Crew Waiver and Liability Release
This waiver and release applies to all sailing events (the Events) in 2026 for which Bay Access Sailing Foundation is the Organizing Authority and Lakewood Yacht Club is the host venue.
1. I recognize that sailing is an activity that has an inherent risk of damage and injury associated with it. I have read Racing Rule of Sailing #3, Decision to Race, of The Racing Rules of Sailing and hereby acknowledge and agree that I am participating in thee Events entirely at my own risk.
2. I acknowledge and agree that neither Lakewood Yacht Club, Bay Access, Inc., the Race Committee, the Protest Committee, or their respective members, officers, boards of directors, staff or representatives, will be responsible for (a) any damage to the entered boat or my other property, or (b) any injury, including death, sustained as a result of my participation in this event, regardless of the fact that such damage may, in whole or in part, be due to the negligence of Lakewood Yacht Club, Bay Access, Inc., the Race Committee, the Protest Committee, or their respective members, officers, boards of directors, staff or representatives.
3. To the fullest extent permitted by law, I hereby WAIVE any rights I may have to sue the Race Organizers (including Lakewood Yacht Club, Bay Access, Inc., the Race Committee, the Protest Committee, and/or their respective members, officers, boards of directors, staff or representatives) with respect to personal injury or property damage suffered as a result of my participation in the Events and hereby RELEASE the Race Organizers from any liability for such injury or damage to the fullest extent permitted by law whether caused in whole or in part by negligence.
4. I understand that the Events are governed by the rules as defined by the Racing Rules of Sailing, including, but not limited to the Notices of Race and Sailing Instructions for any individual Event, and I agree to abide by those rules.
5. I have taken all necessary steps to ensure that I and the entered boat are adequately prepared for all possible contingencies, including appropriate safety equipment as may be required by law or by the Safety Equipment Requirements or that a prudent seaman would consider advisable.
6. PHOTOGRAPHERS AND MEDIA RIGHTS On behalf of myself and all of my guests who may participate in the racing or shoreside events related to the Events grant Bay Access, Lakewood Yacht Club and their sponsors the irrevocable and unrestricted right and permission in perpetuity, to use my and their name, image or likeness or that of their vessel for editorial, promotional, educational or race reporting purposes in any and all forms of media, including, but not limited to TV, movie, videos, newspapers, magazines, periodicals, and any electronic form of the internet, or like or similar media.
7. By providing the information requested below, I indicate my intent to affix an electronic signature to this Waiver and Liability Release.
