Better Your Business Partner Agreement

This Agreement is made between Better Your Business ("Company") and   First Name   Last Name   ("Partner").

The Partner is an independent contractor. Nothing in this agreement shall be construed to create a partnership, joint venture, or employer-employee relationship. Partner has no authority to bind the Company to any legal obligations.

1. Referral Process
The partner is responsible for:

• Identifying and reaching out to small business owners.
• Presenting the value proposition and ROI of Company services.
• Facilitating the signing of new clients via Company-approved tools.

2. Compensation (The 80/10 Model)
The Company shall pay the partner based strictly on performance:

• Upfront Commission: 80% of the first month’s subscription fee for every new client successfully signed and paid.
• Recurring Residual: 10% of the monthly fee for the lifetime of the client, beginning in Month 2.
• Payment Terms: Payouts occur [Instantly] after the client’s payment has cleared.
• No Salary: The partner acknowledges this is a commission-only role with no base salary or hourly wage.

3. The "Partner" Status

• Non-W2: The partner is an independent contractor, not an employee.
• Taxes: Responsible for all self-employment taxes, income taxes, and insurance.
• Autonomy: Has the right to determine their own schedule, location, and methods of solicitation, provided they represent the Company professionally.
• No Equipment Provided: Use their own tools (phone, computer, internet) to perform the services.

4. Non-Disclosure Agreement (NDA) & Confidentiality
The partner acknowledges that they will have access to sensitive information, including but not limited to proprietary lead lists, internal training resources, and client data.

• Confidentiality: Agrees to keep all "Confidential Information" strictly secret. This includes business strategies, trade secrets, and the "Weekly Lead Lists" provided by the Company.
• Non-Use: Shall not use Confidential Information for any purpose other than performing services for the Company.
• Return of Property: Upon termination of this agreement, the partner must immediately return or destroy all lead lists and company-provided materials.

5. Non-Solicitation
During the term of this agreement and for one (1) year thereafter, the partner shall not attempt to divert Company clients to a competitor or solicit Company employees/contractors for other business ventures.

6. Termination

Either party may terminate this agreement at any time with written notice. Upon termination, the partner shall be entitled only to commissions for clients closed prior to the termination date. Residual payments will continue as long as the client remains active.

Fees: Contractor/Partner acknowledges that PayPal may deduct standard transaction fees from the payout amount. Better Your Business is not responsible for fees charged by PayPal for receiving funds.

Verification: Contractor is responsible for ensuring their PayPal account is "Verified" to avoid payment holds or delays.

4. Authorization

I hereby authorize Better Your Business to send all earned commissions and residuals (the 80/10 model mention in business agreement) to the PayPal email address listed above. I understand that it is my responsibility to notify the Company in writing if my payment email changes.
