Liability Waiver
I hereby agree to participate in the above stated festivals organized by Colorado Creative Music, Inc. dba ColoradoArtWeekend.com and ColoradoArtShows.com
As a requirement for being allowed to participate in this event, I acknowledge and agree to the following:
Food Provider Safety and Liability Waiver
I hereby acknowledge and agree to the following terms and conditions in consideration of being allowed to provide food services at the Fall Arts Invitational at the above festival(s) (the "Festival(s)") organized by Colorado Creative Music, Inc. dba ColoradoArtShows.com & ColoradoArtWeekend.com (the "Organizer"):
The events are scheduled to take place from 12:01 am the day before the festival date to 11:59pm on Sunday of the festival weekend.
Compliance with Laws and Regulations: I agree to comply with all applicable laws, regulations, and health codes governing the preparation, handling, and serving of food at the Festival, including obtaining any necessary permits or licenses before each festival.
Assumption of Risks: I understand that providing food services at the Festival(s) involves inherent risks and dangers, including but not limited to risks associated with foodborne illnesses, allergic reactions, and accidents. I voluntarily assume all risks related to my participation in the Festival as a food provider.
Release of Liability: I hereby release, waive, discharge, and covenant not to sue the Organizer, its directors, officers, employees, volunteers, agents, and representatives (collectively, the "Released Parties") from any and all claims, liabilities, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death, including but not limited to those caused by the negligence of the Released Parties, while providing food services at the Festival.
Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all liabilities or claims made by third parties arising out of my provision of food services at the Festival, including but not limited to claims for personal injury, property damage, or wrongful death.
Food Safety and Hygiene: I certify that I will maintain high standards of food safety and hygiene at all times during the Festival, including proper food storage, preparation, and serving practices, as well as cleanliness of equipment and facilities.
Insurance: I understand that the Organizer may not provide insurance coverage for me as a food provider at the Festival and that it is my responsibility to obtain appropriate insurance coverage for my food business.
Medical Treatment: In the event of any injury or illness that I may sustain during The Festival(s), I authorize the event organizers to seek and consent to any necessary medical treatment on my behalf. I understand that I will be responsible for any medical expenses incurred.
Photography and Publicity: I grant the irrevocable right to use my name, likeness, voice, and any photographs, video recordings, or other media taken of me or my work during The Festival(s) for promotional purposes without compensation.
Governing Law: This liability waiver shall be governed by and construed in accordance with the laws of Colorado, without regard to its conflict of law principles.
I have read this liability waiver, fully understand its terms, and voluntarily agree to its contents. I acknowledge that my participation in the Festival(s) as a food provider is voluntary and that I am freely and willingly signing this waiver.
Severability: If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
By signing below, I acknowledge that I have read this waiver and fully understand its contents. I voluntarily agree to be bound by its terms and conditions.
