PHOTOGRAPHY SERVICES AGREEMENT
Master / Umbrella Contract
This Photography Services Agreement (“Agreement”) governs all photography services provided by the Photographer. By booking a session, submitting payment, or participating in photography services, the Client agrees to the terms below.

1. SERVICES
Photographer agrees to provide photography services as selected by the Client. Session details, packages, deliverables, and pricing are outlined separately through booking forms, invoices, proposals, or written communication and are incorporated into this Agreement by reference.
2. BOOKING & PAYMENT
A 20% non-refundable deposit is required to secure the session date.
The remaining balance is due during the week of the scheduled session.
Sessions are not considered confirmed until the deposit is received.
Failure to submit payment as required may result in cancellation, rescheduling delays, or delayed delivery of images.
3. CANCELLATION & RESCHEDULING
All deposits are non-refundable.
Rescheduling is permitted based on Photographer availability.
Weather-related rescheduling is allowed when conditions are unsafe or unsuitable for photography, as determined by the Photographer.
Rescheduled sessions must occur within a reasonable timeframe and are subject to the Photographer’s schedule.
Photographer reserves the right to cancel or reschedule due to illness, emergency, weather, or circumstances beyond reasonable control. In such cases, the Client will be offered rescheduling or a refund of payments made, excluding the deposit.
4. SESSION CONDUCT & RESPONSIBILITY
Client is responsible for the behavior, cooperation, and supervision of all participants.
Photographer is not responsible for missed images due to late arrival, uncooperative subjects, distractions, or conditions outside the Photographer’s control.
Late arrivals may result in reduced session time without refund and are subject to Photographer availability.
Client acknowledges that photography sessions involve inherent risks and assumes responsibility for all participants.
5. ILLNESS POLICY
If illness affects session participants, Client agrees to notify Photographer as soon as possible.
Rescheduling due to illness is subject to availability and Photographer discretion.
6. EDITING & CREATIVE STYLE
Images are edited at the Photographer’s professional discretion and consistent with their artistic style.
Unedited or RAW files are not provided.
Photographer does not guarantee specific poses, expressions, individuals, or moments.
Requests for additional edits or retouching beyond standard delivery may incur additional fees.
Client acknowledges that photography style, color tones, and image selection are subjective and final.
7. DELIVERY TIMELINE
Final edited images will be delivered within one (1) to two (2) months following the session date.
Turnaround time may vary based on time of year, session volume, workload, and unforeseen delays.
Delivery timelines are estimates and not guaranteed.
Expedited delivery is not guaranteed unless explicitly offered in writing.
8. IMAGE ARCHIVING & GALLERY ACCESS
Photographer does not guarantee long-term archiving of images.
Client is responsible for downloading and backing up images upon delivery.
Online galleries may be removed after a reasonable period of time.
9. COPYRIGHT & IMAGE OWNERSHIP
Photographer retains full copyright ownership of all images.
Client is granted a non-exclusive, non-transferable license for personal use unless otherwise stated in writing.
Images may not be sold, altered, licensed, or used commercially without Photographer’s written permission.
Commercial or extended usage requires a separate licensing agreement.
10. IMAGE USAGE & MARKETING
Client grants Photographer permission to use images for portfolio, website, social media, marketing, and promotional purposes.
Requests to restrict image usage must be submitted in writing prior to the session.
11. CLIENT IMAGE ALTERATION
Client agrees not to apply heavy filters, presets, or edits that significantly alter the appearance of delivered images.
Cropping out watermarks or credit is not permitted.
12. LOCATION & PERMITS
Client is responsible for securing any required permits, permissions, or location approvals unless otherwise stated.
Photographer is not liable for restrictions imposed by locations or venues.
13. ASSISTANTS & SUBSTITUTION
Photographer reserves the right to use a qualified assistant or substitute photographer in the event of an emergency.
14. LIMITATION OF LIABILITY
Photographer is not liable for:
Injury, illness, or property damage occurring before, during, or after the session
Missed images due to technical failure, weather, lighting, or participant behavior
Loss or damage of images beyond Photographer’s reasonable control
In the event of total failure to deliver images, Photographer’s liability is limited to a refund of amounts paid.
15. FORCE MAJEURE
Photographer shall not be held liable for failure to perform due to events beyond reasonable control, including but not limited to acts of God, illness, government restrictions, emergencies, or equipment failure.
16. INDEMNIFICATION
Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or liabilities arising from participation in the session or use of the images.
17. GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the Photographer’s operating state.
18. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior communications. Any modifications must be made in writing and agreed upon by both parties.
19. ACCEPTANCE
By booking a session, submitting payment, or participating in photography services, the Client acknowledges that they have read, understood, and agreed to this Agreement in full.
