Waiver and Release of Liability, Defense, Indemnity, and Hold Harmless Policy & Directives.
This Waiver and Release of Liability / Defense, Indemnity, and Hold Harmless Agreement (the “Agreement”) affects your legal rights. Please read this in its entirety, and seek legal counsel about its effect on your legal rights if you deem necessary.
WAIVER, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT I. DEFINITIONS For the purposes of this Agreement, the following definitions shall apply: "Participant" shall refer to any individual attending or participating in the Event in any capacity, including but not limited to cyclists ("Riders"), non-riding attendees, Volunteers, and Volunteer Guides."Released Parties" shall collectively refer to the Volunteer Event Organizers, Event Sponsors, and their respective parent organizations, owners, partners, directors, officers, employees, agents, volunteers, guides, affiliates, event site/trail landowners, and all related entities. II. ACKNOWLEDGMENT OF VOLUNTARY PARTICIPATION The Participant acknowledges that their participation in the Event is entirely voluntary. The Participant further understands and agrees that the activities provided at the Event are not unique and that the Participant has the opportunity to engage in similar activities independently, at other locations, and at various times throughout the year. III. EVENT ADMINISTRATION AND DISCRETION Inclement Weather: The Event shall proceed “rain or shine.” The Participant acknowledges that all suggested donations are non-refundable, regardless of weather conditions or event cancellation. Modifications: The Volunteer Event Organizers reserve the unilateral right to modify the Event schedule, logistics, or specific details at their sole discretion, for any reason deemed necessary. Revocation of Participation: The Volunteer Event Organizers reserve the right to revoke a Participant’s admission or participation at any time, without prior notice or refund of suggested donations, should such action be deemed necessary in the interest of the Event. IV. STANDARD OF CONDUCT AND PERSONAL RESPONSIBILITY Participants are strictly required to conduct themselves in a safe, reasonable, and responsible manner at all times. This duty of care extends to the Participant’s own person and the safety of all other attendees. The Participant acknowledges that while the Volunteer Event Organizers may enforce conduct standards, they do not assume any legal duty or responsibility for the individual actions, omissions, or personal safety of any Participant. V. RELEASE, DEFENSE, AND INDEMNIFICATION As a condition of participation, the Participant hereby irrevocably agrees to waive, release, and forever discharge the Released Parties from any and all liability, claims, or causes of action. Furthermore, the Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, losses, damages, or expenses (including legal fees) arising out of or resulting from the Participant’s presence at, or participation in, the Event.VI. SEVERABILITY AND GOVERNING LAW Should any provision of this Agreement be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire understanding between the parties regarding the subject matter herein.
Assumption & Acceptance of Risk
Participant Waiver and Release of Liability 1. Assumption of Risk I acknowledge that mountain biking and volunteer trail building are inherently dangerous activities. I understand that injuries, disability, or death can occur regardless of my experience, training, or use of safety equipment. By signing this, I freely accept and fully assume all risks, including but not limited to: Environmental Hazards: Changing weather, falling objects (rocks, trees), steep terrain, cliffs, and water features. Equipment & Mechanical Issues: Failure of bikes, tools, or safety gear. Human Factors: Collisions with other riders, pedestrians, or vehicles; encounters with wildlife; and the potential for becoming lost. Negligence: I specifically acknowledge and assume the risk of NEGLIGENCE on the part of Westside Trail Federation (including its directors, officers, employees, and volunteers) in their failure to safeguard me from these hazards. 2. Loaned Equipment I accept all equipment (bikes, helmets, trail tools, etc.) provided by Westside Trail Federation in "as-is" condition. Responsibility: I am responsible for the equipment until it is returned and agree to return it in the same condition it was received. Liability: I agree to waive and release Westside Trail Federation from any claims or losses resulting from the use of this equipment. I will indemnify and defend the Federation against any legal costs arising from my use of loaned gear. 3. Shuttle and Transport I understand that event shuttles involve transporting many bikes over rough terrain. Damage Risk: I acknowledge that cosmetic or structural damage to my bicycle may occur during transport. Release: I hold the "Released Parties" harmless for any property damage occurring during the shuttle process. If I wish to avoid this risk, I understand I have the option to transport the bike myself. 4. Indemnification and Release I agree to waive, release, and hold harmless Westside Trail Federation and its affiliates from all claims, actions, or proceedings resulting from my participation. Minors: This release applies equally to any claims brought on behalf of a minor in my charge. Legal Costs: I agree to defend and indemnify the Federation (including covering attorney fees) for any claims arising from my participation or the participation of minors in my care. 5. Photo and Media Release I grant Westside Trail Federation the irrevocable right to use, publish, and edit any photographs or video footage taken of me during the event for commercial, editorial, or advertising purposes without compensation or prior approval. 6. Verification I verify that I have read this document in its entirety. I understand that by signing, I am giving up substantial legal rights.
Motor Vehicle Liability
If you use a personally owned vehicle in the course of your duties, you are required to have automobile liability insurance to provide your primary coverage for any accidents involving that vehicle.

PARENT OR GUARDIAN’S AUTHORIZATION FOR MEDICAL CARE AND CONSENT TO AGREEMENT READ CAREFULLY
As parent or legal guardian, I hereby grant permission for the (Minor listed below) to do volunteer work for Westside Trail Federation. In the event of an emergency, accident, or illness, I authorize Westside Trail Federation and it's Volunteers to administer emergency medical care to my child and/or, if deemed necessary, to secure emergency medical services and incur expenses for which I will be responsible for payment. My signature below hereby represents that I have read, understand, and consent to this agreement.
