  • This Client Service Agreement (“Agreement”) is entered into between Wellington Home Watch (the “Service Provider”) and the undersigned Client. By signing this Agreement, the Client affirms that they are the property owner or have been duly authorized by the owner to grant access and provide instructions under this Agreement.

  • 1. PURPOSE OF SERVICES

    Wellington Home Watch provides scheduled Home Watch services consisting of

    • visual non-invasive,
    • observational inspections
    • of unoccupied or intermittently occupied residential and commercial properties for the purpose of reporting observable conditions to the Client.
  • 2. SCOPE OF SERVICES

    All services provided under this Agreement are:

    •  Visual
    •  Non-invasive
    •  Observational only Wellington Home Watch does not:
      • Perform repairs or maintenance
      • Test alarms, valves, breakers, pumps, HVAC
      • Detect hidden, intermittent, or developing conditions
      • Enter attics, crawlspaces, roofs, or unsafe areas
      • Guarantee detection of leaks, mold, pests, or failures
      • Provide licensed trade services
      • Observations reflect conditions present at the time of inspection only.
      • Act as an insurer, guarantor, or loss-prevention provider
  • 3. NO GUARANTEE


    I, the Client, acknowledges and agrees that Wellington Home Watch services:
     
    * Do not guarantee the prevention of damage, loss, theft, or system failure
    * Do not replace routine maintenance, insurance coverage, or professional services

  • Access and Authorization
    The Client authorizes Wellington Home Watch and its representatives to enter the property listed in the service agreement for the sole purpose of performing contracted Home Watch and related services. This authorization includes, but is not limited to, visual inspections of the interior and exterior of the property, operation of lights, faucets, thermostats, appliances, irrigation controls, and other systems as reasonably necessary to perform services.

    The Client affirms that they have the legal authority to grant access to the property and agrees to provide all necessary keys, codes, gate access, alarm instructions, and other means of entry required to perform services. The Client understands that failure to provide accurate or current access information may prevent services from being completed.

    The Client authorizes Wellington Home Watch and its authorized representatives to contact emergency services, repair professionals, utilities, or designated contacts in the event of an emergency or condition that may threaten the property.

    The Client further authorizes Wellington Home Watch and its authorized representatives to grant access to the property to such parties when reasonably necessary to protect the property, with the understanding that Wellington Home Watch does not perform repairs and accepts no liabilty for the cost of these services. Services performed under this cluse and the costs for time accrued by Wellington home watch are wholy the responsibility of the Client.. 

    This authorization remains in effect for the duration of the service agreement unless revoked in writing.

  • I, the Client, hereby authorizes Wellington Home Watch and its representatives to enter the property listed in this agreement*
  •  4. AUTHORIZATION & ACCESS
     
    I the Client, authorizes Wellington Home Watch to access the property using approved methods as documented in the Client Authorization Form.
     
    Interior access will occur **only if expressly authorized ** by the Client.
     

  • 5. CLIENT RESPONSIBILITIES
     
    The Client is responsible for:
    * Providing accurate property and access information
    * Ensuring alarm systems and access methods function as instructed
    * Responding to notifications in a timely manner
    * Engaging licensed professionals for repairs or diagnostics

    * Maintaining active insurance coverage
    * Updating emergency contacts

  • 6.Key & Access Authorization

    The Client authorizes Wellington Home Watch to retain and use property access credentials, including physical keys, alarm codes, smart lock credentials, garage remotes, and related access devices for the sole purpose of performing contracted services.

    The Client agrees to:

    • Provide accurate and functional access credentials.
    • Inform Wellington Home Watch immediately of any changes to locks, codes, or access permissions.
    • Maintain appropriate insurance coverage for the property.                                                                                                                                            Wellington Home Watch maintains structured key control and credential management procedures. While reasonable precautions are taken to safeguard keys and access information, Wellington Home Watch shall not be responsible for losses resulting from:
    • Pre-existing security vulnerabilities,
    • Unauthorized third-party access beyond its control,
    • Failure of mechanical or electronic security systems.                                         In the event of lost or compromised keys while under the care, custody, and control of Wellington Home Watch, liability shall be limited to the reasonable cost of re-keying affected locks.
      Upon termination of services, access credentials will be returned or deleted in accordance with company policy.

     

    • 7. EMERGENCY AUTHORIZATION
       
      In the event of a condition presenting an **immediate risk to life or property** I, the Client, authorizes Wellington Home Watch to:

    • * Exit the property if unsafe
      * Contact emergency services
      *Document the Condition
    • * Notify the Client as soon as reasonably possible
       
      No corrective actions will be taken without explicit Client authorization unless required for personal safety.
  • 8. LIMITATION OF LIABILITY

     

    Services are observational only and non-continuous.

    Welllingtom Home Watch is not responsibe for:

    •  for conditions arising between visits
    • Liability is limited to the value of the service fee for the affected visit unless otherwise required by law
    • No warranties, express or implied, are provided
  •  9. INSURANCE
     
    Wellington Home Watch maintains:
     
    * $2,000,000 General Liability Insurance
    * Errors and Omissions Insurance
    * Bonding coverage
     
    Coverage applies only within the defined scope of services authorized by the Client

  • 10. Payment, Pricing & Invoicing Terms

    The Client acknowledges and agrees that:

    Service pricing, travel/mileage charges, add-on fees, premium rate multipliers (e.g. after-hours, statutory holidays), and emergency billing terms are those published on the Wellington Home Watch website and Pricing Policy at the time services are ordered or requested;
    Invoices for services may be issued after services are performed and are due within the stated terms (e.g., 7 days) unless otherwise agreed in writing;
    The Client authorizes Wellington Home Watch to charge the payment method provided on file for recurring service plans, authorized add-on services, emergency service attendance, mileage charges, and any unpaid invoice balances where payment has not been received within the stated terms;
    Accounts not paid within the stated terms may result in suspension, cancellation, or refusal of services, and may be referred to lawful collection remedies.

  •  11. FEES & TRAVEL
     
    Service fees are based on the authorized inspection level and frequency. Travel beyond the included distance may incur additional charges as outlined in the pricing structure provided to the Client.

  •  12.Emergency and Incident Response services
    Emergency and Incident Response services are subject to the hourly rates and premium multipliers outlined on the Wellington Home Watch website at the time of service.

  • 13. TERM & TERMINATION
     
    This Agreement remains in effect until terminated in writing by either party in accordance with the agreed terms.

  •  14. GOVERNING LAW
     
    This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario.
     

  •  15. ELECTRONIC RECORDS & COMMUNICATION


    The Client agrees that all agreements, notices, reports, photographs, and service communications may be delivered electronically via the email address provided. The Client acknowledges that this email address constitutes the primary identifier for services, records, and report delivery.
     

  •  16. ACKNOWLEDGEMENT & SIGNATURES


    I, the Client, confirm that I have read, understand, and agree to the terms of this Agreement.
