IN CONSIDERATION OF the risk of injury that exists while participating in GENERAL CLEANING DUTIES(hereinafter the “Activity”); and

IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same;

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, “Releasor”), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims, or causes of action of any kind arising out of my participation in the Activity.

I HEREBY release and forever discharge JMS HOME SOLUTIONS LLC, located at 1522 Cornette Way, Louisville, Kentucky 40216, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns (collectively, “Releasees”), from any physical or psychological injury that may result from my participation in the aforementioned Activity.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I am aware of the risks associated with participating in this Activity which may include, but are not limited to: physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others’ negligence, conditions related to travel to and from the Activity, or from conditions at the Activity location(s). Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this Activity.

I FURTHER AGREE to indemnify, defend, and hold harmless the Releasees against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney’s fees and related costs.

I FURTHER ACKNOWLEDGE that the Releasees are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of the Releasees. In the event that I should require medical care or treatment, I authorize JMS HOME SOLUTIONS LLC to provide all emergency medical care deemed necessary, including but not limited to first aid, CPR, use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

I FURTHER ACKNOWLEDGE that this Activity may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. I agree not to participate in the Activity unless I am medically able and properly trained, and I agree to abide by the decision of the JMS HOME SOLUTIONS LLC official or agent regarding my approval to participate in the Activity.

I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I expressly agree to release and discharge JMS HOME SOLUTIONS LLC and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, from any and all claims or causes of action and agree to voluntarily give up or waive any right that I otherwise may have to bring a legal action against JMS HOME SOLUTIONS LLC for personal injury or property damage.

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of JMS HOME SOLUTIONS LLC, its agents, and employees.

I agree that this Release shall be governed for all purposes by Kentucky law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements.

In the event that any damage to equipment or facilities occurs as a result of my or my family’s or my agent’s willful actions, neglect, or recklessness, I acknowledge and agree to be held liable for any and all costs associated with such actions of neglect or recklessness.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT for the duration of my participation in the Activity, during this initial and all subsequent events of participation.

THIS AGREEMENT was entered into at arm’s length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength.

JMS HOME SOLUTIONS LLC agrees that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase, or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed, and enforced as so limited.

EN CONSIDERACIÓN del riesgo de lesiones que existe al participar en TAREAS GENERALES DE LIMPIEZA (en adelante, la “Actividad”); y

EN CONSIDERACIÓN de mi deseo de participar en dicha Actividad y de que se me otorgue el derecho a participar en la misma;

POR LA PRESENTE, yo, por mí mismo(a), mis herederos, albaceas, administradores, cesionarios o representantes personales (en adelante, colectivamente, el “Liberador”), de manera consciente y voluntaria entro en esta EXENCIÓN Y LIBERACIÓN DE RESPONSABILIDAD y por la presente renuncio a cualquier y todos los derechos, reclamaciones o causas de acción de cualquier tipo que surjan de mi participación en la Actividad.

POR LA PRESENTE libero y eximo de toda responsabilidad de manera permanente a JMS HOME SOLUTIONS LLC, ubicada en 1522 Cornette Way, Louisville, Kentucky 40216, así como a sus afiliados, gerentes, miembros, agentes, abogados, personal, voluntarios, herederos, representantes, predecesores, sucesores y cesionarios (colectivamente, los “Liberados”), por cualquier lesión física o psicológica que pueda resultar de mi participación en la Actividad antes mencionada.

PARTICIPO VOLUNTARIAMENTE EN LA ACTIVIDAD ANTES MENCIONADA Y LO HAGO BAJO MI PROPIO RIESGO. Reconozco que existen riesgos asociados con la participación en esta Actividad, los cuales pueden incluir, entre otros: lesiones físicas o psicológicas, dolor, sufrimiento, enfermedad, desfiguración, discapacidad temporal o permanente (incluida la parálisis), pérdidas económicas o emocionales, e incluso la muerte. Entiendo que dichas lesiones o resultados pueden surgir por mi propia negligencia o la de otras personas, por condiciones relacionadas con el traslado hacia o desde la Actividad, o por condiciones en el(los) lugar(es) donde se lleve a cabo la Actividad. No obstante, asumo todos los riesgos relacionados, tanto conocidos como desconocidos, asociados con mi participación en esta Actividad.

ADEMÁS, ACEPTO indemnizar, defender y mantener indemnes a los Liberados frente a cualquier y toda reclamación, demanda o acción de cualquier naturaleza relacionada con responsabilidad, daños, compensación u otros conceptos, presentada por mí o por cualquier persona en mi nombre, incluidos los honorarios de abogados y costos relacionados.

ASIMISMO, RECONOZCO que los Liberados no son responsables por errores, omisiones, actos o faltas de actuación de ninguna persona o entidad que lleve a cabo un evento o actividad específica en nombre de los Liberados. En caso de que requiera atención médica o tratamiento, autorizo a JMS HOME SOLUTIONS LLC a proporcionar toda atención médica de emergencia que se considere necesaria, incluyendo, entre otros, primeros auxilios, RCP, uso de desfibriladores externos automáticos (AED), transporte médico de emergencia y el intercambio de información médica con el personal médico correspondiente. Asimismo, acepto asumir todos los costos involucrados y reconozco que soy financieramente responsable de cualquier gasto incurrido como resultado de dicho tratamiento. Reconozco y entiendo que debo contar con mi propio seguro médico.

RECONOZCO ADEMÁS que esta Actividad puede implicar una prueba de los límites físicos y mentales de una persona y puede conllevar el riesgo de muerte, lesiones graves y pérdida de propiedad. Acepto no participar en la Actividad a menos que esté médicamente apto(a) y debidamente capacitado(a), y acepto acatar la decisión de cualquier funcionario o agente de JMS HOME SOLUTIONS LLC con respecto a mi autorización para participar en la Actividad.

POR LA PRESENTE RECONOZCO QUE HE LEÍDO CUIDADOSAMENTE ESTA “EXENCIÓN Y LIBERACIÓN” Y QUE COMPRENDO PLENAMENTE QUE SE TRATA DE UNA LIBERACIÓN DE RESPONSABILIDAD. Acepto expresamente liberar y eximir de responsabilidad a JMS HOME SOLUTIONS LLC y a todos sus afiliados, gerentes, miembros, agentes, abogados, personal, voluntarios, herederos, representantes, predecesores, sucesores y cesionarios, de cualquier y toda reclamación o causa de acción, y acepto renunciar voluntariamente a cualquier derecho que de otro modo pudiera tener para iniciar una acción legal contra JMS HOME SOLUTIONS LLC por lesiones personales o daños a la propiedad.

En la medida en que la ley o la jurisprudencia aplicable no prohíba las exenciones por negligencia ordinaria, esta liberación también se aplica a la negligencia ordinaria por parte de JMS HOME SOLUTIONS LLC, sus agentes y empleados.

Acepto que esta Exención se regirá, para todos los efectos, por las leyes del Estado de Kentucky, sin considerar los principios de conflicto de leyes. Esta Exención sustituye cualquier promesa u acuerdo previo, ya sea oral o escrito.

En caso de que ocurra algún daño a equipos o instalaciones como resultado de acciones intencionales, negligentes o imprudentes por mi parte, o por parte de mi familia o mis agentes, reconozco y acepto ser responsable de todos los costos asociados con dichas acciones de negligencia o imprudencia.

ESTA EXENCIÓN Y LIBERACIÓN DE RESPONSABILIDAD PERMANECERÁ EN VIGOR durante toda la duración de mi participación en la Actividad, tanto en esta participación inicial como en cualquier participación posterior.

ESTE ACUERDO se celebra de manera libre, sin coacción ni presión indebida, y deberá interpretarse como un acuerdo entre dos partes con igual poder de negociación

JMS HOME SOLUTIONS LLC reconoce y acepta que este acuerdo es claro e inequívoco en cuanto a sus términos, y que no se utilizará ni admitirá ninguna otra evidencia para modificar o explicar los términos de este acuerdo, sino que será interpretado conforme al lenguaje del mismo y de acuerdo con los fines para los cuales fue celebrado.

En caso de que cualquier disposición contenida en esta Exención de Responsabilidad sea considerada divisible o inválida, o si cualquier término, condición, frase o parte de este acuerdo se determinara como ilegal o de otro modo inaplicable, el resto de este acuerdo permanecerá en pleno vigor y efecto. Si un tribunal determinara que alguna disposición de este acuerdo es inválida o inaplicable, pero que al limitar dicha disposición esta se volvería válida y exigible, entonces dicha disposición se considerará redactada, interpretada y aplicada con dicha limitación.

I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT, AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.

CERTIFICO QUE HE LEÍDO ESTE ACUERDO, QUE COMPRENDO PLENAMENTE SU CONTENIDO, Y QUE ESTA EXENCIÓN NO PUEDE SER MODIFICADA DE FORMA VERBAL. RECONOZCO QUE ESTE DOCUMENTO CONSTITUYE UNA EXENCIÓN DE RESPONSABILIDAD Y UN CONTRATO, Y QUE LO FIRMO POR MI PROPIA Y LIBRE VOLUNTAD.
