WAIVER AND RELEASE I HEREBY WAIVE AND RELEASE Born to Fly LLC., from liability pertaining to the matters set forth below. I understand that by signing this Waiver and Release, I expressly and willingly agree to assume complete responsibility for any risk of injury that might arise from activities and events that the athletes participate in. With this waiver, I assume any risk and take full responsibility and waive all claims of personal injury, including severe bodily injury to all activities associated with Born to Fly, LLC. I do not have any physical limitations, medical ailments, physical or mental disabilities that would prevent me from participating in the abovementioned activity. Born To Fly LLC has my permission to use my or my child’s photograph or video publicly to promote Born to Fly LLC and their direct affiliates. I understand that the images and videos may be used in print publications, online publications, presentations, websites, and social media. I also understand that no royalty, fee, or other compensation shall become payable to me by reason of such use. All will be used in a positive and professional manner. I HAVE READ AND FULLY AGREE TO THE TERMS OF THIS WAIVER AND RELEASE. MY SIGNATURE IS PROOF OF MY INTENTION TO EXECUTE A COMPLETE AND UNCONDITIONAL WAIVER, AND RELEASE OF ALL LIABILITY TO THE FULL EXTENT OF THE LAW. I AM 18 YEARS OF AGE OR OLDER AND MENTALLY COMPETENT TO GRANT THIS WAIVER. IF IM NOT 18 YEARS OLD, A PARENT OR LEGAL GUARDIAN WILL SIGN THIS WAIVER TO GRANT THE WAIVER. ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 IS EXTREMELY CONTAGIOUS and is believed to spread from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. BORN TO FLY LLC/WILLIAM VANZELA, has put in place preventative measures to reduce the spread of COVID-19; however, we CANNOT GUARANTEE that you or your child(ren) will not become infected with COVID-19. Further, ATTENDING THE SESSIONS COULD INCREASE your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the sessions and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Born to Fly LLC sessions may result from the actions, omissions, or negligence of myself and others, including, but not limited to, our employees, volunteers and program participants and their families. I voluntarily agree to assume all of the foregoing risk and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club or participation in Club programing (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Born to Fly LLC., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club program.
