or the relationship of the parties in any respect thereto shall first be submitted to mediation through the American Arbitration Association, and that engaging in such mediation is a condition precedent to bringing any claim against EH Hockey INC arising from or related to this agreement. Such mediation may be initiated by either party by submitting a request for mediation in the manner provided by the American Arbitration Association. If the claim or dispute is not resolved through mediation, I agree and acknowledge on behalf of myself and the Minors that any claim or dispute arising from or related to this agreement or the relationship of the parties in any respect thereto shall be submitted to arbitration with the American Arbitration Association pursuant to its Consumer Arbitration Rules or such other arbitration rules that the American Arbitration Association determines are applicable. Information regarding the American Arbitration Association, its services and rules may be found at www.adr.org. I acknowledge and agree on behalf of myself and the Minors that by agreeing to arbitrate any claim or dispute I am giving up the opportunity to have a court, judge or jury decide the claim or dispute and that the rules of procedure and rules of evidence applicable in court may not be applicable in arbitration. Mediation or arbitration shall be conducted in Boston, Massachusetts or at such other place as the parties may agree in writing. In the event of litigation to enforce mediation, arbitration, or settlement between the parties to this agreement, I agree that sole jurisdiction and venue shall be in the state courts located in Plymouth County, Massachusetts and the United States District Court for the District of Massachusetts sitting in Boston, Massachusetts, and I waive any defense of jurisdiction and/or venue that may now or hereafter exist. Entire Agreement; Severability. I understand that this is the entire agreement between the undersigned and the EH Hockey INC, and that it cannot be modified or changed in any way by the representations or statements of the EH Hockey INC or its employees or agents or by the undersigned. This agreement supersedes any and all previous oral or written promises or agreements. I understand and agree that this agreement is intended to be as broad and inclusive as permitted by the laws of the State of Massachusetts and that if any portion thereof is held invalid, it is agreed that the remainder of the agreement will remain in effect and will continue in full legal force and effect.
While not a “contact”sport, including hockey The following comprehensive safely protocols have
been put into place to ensure the safety of participants and mitigate the risks associated with concussions in all EH hockey programming.
1. Pre-camp/skills preparation: a. Comprehensive training to camp/skills staff members, with senior members being certified in CDC approved concussion recognition, prevention, and response. b. Develop Policies: Establish clear that prioritize participant safety, emphasizing the importance following concussion safety protocols. c. Communicate with Parents/Guardians: Inform parents or guardians about the camp's/skills commitment to concussion safety, including the protocol and procedures in place.
2. Pre-camp/skills Participant Evaluation: a. medical History: request thorough medical history forms from each participant, including any past concussions or related injuries.
b. Pre-Camp/skills Medical Examination: Encourage
participants to undergo a pre-camp/skills medical examination, including a baseline assessment if possible.
3. Concussion Prevention: a. Equipment: Ensure that all participants wear certified and properly fitted helmets with appropriate face protection during all on-ice activities.
B. Technique Training: Emphasize proper playing techniques,
including body-checking, to minimize the risk of head injuries. C.
Enforcement: Strictly enforce rules relates to head contact and illegal hits to discourage dangerous play.
Concussion Recognition: a. Symptom Education: Train camp/skills staff to recognize common signs and symptoms of concussions, such as headache, dizziness, confusion, memory loss, and balance problems. b. Observation:
Encourage staff to closely monitor participants for any signs of head injuries or concussions during camp/skills activities.
Response and Management: a. Immediate Removal: Instruct coaches and trainers to immediately remove any participant suspected of having a concussion from play or activity. b. Medical Evaluation: Arrange for a qualified medical professional to evaluate the participant, following the appropriate medical protocol. c. Parent/Guardian Notification: Inform the participant's parents or guardians about the suspected concussion, recommending further medical evaluation and care. d. Return-to-Play Protocol: Establish a step-by-step process for a gradual and supervised return to play, following the guidance of a qualified healthcare provider.
Documentation and Reporting; a. Incident Reports: Develop a standardized incident reporting process to document suspected concussions and related incidents. b. Medical Records: Maintain accurate and confidential medical
records for all participants, including any reported concussions or related injuries.
Return to Play Protocol: a. Medical Clearance: Participants diagnosed with a concussion must follow a step-wise return-to-play protocol and obtain written clearance from a qualified healthcare professional experienced in concussion management. b. Gradual Progression: Gradually reintroduce physical and cognitive activities, closely monitoring the participant for any recurring symptoms. Progression will be guided by the participant's symptoms and healthcare professional's recommendations. c. Full Recovery: Participants must be symptom-free at rest and with physical exertion before being cleared toresume full participation in camp/skills.
Documentation and Insurance Claims: a. Incident Reports: EH Hockey will maintain detailed records of all suspected concussions, including the participants information, date, time, description of the incident, symptoms, medical evaluation details, and clearance for return to play. b. Insurance Claims:
EH Hockey will ensure that the insurance provider is promptly notified of any concussion and provide all necessary documentation for claims related to medical expenses and treatment associated with concussion injuries.
9. Concussion Protocol Evaluation and Improvement: a. Regular Review: Conduct periodic reviews of the concussion safety protocol to ensure it aligns with current best practices and guidelines. b. Staff Training: Provide ongoing education and training for camp/skills staff to stay updated on concussion management and prevention.
Effect of Agreement. I have read the above and fully understand the terms of this agreement and I have either consulted an attorney regarding the agreement or have elected not to do SO. I am aware that by signing this agreement, I am giving up rights that I may have to bring a legal action or assert a claim against the Protected Parties on the basis of their negligent acts or omissions.
