The undersigned individual/couple/family (hereafter “Member”) hereby indicates their desire to become a member of Vision N Motion LLC and to use the facility and equipment for exercise and workout purposes only, pursuant to the terms and conditions of this gym membership agreement.
Health Attestation
The above signed Member, attests and promises that s/he have discussed workouts with his/her primary care physician and are/is able to fully participate in an exercise regimen of their design and choosing without undue risk and promises and agrees to hold Vision N Motion LLC harmless and not liable for any and all health conditions, concerns, or emergencies that take place while in and on the premises of Vision N Motion LLC stemming from any health condition either on set or then existing.
Gym Membership Dues
The Member promises and agrees to pay either monthly, quarterly or annual dues, indicated by selecting an option on page one. These dues may be paid by check, cash, or other acceptable payments approved by Vision N Motion LLC. All fees are due on the 1st of the month. Failure to pay Gym Membership dues within a timely manner will result in Member’s membership being revoked along with revocation of access to Vision N Motion LLC. If payment is received after the 10th of the month, there will be a late fee assessed in the amount of $10.
Cancellation
Should the member decide to cancel, it must be in writing or on the website within his/her login portal. Said cancellation must be requested a minimum of fourteen days prior to the next renewal date. Any key fobs or access keys must be returned at the time of cancellation or there will be a $10 per key charge assessed for replacement.
Member Access
This signed Agreement entitles the Member access to Vision N Motion LLC so long as Member continues to pay Gym Membership Dues. No Member shall grant access to non-members. Members agree to abide by the Code of Conduct and any rules set forth within the Gym. Failure to comply with this provision will result in revocation of Member’s access to Vision N Motion LLC, membership and possible litigation.
Indemnification
This signed Gym Membership Agreement serves as a liability release, pursuant to which the Member agrees to indemnify and hold Vision N Motion LLC and its subsidiaries, instructors and other help harmless against any and all claims of loss or damage without limitation.
Binding Law
This Agreement shall be binding upon Member and Vision N Motion LLC. This Agreement shall be read and construed by and through the laws of the State of Kansas. Any and all litigation, if necessary, shall be heard in Morton County, Kansas.
Photo/Video Release
Members hereby grant Vision N Motion LLC the right to take photographs and video footage of each of its members. Member further grants permission to Vision N Motion LLC to use and publish said photographs and video footage.
Acceptance
Member’s Signature below signifies that Member has read and understood all the terms and conditions of the Agreement. Member promises to abide by said Agreement. I understand that participation in gym activities includes, but is not limited to, risks of injury from weightlifting, cardiovascular exercise, group fitness classes, equipment malfunction, slips and falls, and physical exertion. I voluntarily assume all such risks.
Addendium A - Minor (14 years old until 18 years of age)
Adult agrees to the terms and conditions of the Vision N Motion LLC Membership Agreement. Adult agrees and understands that Minor may be harmed resulting from exercise and activities that may take place in and on the premises of Vision N Motion LLC. Adult is assuming this risk. Adult is signing this agreement on behalf of the minor (Hereafter “Minor). Adult agrees to hold Vision N Motion LLC harmless for any injury that may occur during the course of lifting weights or stemming from the activity of lifting weights that may occur to Minor. Or as a result of activities that minor may perform while in Vision N Motion LLC or on the premises of Vision N Motion LLC. Adult agrees and promises that Minor will abide by the terms and conditions of the Vision N Motion LLC Agreement, that Adult has read the terms and conditions of the Agreement to minor and is promising that minor understands the terms and conditions of the Agreement. Failure to abide by the terms and conditions of the Agreement will result in Minor’s membership and access to Vision N Motion LLC being revoked.
