NEHEMIAH COMMUNITY DEVELOPMENT CORPORATION RELEASE OF LIABILITY AND INDEMNIFICATION FORM

This Release of Liability and Indemnification Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in favor of the Nehemiah Community Development Corporation, its officers, directors, employees, volunteers, agents, sponsors, and affiliates (collectively, the "Released Parties").

1.          EVENT.
Participant desires to voluntarily participate in the Pickleball Tournament (the "Event").

 

2.          ASSUMPTION OF RISK.

Participant understands that participation in the Event involves inherent risks, including but not limited to physical injury, illness, permanent disability, or death, and damage to personal property. Participant knowingly and voluntarily assumes all such risks, whether known or unknown.

3.      RELEASE AND WAIVER.
Participant hereby releases, waives, and discharges the Released Parties from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to participation in the Event, including those caused by the negligence of the Released Parties, to the fullest extent permitted by law.

4.      INDEMNIFICATION.
Participant agrees to indemnify, defend, and hold harmless the “Released Parties” from any and all claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to Participant’s participation in the Event or breach of this Agreement.

5.      MEDICAL TREATMENT.
Participant consents to receive medical treatment deemed necessary in the event of injury, accident, or illness during the Event and agrees to be responsible for all associated costs.

6.      PHOTOGRAPHY AND MEDIA RELEASE.
Participant grants permission for the charitable organization to use photographs, video, or other media taken during the Event for lawful promotional purposes without compensation.

7.      GOVERNING LAW.
This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, where the Event is held.

8.      ACKNOWLEDGMENT.
Participant acknowledges that they have read and fully understand this Agreement and sign it freely and voluntarily.
