I herby represent and warrant that I am the PARENT/LEGAL GUARDIAN of the MINOR PARTICIPANT, and that I have the full power, authority, capacity and right, without limitation, to enter into, execute, deliver and perform this WAIVER OF LIABILITY ("Agreement").
I acknowledge the following:
- I have read this Waiver of Liability fully and understand its contents.
- MINOR PARTICIPANT is physically able to participate in the Event.
- I am aware of the risks associated with participation in the Event.
I expressly acknowledge that the MINOR PARTICIPANT'S participation in the Event will expose the MINOR PARTICIPANT to such hazards. I herby represent that I am very aware of the skills and abilities of the MINOR PARTICIPANT and represent that the MINOR PARTICIPANT has the physical and mental ability to engage safely in the Event. I further acknowledge on behalf of the MINOR PARTICIPANT that MINOR PARTICIPANT is voluntarily participating in the Event and that the undersigned and MINOR PARTICIPANT are participating with full knowledge of the inherent risk, hazards and dangers involved. Releasor understands and acknowledges that Madison County Livestock and Fair Association rodeo activities and the sport of rodeo in general have inherent dangers that no amount of care, caution, training, instruction, supervision or expertise can eliminate. As such, I hereby assume and accept, individually and on behalf of MINOR PARTICIPANT, our heirs, successors, executors, administrators and personal representatives, any and all risks of injury or death associated with MINOR PARTICIPANT participating in the event and being on the premises prior to, during and after the Event. The undersigned acknowledges that the Madison County Livestock and Fair Association is relying upon the representations and acknowledgements made herein by the undersigned in allowing the MINOR PARTICIPANT to participate in the EVENT. The undersigned further acknowledges that the Madison County Livestock and Fair Association WOULD NOT allow MINOR PARTICIPANT to participate in the Event if the representations and acknowledges made herein were not made.
Being possessed of all my faculties and capabilities, I for myself and on behalf of the minor participant, our heirs, succesors, executors, administrators and personal representatives (all hereinafter "Releasers") HERBY KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY, HOLD HARMLESS AND COVENANT NOT TO SUE THE MADISON COUNTY LIVESTOCK AND FAIR ASSOCIATION, its insurers, administrators, agents, directors, officers, volunteers, participants, officials, judges, sponsoring agencies, sponsors, advertisers, local organizing committees, property owners, lessors, operators of the premises, heirs, successors and assigns (all hereinafter "Releasees"), from any and all libilities, claims, demands, causes of action, expenses, or losses of any kind or nature, past present or future, direct or consequential that I may hereafter have, and hereby expressly and voluntarily assume all risk for PERSONAL INJURY, PERMANENT, TEMPORARY, TOTAL OR PARTIAL DISABILITY, DISFIGUREMENT, PARALYSIS AND ANY OTHER LOSSES OR DAMAGES TO PERSON OR PROPERTY OR DEATH, arising out of my participation in, attendance at or traveling to and from any Madison County Fair rodeo event or activity, including, but not limited to, negligence of any kind of nature, whether foreseen or unforeseen, arising directly or indirectlyout of minor's participation whether such damage or loss was caused or alleged to be caused, in whole or in part, by the negligence of the Releasees or otherwise.
I also agree to use of my photograph or image(s) and/or my child's photograph or image to be used in future web pages, print advertising, news/press releases, television, video and other advertising promotional work by the Madison County Livestock and Fair Association.
