PLAYER PARTICIPATION WAIVER
THE FOLLOWING PROVISIONS MUST BE SIGNED AND AGREED TO BY EACH PLAYER (OR SUCH PLAYER’S PARENT/GUARDIAN IF THE PLAYER IS UNDER 18).
In consideration for being permitted to participate in the 2026 NY2LA Sports basketball tournament/camp/league (the “Event”) conducted by Brew City Entertainment, L.L.C., a Wisconsin limited liability company d/b/a NY2LA Sports (the “Company”), the undersigned player, and if the player is under the age of 18 years, his/her parent/guardian, acknowledges, agrees, and represents that participation in the Event is voluntary, that he/she is physically able to participate, and that he/she will comply with all Event, venue, and safety rules and directions of Event officials.
VOLUNTARY WAIVER AND RELEASE: The undersigned, for himself/herself, and his/her personal representatives, heirs, successors and assigns, hereby releases, waives and discharges, to the fullest extent permitted by applicable law, and covenants not to sue the Company, any Event sponsor, the owner of the Event premises, media and other licensees, and their respective representatives, agents, directors, officers, owners, employees, servants, successors, and assigns (collectively referred to herein as “Event Organizers”) from any and all loss, damages, claims, demands, causes of action, torts, obligations, and any other liability of any kind or nature, whether known or unknown, seen or unforeseen, in law or in equity arising out of or in any way related to the Event, including but not limited to claims of personal injury, disease or death from playing in the Event, loss of personal property, exposure to or spread of communicable illness, any publicity relating to the Event, and any alleged or actual loss of collegiate, international, or high school eligibility as a result of participation in the Event, whether caused by the ordinary negligence of the Event Organizers, to the fullest extent permitted by applicable law.
ASSUMPTION OF RISK: The undersigned hereby assumes full responsibility for all risk of bodily injury, death, or property damage while participating in or observing the Event. The undersigned expressly acknowledges that basketball and related Event activities involve inherent and significant risks, including but not limited to: contact with other participants; equipment and surface hazards; falls and collisions; sprains, fractures, and dislocations; dental and facial injury; concussion and traumatic brain injury; spinal cord injury; cardiac events including sudden cardiac arrest; eye injury; and exposure to communicable illness. All such risks are knowingly and voluntarily assumed to the fullest extent permitted by applicable law.
PARTICIPANT RESPONSIBILITY: The undersigned agrees to be responsible for any damage to facilities, equipment, or third parties caused by the participant’s intentional misconduct or reckless conduct during the Event.
CONSENT TO TREAT: For participants 18 years of age or older: The undersigned authorizes emergency medical care and treatment as deemed necessary by the Company’s medical staff or contracted licensed athletic trainers, and authorizes release of relevant health and injury information for treatment purposes. For participants under 18 years of age: The parent/guardian authorizes emergency medical care and treatment for the minor as deemed necessary by the Company’s medical staff or contracted licensed athletic trainers, and will be contacted as soon as practicable. The undersigned understands that the undersigned is financially responsible for any medical care provided or arranged. Company’s medical staff does not have authority to clear a participant for return to play following a suspected concussion; clearance requires an authorized licensed health care provider.
CONCUSSION AND INJURY REPORTING: The undersigned (and parent/guardian of a minor) acknowledges receipt of the Company’s Concussion Information Sheet and understands the risks of concussion and other head injuries, consistent with applicable youth sports safety laws. The participant agrees to: (a) immediately report symptoms of head injury (including headache, dizziness, confusion, nausea, or loss of consciousness) to Event staff; (b) cease participation upon removal by any Event official or medical personnel; and (c) not return to play until permitted under applicable law and cleared in writing by an authorized licensed health care provider. No participant may participate in the Event unless all required concussion information and acknowledgments have been completed.
CONDUCT AND REMOVAL: The undersigned agrees to comply with all Event rules and directions of Event officials. Company may remove any participant or spectator for unsafe, disruptive, or unsportsmanlike conduct, in its sole discretion, without refund.
PUBLICITY: The undersigned hereby consents to the use, without compensation, of his/her name, likeness, photograph, video (including livestream and archived broadcasts), biographical material and voice in connection with the Event and related promotion, advertising, broadcasts, and archival uses, in any media now known and later developed. Company may collect and use participant information to administer the Event and provide care, subject to its posted Privacy Policy. For minor participants, the parent/guardian grants media and likeness consents on the minor’s behalf.
ELIGIBILITY: Company makes no representation regarding scholastic, amateur, collegiate, or other athletic eligibility. The participant, and if a minor, the parent/guardian, are solely responsible for confirming any eligibility impact of participation with the participant’s school, association, conference, or governing body (e.g., NCAA, NAIA, WIAA) before registering for the Event.
MINOR PARTICIPANT — PARENTAL AUTHORITY: If the participant is under 18, the signing parent/guardian represents that: (a) the signing parent/guardian is the participant’s legal parent or guardian with full authority to execute this Player Participation Waiver (“Waiver”); (b) the signing parent/guardian has read and understands all provisions; (c) this Waiver shall be binding on the parent/guardian and his/her heirs and assigns regardless of whether any court determines that its provisions are enforceable against the minor directly; and (d) the minor’s independent right to bring a claim may not be extinguished where prohibited by applicable law. The parent/guardian acknowledges that the parent/guardian is waiving rights on behalf of the minor to the fullest extent permitted by law.
GOVERNING LAW: This Waiver is governed by the laws of the State of Wisconsin, except to the extent non-waivable laws of the participant’s home state apply. Any action arising out of this Waiver shall be brought in a court of competent jurisdiction in Wisconsin, unless applicable law requires otherwise.
SEVERABILITY: If any provision of this Waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
ELECTRONIC SIGNATURES: This Waiver may be executed electronically and in counterparts. Electronic signatures and scanned or electronic copies of this Waiver shall be treated as originals for all purposes.
BINDING EFFECT: It is further understood and agreed that these waivers, releases, and assumptions of risk are binding on the undersigned’s heirs, legal representatives, and assigns.
