FACILITY USE TERMS, CONDITIONS AND REQUIREMENTS
1.0 Terms of Use
1.1 The Event Renter (“Renter”) may not overuse time reserved and stated on the Reservation Detail. Ample time for set-up and tear-down will be allocated, however it will be monitored and is subject to change by authorized Starfire personnel.
1.2 The Renter and his/her organization/team assumes full responsibility for the conduct of all persons involved during their use of Starfire and will be liable for damages to persons or property arising from such conduct. Here is a list of Starfire rules:
1. No pets
2. No smoking
3. No un-licensed alcohol
4. No bicycles, rollerblades or scooters
5. No non-vendor cooking, selling of food or merchandise inside the campus
6. No fire or flame of any kind
7. No sunflower seeds or peanuts
8. No chewing gum
9. No hard candy
10. No food of any kind permitted on FIELDturf fields
11. No cleats on indoor FIELDturf fields
12. Spectators must remain outside of the yellow field perimeter lines
13. No excessive noise
14. Deposit all trash in the garbage cans provided
15. Deposit all paper & plastic in the recycle bins provided
16. Do not remove field equipment (goals, corner flags, etc.)
17. Moving goals is permitted on FIELDturf fields only
18. All tents must be anchored and weighed down at all times
19. No fighting
20. Each team is responsible for its own post practice / game / event clean up
21. Starfire is not liable for any injuries that occur on its campus during the event
1.3 If the use of lights occurs during the reservation the Renter and the organization/team acknowledge that the lights will be shut off immediately following the end time stated on the Reservation Detail.
1.4 Starfire reserves the right to close the facility and/or fields rented by Renter for emergencies, safety purposes, when field conditions or maintenance issues necessitate, and/or at its discretion. Reschedule or refund may be issued.
2.0 Non-Discrimination Clause
2.1 Starfire does not discriminate towards any person participating in events held on our campus.
2.2 Starfire reserves the right to deny and/or refuse service to any event with a specific message or agenda that is considered harmful and/or controversial to Starfire patrons.
3.0 Compliance with Laws & City Regulations
3.1 Renter and Renter’s organization/team shall comply with all laws, ordinances and rules of Starfire, the City of Tukwila, King County, the State of Washington and the United States that are applicable to the use of Starfire.
3.2 Any use of professionally staffed first-aid stations must be approved by Starfire and cleared by the Tukwila Fire Department.
3.3 Disorderly conduct and assault at Starfire will not be tolerated. Such actions include, but are not limited to, abusive, indecent, profane, or vulgar language that might cause a breach of the peace; or threatening or causing physical contact with someone else who might consider the contact offensive.
3.4 If at any time the use of Starfire by Renter and Renter’s organization/team violates these Terms and Conditions, an applicable ordinance or law of the City of Tukwila, King County, State of Washington or the United States of America, Starfire has the right to immediately stop the event, cancelling the remainder of the event with no refund.
4.0 Concessions & Vending
4.1 All vendors must fill out and submit a vendor application to Starfire 14 days prior to event(s) for approval. Items to be sold at the event (including admission charges, fund raising goods and services of any type) are subject to the approval of Starfire at its sole discretion; such approval may be unreasonably withheld. Options for vendor placement will be provided in the attached addendums.
4.2 Certain beverage sales will be permitted only upon pre-purchase of items from Starfire Concessions.
5.0 Promotional Material
5.1 Starfire reserves the right to take and use photographs of the participating organizations/teams and spectators for Starfire’s promotional materials.
6.0 Advertising and Selling
6.1 No advertising material of any kind shall be placed or posted on walls or doors in or around Starfire or distributed at the fields without the prior written permission of Starfire.
6.2 Renter may use the Starfire name as the event location for advertising the event. Any other use to suggest co-sponsorship or endorsement of any activity is not permitted, except with the prior written consent from Starfire. Copies of brochures, posters, flyers or mailings advertising this event must be attached in the final contract.
6.3 Renter must notify Starfire prior to making any commercial audio or video recordings and/or televising or broadcasting the event or any portion thereof.
7.0 Maximum Capacity
7.1 Only the number of participants and spectators approved for admittance in the Event Rental Agreement will be given access to Starfire; numbers in excess of the agreed attendance will not be tolerated. It is the Renter’s sole responsibility to ensure the approved number of attendees is not exceeded. Breach of this clause may result in a Starfire representative terminating the event.
8.0 Defacement and Damage
8.1 Renter and Renter’s organization/team shall not injure, mar or in any way deface Starfire and shall not cause or permit anything to be done where Starfire shall be in any manner injured, marred or defaced. Renter and Renter’s organization/team will not drive nails, hooks, tacks or screws into any part of Starfire and will not be allowed to make any alterations of any kind. Renter is responsible for any costs related to repair of damages caused during usage.
9.0 Starfire Equipment
9.1 Renter and Renter’s organization/team shall only be able to use equipment that is included in the Reservation Detail. Starfire is not responsible for lost, stolen, or damaged property kept or stored anywhere in Starfire.
10.0 Additional Users
10.1 Renter and Renter’s organization/team understands and agrees that during the term of this Agreement there may be other events taking place in other parts of Starfire not covered by this Agreement. Renter and Renter’s organization/team shall conduct their activities so as not to interfere with other events.
11.0 Parking Facilities
11.1 Starfire shall make its parking facilities available for the Renter’s use. During the event, Starfire may charge entry or parking fees at its sole discretion, requiring all visitors to pay without exception. The renter MAY NOT charge parking fees during the event.
11.2 Renter will be given a limited supply of parking passes for their distribution to event staff and volunteers. These will either be given to the event planner to distribute or a parking list of the individuals will be created. Specific number is determined by size of the event.
12.0 Indemnification
12.1 Renter and Renter’s team/organization hereby release, waive, discharge, and agree not to sue Starfire, its shareholders, members, agents, employees, subsidiaries, affiliates, parent companies, business partners, sponsors and/or otherwise affiliated third parties (collectively the “Released Parties”), from any and all liability to Renter and Renter’s team/organization for all loss or damage, and any claim or demands therefore, on account of injury to the person or property or resulting in death of Renter and Renter’s team/organization, whether caused by the negligence of the Released Parties or otherwise related to or resulting from the event.
12.2 Renter and Renter’s team/organization, jointly and severally, hereby agree to indemnify, defend, and hold the Released Parties harmless from any loss, liability, damage, or cost they may incur due to the participation of Renter and Renter’s team/organization in the event of negligence from a Released Party or otherwise.
12.3 Renter and Renter’s team/organization hereby assume full responsibility and risk related to or resulting from the event including, without limitation, the risk of bodily injury, death, loss or damage to person or property and costs or expenses resulting therefore due to negligence of a Released Party or otherwise.
12.4 Renter and Renter’s team/organization expressly acknowledge and agree that the activities related to the event are dangerous and involve the risk of serious injury and/or death and/or property damage. Renter and Renter’s team/organization agree that members of Renter’s team/organization are medically, physically, and in all other respects, fit and fully able to participate in the event and have no special medical requirements or conditions which may affect Renter and Renter’s team/organization’s ability to participate in the event. Renter and Renter’s team/organization further expressly agree that this indemnity and release extends to all acts of negligence by the Released Parties, including negligent rescue operations, and is intended to be as broad and inclusive as is permitted by law, and that if any portion thereof is held invalid, it is agreed that the balance notwithstanding, shall continue in full legal force and effect.
13.0 Liability for damage to equipment, persons and property
13.1 Renter and Renter’s organization/team agrees to indemnify and hold Starfire Sports harmless from claims for loss, damage or injury to person or property arising out of customers possession, use, maintenance or return of rented or rented on behalf of equipment, including legal costs incurred in defense of such claims. Renter agrees to pay for any and all damage or loss to rented or rented on behalf of items.
14.0 No Assignment
14.1 Renter shall not assign or transfer any of its rights under this Agreement without the prior written consent of Starfire, which consent may be withheld by Starfire in its absolute discretion. Renter herein is an independent contractor and not the agent or employee of Starfire.
15.0 Entirety and Amendment
15.1 These Terms, Conditions and Requirements, along with the Event Rental Agreement and other attached documents, embody the entire agreement between the parties and supersedes all prior agreements and understandings, if any, relating to the subject matter hereof. All proposals, negotiations, notices, and representations concerning matters covered by this Event Rental Agreement are merged in this instrument and no amendment or modification hereof shall be valid evidenced in writing and signed by authorized representatives of Starfire and Renter.
