constituye mi firma (en lo sucesivo denominada “Firma electrónica”), aceptación y acuerdo como si realmente lo hubiera firmado por escrito. También acepto que no es necesaria ninguna autoridad de certificación u otra verificación de terceros para validar mi firma electrónica y que la falta de dicha certificación o verificación de terceros no afectará en modo alguno la aplicabilidad de mi firma electrónica o cualquier contrato resultante entre TXC y yo. También manifiesto que estoy autorizado a celebrar este acuerdo en nombre de todas las personas que son dueñas o están autorizadas a acceder a cualquiera de mis cuentas y que tales personas estarán obligadas por los términos de este acuerdo. Además, estoy de acuerdo en que cada uso de mi firma electrónica para obtener un servicio constituye mi acuerdo a estar obligado por los términos y condiciones de las divulgaciones y acuerdos de TXC tal y como existen en la fecha de mi firma electrónica.
Con mi aceptación electrónica, estoy de acuerdo en dar permiso a TXC de enviarme su boletín electrónico para que pueda saber más sobre las actualizaciones de TXC, eventos y ventas. Puedo excluirme en cualquier momento. TXC no venderá o compartirá su dirección de email.
