1. ASSUMPTION OF RISK
The Client understands and acknowledges that hunting in remote areas of Alberta involves inherent risks and dangers, including but not limited to:
The use of firearms and proximity to other active hunters and guides.
Challenging terrain, including, but not limited to, steep slopes, dense forests, frozen waterways, and unstable ground.
-Extreme weather conditions, including, but not limited to, subzero temperatures, high winds, and storms.
Encounters with wild and dangerous animals, including, but not limited to, wolves, coyotes, black bears, grizzly bears, cougars and wolverines, in addition to moose, elk, deer and caribou.
Motorized travel by snowmobile, ATV, airplane, helicopter, boat, or horseback which may be owned, leased, or chartered by Wingmaster Outfitting Ltd..
Lack of immediate medical care due to the remoteness of the locations. Emergency evacuation and medical assistance may be delayed, and access to healthcare may be limited.
THE CLIENT VOLUNTARILY ASSUMES ALL RISKS ASSOCIATED WITH THESE ACTIVITIES AND UNDERSTANDS THAT PARTICIPATION IS ENTIRELY AT THEIR OWN RISK.
2. RELEASE OF LIABILITY AND WAIVER OF CLAIMS
To the fullest extent permitted by law, the Client hereby waives, releases, and forever discharges Wingmaster Outfitting Ltd., its owners, employees, guides, agents, representatives, contractors, and affiliates (collectively referred to as the "Released Parties") from any and all claims, demands, causes of action, losses, damages, or expenses (including injury, death, or property loss) arising out of or in connection with participation in a Wingmaster Outfitting Ltd. hunting excursion, including but not limited to claims based on negligence or other actions the Released Parties.
3. NO GUARANTEE OF SUCCESS & NO REFUNDS
The Client acknowledges that all hunts provided by Wingmaster Outfitting Ltd.are conducted as fair chase hunts in natural and uncontrolled environments. Wingmaster Outfitting Ltd. makes no guarantee of a successful hunt, and the Client is not entitled to a refund in the event of an unsuccessful hunt.
4. INDEMNIFICATION
The Client agrees to defend, indemnify, and hold harmless Wingmaster Outfitting Ltd. and the Released Parties from any claims, liabilities, costs, or expenses (including legal fees) arising from the Client's participation in the hunting excursion, including any harm caused by the Client's own actions or negligence.
5. CHOICE OF LAW & JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of Alberta, Canada, and any legal actions arising from this Agreement shall be brought exclusively in the courts of Alberta, regardless of where the hunt took place.
6. EMERGENCY MEDICAL PROCEDURES
In the event of an emergency, Wingmaster Outfitting Ltd. will attempt to contact emergency services as soon as possible; however, the remoteness of the location may delay response times. The Client understands and accepts the potential delays in receiving medical care and agrees to take personal responsibility for their own safety and well-being.
7. CANCELLATION POLICY
The Client acknowledges that all payments made to Wingmaster Outfitting Ltd. are non-refundable. In the event of a cancellation by the Client for any reason, including but not limited to personal or health emergencies, travel issues, or inability to attend, no refunds will be issued. Clients are strongly encouraged to obtain travel insurance or trip-cancellation insurance to cover any unforeseen circumstances.
8. WITNESS & CLIENT SIGNATURES
BY SIGNING BELOW, THE CLIENT ACKNOWLEDGES THAT THEY HAVE READ AND UNDERSTOOD THIS AGREEMENT AND VOLUNTARILY ACCEPT ALL RISKS ASSOCIATED WITH PARTICIPATING IN A WINGMASTER LTD. HUNTING EXCURSION.
