  • Parties to the agreement

    This agreement is made between the buyer (referred to in this document as ‘the buyer’, ‘you’ or ‘your’) and The University of Newcastle Students’ Association (‘UNSA’) ABN 40640035195 of AE Building, University of Newcastle, University Drive, Callaghan NSW 2308 (referred to in this document as ‘the organisation’, ‘UNSA’, ‘we’, ‘us’ or ‘our’).
  • Purpose of the program

    The purpose of this agreement is to outline the terms and conditions under which the Laptops for Less initiative operates, providing refurbished, high-quality laptops to University of Newcastle students and wider community members at an affordable cost, thereby promoting digital access and equity.
  • Program terms and buyer acknowledgements

  • You understand that in purchasing a refurbished laptop under this program, you agree to the following:

    1. Purchase the refurbished laptop outright using an appropriate form of payment, either online or in person.

    2. Accept ownership and full responsibility for the refurbished laptop upon purchase.

    3. Acknowledge that the laptop is refurbished and may contain used or replaced parts.

    4. Receive a 12-month warranty, applicable through UNSA and its correspondence with one of its suppliers, in addition to your rights under the Australian Consumer Law.

    5. Use the laptop for personal and educational purposes only. Misuse may result in disciplinary action, a financial penalty of up to $250.00, and exclusion from future UNSA programs.

    6. Not resell, lease, or distribute the laptop for commercial gain, nor sell it for more than the original purchase price inclusive of GST.7. Take reasonable care of the laptop and understand that you are responsible for any breakages, loss, or theft not covered by warranty or consumer guarantees.8. Consent to UNSA collecting and storing your personal information for the purposes of administering the program, in accordance with applicable privacy legislation

  • Price and payment

    You agree to pay the purchase price applicable to the refurbished laptop you have selected under the Laptops for Less program. The purchase price is communicated at the time of sale, either online or in person, and is inclusive of GST unless otherwise stated.The purchase price reflects the subsidised nature of the Laptops for Less program and is not intended for resale or commercial gain. No additional fees will apply unless expressly agreed in writing.
  • Resale restrictions and remedies

    You agree that the refurbished laptop purchased under the Laptops for Less program is for your personal and or educational use only.You must not resell, lease, or otherwise distribute the laptop for commercial gain, nor sell or attempt to sell the laptop for a price greater than the original purchase price inclusive of GST.In the event of a breach of this clause, UNSA reserves the right to impose a financial penalty of up to $250.00, exclude you from future UNSA programs, seek reimbursement of any profits made from unauthorised resale, or take any other action available at law.
  • Waiver of responsibility

  • Repair notice

    You acknowledge that the laptop is a refurbished item and may contain used parts that have been repaired or replaced.This notice is provided in accordance with section 54 of the Australian Consumer Law.
  • Force majeure

    UNSA will not be liable for any failure or delay in performing its obligations under this agreement if such failure or delay is due to circumstances beyond its reasonable control.This includes events such as natural disasters, pandemics, government restrictions, industrial disputes, or supply chain disruptions.
  • Breakages, loss, theft, and use

    You are responsible for the care and security of the laptop upon purchase.• Breakages: You are responsible for repair costs unless the issue is covered under warranty or the Australian Consumer Law.• Loss or theft: UNSA does not provide replacements or refunds for lost or stolen laptops.• Use: The laptop is provided for personal and educational use only. Misuse may result in penalties and exclusion from future UNSA programs.This clause does not limit your rights under the Australian Consumer Law.
  • Consumer guarantees

    This sale is subject to the consumer guarantees under the Australian Consumer Law.These guarantees apply in addition to the 12-month warranty offered through UNSA and its suppliers.
  • Refunds and returns

    If the laptop fails to meet the consumer guarantees under the Australian Consumer Law, you may be entitled to a repair, replacement, or refund, depending on the nature of the issue.To request a remedy, please contact UNSA and provide proof of purchase.
  • Dispute resolution

    If a dispute arises in connection with this agreement, both parties agree to attempt to resolve the matter in good faith through informal discussions.If the dispute cannot be resolved, the matter may be referred to mediation in New South Wales.
  • Privacy and data collection

    By entering into this agreement, you consent to UNSA collecting and storing your personal information for the purposes of administering the Laptops for Less program and providing warranty support.Your information will be handled in accordance with applicable privacy legislation and will not be shared except where required by law or for warranty purposes.
  • Execution of agreement

    By signing below, you confirm that you have read, understood, and agree to the terms of this warranty and sales agreement.
