  • These disclosures are required annually under the Municipal Officers' and Employees' Ethics Act (Utah Code Annotated 10-3-1301) to ensure that public officials and employees avoid conflicts of interest. The filing deadline for the 2026 calendar year is January 31, 2026.

    If an officer, employee, or appointed officer is appointed, hired, or otherwise becomes a member after the beginning of the calendar year, the disclosure must be filed within 30 days of the appointment, hiring, or change in status.

    Boulder Town will maintain the information disclosed on this form, which is subject to public disclosure.

  • Step 2: Business Entities Subject to Boulder Town Regulation

    Examples of disclosable business entities (non-exhaustive):

    • A construction company requiring town-issued building permits or zoning variances.

    • A property management firm that owns or operates rental units subject to town housing ordinances.
    • A development company seeking plat approval or conditional use permits from the Planning Commission.
  • MANDATORY DISCLOSURE: 

    Pursuant to Utah Code Section 10-3-1307, an officer must disclose their interest in an open and public meeting immediately prior to any discussion pertaining to business the Town may do with the entity, even if already disclosed in this form.

    Key Terms Defined: 

    • Substantial Interest: defined in Utah Code Section 10-3- 1303(9) as the ownership, either legally or equitably, by an individual, the individual's spouse, or the individual's minor children, of at least 10% of the outstanding shares of a corporation or 10% interest in any other business entity.
    • Officer, Employee, and Appointed Officer: These terms refer to individuals formally designated or hired to perform duties for an organization or the Town, including elected and appointed positions.
    • Agent: An individual authorized to act on behalf of a business entity oranother person.
    • Regulation (in the context of Section 2): Refers to the rules, ordinances, permits, licenses, or other authoritative actions of Boulder Town that govern or impact the business entity's operations, actions, or conduct within the town's jurisdiction.

  • Step 3: Business Entities Doing Business with or Anticipating Doing Business with Boulder Town 

    Examples of disclosable business entities (non-exhaustive):

    • A local contractor providing snow removal, road maintenance, or water/sewer line repair services under a town contract.
    • A law firm, financial auditor, or planning consultant retained by the Town for ongoing or project-specific legal/financial/land-use guidance.
    • A company with a contract to install, maintain, or upgrade public infrastructure, such as internet, street lighting, or water system components.
    • A vendor supplying office equipment, vehicles, or specialized software/IT support to the Town offices.
    • A local real estate agency or appraiser hired by the Town to assist with the acquisition or disposal of municipal property.

  • Step 4: Personal Interests/Investments Creating Potential or Actual Conflict

    Examples of disclosable personal interests (non-exhaustive):

    • Owning property immediately adjacent to a parcel being considered for a zone change, variance, or annexation that you will vote on.
    • Holding a substantial investment (10% or more ownership) in a local business seeking an exclusive contract or special allocation of town funds.
    • A personal loan or debt relationship with a principal of a company bidding on a major Town contract.
    • Serving on a board that is currently applying for Town funding or a land-use approval.

    This includes any personal investment, property ownership, or relationship that could influence your official decision-making (e.g., owning property that may be rezoned by a vote you participate in).

    Step 5: Further Disclosure

    This section allows for the voluntary disclosure of other business interests, investments, and personal matters, including gifts. While not all disclosures in this step are legally mandated, they are based on best practice and align with a comprehensive ethics program that promotes full transparency and accountability. They are offered to provide a comprehensive view of any interests that might be relevant to the execution of public duties, or to fully detail economic or personal activities.

    1. Relationships: Do any of your immediate family members (parents, siblings, adult children) currently work for or conduct business with Boulder Town?

    2. Volunteering/Board Seats: Are you a member of any boards or volunteer organizations that either receive funding from or otherwise interact with Boulder Town?

    3. Gifts Disclosure: Have you received any gifts, other than those exempted by law (e.g., promotional items of nominal value, gifts from family), in connection with your official duties during the reporting period?
