HOOKS OF HOPE FISHING TOURNAMENT & FREE KID FISH
PARENT/LEGAL GUARDIAN CONSENT, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY

Location: The Landing, 4234 Laguna Shores Rd., Corpus Christi, TX 78414
For purposes of this agreement, the “Released Parties” are Nate’s Next Kid Up, Blue Collective Texas Hospitality LLC, and Laguna Marina and Storage LLC, and their respective officers, directors, members, managers, employees, agents, volunteers, and event organizers acting within their event-related roles.
In consideration of permission for my child and me to participate in the Hooks of Hope Fishing Tournament, Free Kid Fish, and related event activities, I acknowledge and agree as follows:
1. PARENTAL CONSENT
I certify that I am at least 18 years old and am the parent or legal guardian of the minor participant identified above. I authorize my child to participate and confirm that I have authority to provide this consent.
2. ACKNOWLEDGMENT OF RISKS
I understand that fishing and activities near water involve inherent and other risks that may result in property damage, serious injury, permanent disability, or death.
These risks include, but are not limited to:
Fishhooks, fishing lines, sharp equipment, casting, and contact with other participants’ equipment.
Slips, trips, and falls on wet, uneven, or slippery surfaces, docks, piers, walkways, and shoreline areas.
Falling into water, drowning, currents, changing water depth, and underwater hazards.
Contact with fish, wildlife, insects, bait, and contaminated water.
Heat, sun exposure, dehydration, severe weather, and lightning.
Boats, vehicles, moving equipment, and marina traffic.
Equipment defects or failure and the actions or omissions of participants or others.
Delays in emergency response or access to medical care.
I understand that additional risks may exist that are not known or reasonably foreseeable.
3. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK
Participation is voluntary. I have considered the risks and my child’s age, abilities, swimming skills, and physical condition. I voluntarily accept the risks of my own participation and acknowledge those associated with my child’s participation, to the fullest extent permitted by Texas law.
4. PARENTAL SUPERVISION AND SAFETY
I understand that this is not a drop-off childcare program. I agree to remain on-site and ensure my child is appropriately supervised throughout participation.
My child and I will follow event rules, posted warnings, restricted-area boundaries, and reasonable safety instructions. We will handle fishing equipment responsibly, keep a safe distance from others when casting, and use properly fitted life jackets whenever required by law or event rules.
I will stop my child’s participation and notify event personnel if I observe an unsafe condition or my child becomes unable to participate safely.
5. RELEASE OF LIABILITY — INCLUDING ORDINARY NEGLIGENCE
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I, INDIVIDUALLY, RELEASE AND DISCHARGE THE RELEASED PARTIES FROM CLAIMS THAT I PERSONALLY OWN ARISING OUT OF MY OR MY CHILD’S PARTICIPATION IN THE EVENT OR USE OF EVENT PREMISES OR EQUIPMENT, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. THIS INCLUDES CLAIMS INVOLVING NEGLIGENT SUPERVISION, INSTRUCTION, EQUIPMENT MAINTENANCE, OR PREMISES CONDITIONS.
TO THE EXTENT TEXAS LAW PERMITS ME TO DO SO, I ALSO PROVIDE THIS RELEASE ON BEHALF OF THE MINOR CHILD IDENTIFIED ABOVE. THIS AGREEMENT DOES NOT RELEASE CLAIMS FOR GROSS NEGLIGENCE, RECKLESS OR INTENTIONAL MISCONDUCT, OR ANY CLAIM THAT CANNOT LAWFULLY BE WAIVED.
6. MEDICAL CONDITIONS AND EMERGENCY CARE
I will communicate any condition or accommodation need relevant to my child’s safe participation to event personnel before participation.
If my child becomes injured or ill, I authorize event personnel to provide basic first aid within their training and to contact emergency medical services. If I cannot be reached promptly, I authorize emergency evaluation, transportation, and treatment as permitted by law.
I understand that the event does not promise to provide medical insurance for participants. I accept responsibility for medical expenses for which I am legally responsible. This paragraph does not independently release any claim.
7. SCOPE OF AGREEMENT
This agreement applies to participation in the event identified above and its related activities. It is governed by Texas law. If any provision is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.
8. ACKNOWLEDGMENT AND SIGNATURE
I HAVE HAD SUFFICIENT TIME TO READ THIS ENTIRE AGREEMENT. I UNDERSTAND THAT IT INCLUDES A RELEASE OF CLAIMS BASED ON ORDINARY NEGLIGENCE AND MAY LIMIT MY LEGAL RIGHTS. I SIGN VOLUNTARILY AND UNDERSTAND THAT IT DOES NOT ELIMINATE RIGHTS THAT TEXAS LAW DOES NOT ALLOW ME TO WAIVE.
