  • Release of Liability, Assumption of Risks and Indemnity Agreement

    ASSUMPTION OF RISKS: I understand that riding and being around horses are inherently dangerous activities. Horses are powerful, easily frightened, unpredictable animals. All horses, even those that are well trained and appear gentle, may buck, rear, stop short, change direction or speed at will, shy, spook, strike, bite, bolt — all without warning and without apparent cause or in response to wind, sounds, movement of people, cars, bikes or other animals. The inherent risk includes loss of control, falling or being thrown off, being stepped on, collisions with fences, gates, trees, horses or other obstacles, or being hung up or entangled in stirrups, reins or other gear. Tack may break and cinches may come loose. I understand that SERIOUS PERMANENT BODILY INJURY, DISABILITY OR DEATH MAY RESULT from handling, riding or being in the vicinity of horses, and the property belonging to me or others may be damaged as well. I HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS of injury, disability, illness or death, including financial losses and damage or destruction of property resulting from riding or being in the vicinity of horses, including risks caused by negligence of the released parties.

    1. RELEASE OF LIABILITY, INCLUDING LIABILITY FOR NEGLIGENCE: On behalf of myself, my family, heirs, estate, distributees, guardians, legal representatives and assigns, I hereby release the released parties and each of them from all claims, demands, causes of action and liabilities based on injury, disability, illness, death, financial loss, property loss or damage, or other harm suffered by me, or by any third party which I may be held responsible, that may result from my participation in or being in the vicinity of the horse-related activities conducted by the released parties, whether caused by negligence of the released parties or otherwise, excepting the released parties’ willful misconduct or gross negligence.
    2. INDEMNIFICATION: I agree to indemnify, defend and hold harmless each of the released parties from and against any and all claims for injury or death resulting from participation in horse-related activities conducted by the released parties, by or prosecuted for the benefit of myself or my family, estate, heirs, representatives or assigns, and any claim for injury or death of any person whom I may bring or invite to the vicinity of the horse-related activities in which I am participating.
    3. BINDING LEGAL DOCUMENT: If any provision of this release is held to be unenforceable, such provision shall be excluded and the balance of the release shall be enforced in accordance with the remaining terms. I have read this release and understand that I am giving up legal rights. I have executed it knowingly and voluntarily without relying on any statement or representation of any of the released parties. I understand that this is a binding legal document. I represent that I am 18 years of age or older and am legally competent to enter into this release myself. If signing for a minor, I represent that I am the parent or duly appointed legal guardian of the minor for whom I am signing this release.

  • CANCELLATION POLICY 

    Our promise of providing the highest quality care for our clients requires commitment. We attempt to accommodate each person with regards to scheduling.  

    • PLEASE ARRIVE 10-15 MINUTES BEFORE ANY SCHEDULED LESSON, RIDE OR EVENT
    • If a client is late for an appointment, the client will use the remainder of the scheduled appointment and be charged in full. 
    • A scheduled appointment MUST BE CANCELLED AT LEAST 24 HOURS IN ADVANCE OR THE CLIENT WILL BE CHARGED IN FULL. 

    RIDER PRESENTATION STANDARDS & ATTIRE:

    All riders are required to arrive in proper riding attire. Summit Equestrian Club does not provide or loan riding gear.

    Required: ASTM/SEI-certified helmet; breeches for English riding and paddock boots or tall boots with a heal, or jeans for Western riding with cowboy boots. Shirts must be neatly tucked in with a belt, and all riders are expected to maintain proper equestrian attire. Tank tops are not permitted. Proper attire is required for safety, comfort, and a professional appearance.

    Recommended: riding gloves, and a fitted top appropriate for riding.

    If you are in need of riding attire, we are partnered with Manhattan Saddlery, or Dapper Horse in Brewster. 

     

    ACKNOWLEDGMENT:

    I understand that submissions of this form does not guarantee a spot. Placement is confirmed upon receipt of payment and a completed and signed form. Programs are offered on a first come, first served basis. All payments are non-refundable.
