LIABILITY WAIVER FOR PRIVATE LAND
Brownsville Athletics will operate on private land. All athletes, spectators, visitors, and siblings must agree to follow field rules while attending activities. Failure to do so will result in player being disqualified from the team. Any spectators, or athletes, abusing the Haymaker field will be asked to leave and police will be notified for assistance. There is a zero tolerance for feral siblings. Parents are fully responsible for their own children at all times. In order to participate in this sports program, these forms must be signed by athletes and parents. Hard copies will also be signed at parent meeting. There will also be a zero tolerance for drugs or alcohol being brought onto the property.

BROWNSVILLE ATHLETICS HAYMAKER - COMPETITIVE SPORTS PROGRAM ABSOLUTE CONDITION OF ENTRY NO PERSON MAY ENTER OR REMAIN ON THE PROPERTY for any purpose related to the above activities WITHOUT ACCEPTING ALL TERMS OF THIS AGREEMENT, WHETHER OR NOT THEY SIGN IT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. 1. Comprehensive Assumption of Risk I understand and expressly acknowledge that entering private property where athletic activity occurs is inherently dangerous, whether I am a participant, spectator, parent, guest, volunteer, or observer. I knowingly and voluntarily assume ALL RISKS, including but not limited to: • Serious bodily injury, permanent disability, paralysis, disfigurement, or death • Being struck by people, balls, equipment, or debris • Slips, trips, falls, collisions, or contact with structures or terrain • Natural and artificial hazards, open and obvious or concealed • Weather conditions • Negligent acts or omissions of participants, spectators, staff, or third parties • Lack of supervision, instruction, security, maintenance, warnings, or medical care I assume these risks whether or not they are caused by negligence, property condition, activity design, or failure to act. 2. Absolute Release and Waiver of Liability To the fullest extent permitted by law, I irrevocably and unconditionally release, waive, and forever discharge: • The Property Owner • All organizers, instructors, coaches, officials, volunteers • Any family members, agents, insurers, successors, or assigns from any and all claims, causes of action, liabilities, damages, losses, costs, or demands of any kind, whether known or unknown, suspected or unsuspected, arising out of or related to: • My entry upon or presence on the property • My participation in or observation of any activity • The condition, layout, design, or maintenance of the property • The absence of warnings, barriers, supervision, or safety measures This release expressly includes claims based on ordinary negligence and premises liability, to the maximum extent allowed by law. 3. Covenant Not to Sue I agree that I will not initiate or assist in any lawsuit, claim, arbitration, or administrative action against any released party for any matter covered by this agreement. 4. Indemnification and Defense (Broad Form) I agree to fully indemnify, defend, and hold harmless the released parties from any and all claims, including third-party claims, arising from: • My presence on the property • My actions or omissions • The actions or injuries of any minor, guest, or dependent under my supervision • Any claim brought despite this waiver This obligation includes attorney’s fees, court costs, settlements, and judgments, and applies regardless of fault to the fullest extent permitted by law. 5. No Duties Owed I expressly agree and acknowledge that the Property Owner and program staff: • Owe no duty of care, supervision, inspection, or maintenance • Provide no safety assurances • Provide no medical services or emergency response • Are not responsible for enforcing rules or controlling conduct 6. Medical Consent and Financial Responsibility I authorize emergency medical treatment at my own expense if deemed necessary. I accept sole financial responsibilityfor all medical care, transport, and related costs. 7. Insurance Disclaimer I understand that no insurance of any kind (medical, accident, liability) is provided for participants or spectators. I am solely responsible for maintaining my own coverage. 8. Binding Effect; Unknown Claims This agreement applies to all injuries and damages, including those not presently known or anticipated, and is binding upon me, my heirs, executors, administrators, assigns, and next of kin. 9. Severability and Survival If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. All releases and indemnities survive the activity and my presence on the property. 10. Governing Law, Venue, and Exclusive Jurisdiction This agreement shall be governed by the laws of the State of [Insert State], and any dispute shall be brought exclusively in that jurisdiction, regardless of where the injury occurred. 11. Voluntary, Informed Execution I certify that: • I have read this agreement in its entirety • I understand it releases substantial legal rights • I am signing freely, knowingly, and voluntarily • I intend this to be a complete and unconditional release of liability. THIS LIABILITY ALSO PERTAINS TO NEIGHBORING LAND. All land outside the baseball field is private property and there is no trespassing.

Participant agrees to follow the Player/Spectator Code of Conduct. Coach Kyle holds his teams to a much higher standard than most, and this Player/Spectator code of conduct will be discussed at the parent/player meeting.
