This Engagement Letter and Terms and Service Agreement ("Agreement") is entered into between Legacy Financial ("Company", "we", "our", "us") and the Client ("Client", "you", "your"). By signing this agreement, you agree to the following terms and conditions.
1. Services Provided:
Legacy Financial offers credit repair services, including but not limited to credit report analysis, dispute services, financial counseling, and other related financial services as per the agreed package. These services will be provided in accordance with applicable laws and regulations.
2. Payment and Fees:
Client agrees to pay for the services as outlined in the service agreement. All fees are due as per the agreed-upon schedule. A detailed fee structure will be provided prior to service commencement.
3. Refund Policy:
All fees paid for credit repair services are non-refundable once services have commenced. This includes any fees paid for credit report analysis, disputes, or any other related financial services provided by Legacy Financial. This policy is strictly enforced in accordance with industry standards and applicable laws.
4. No Guarantees:
While Legacy Financial will make every effort to improve your credit situation, we do not guarantee any specific results, including but not limited to the removal of negative marks from your credit report or a specific improvement in your credit score. Credit repair is subject to individual circumstances and the practices of credit bureaus, and results may vary.
5. Client Cooperation:
Client agrees to provide all necessary information, documentation, and cooperation required for Legacy Financial to effectively perform credit repair services. Failure to provide accurate, complete, or timely information may hinder the progress and effectiveness of the services.
6. Privacy and Confidentiality:
Client's personal and financial information will be treated with the utmost confidentiality and will only be used for the purpose of providing the agreed-upon services. Legacy Financial will not disclose any personal information to third parties without the Client's express consent, except where required by law or as necessary for service performance.
7. Cancellation and Refunds:
While clients have the right to cancel the agreement at any time, they will still be responsible for payment for any services rendered up to the point of cancellation. No refunds will be issued for services already provided or in progress at the time of cancellation.
8. Limitation of Liability:
Legacy Financial will not be held liable for any damages, losses, or expenses incurred by the Client as a result of using our services, except in cases of gross negligence or willful misconduct. Legacy Financial’s total liability is limited to the amount the Client has paid for services.
9. Agreement Modification:
Legacy Financial reserves the right to modify these terms and conditions at any time. Any changes will be communicated to the Client, and the modified terms will be effective upon notification. It is the Client's responsibility to stay informed of any updates.
10. Governing Law:
This Agreement is governed by the laws of the state of Louisiana, without regard to its conflict of laws principles. Any legal action arising from this Agreement will be brought in the appropriate court in Louisiana or the appropriate jurisdiction for the Client, as applicable.
11. Ghosting Clause:
Client agrees to maintain open communication with Legacy Financial during the service period. If the Client fails to respond to requests for information, updates, or communication from Legacy Financial for a period of 14 consecutive days, the Client’s account will be considered "inactive" or "ghosted." In such a case, Legacy Financial reserves the right to suspend services and retain any fees already paid. No further services will be rendered until the Client re-establishes communication and resumes payments if applicable.
12. Defamation Clause:
Client agrees not to make any defamatory statements, whether verbal or written, regarding Legacy Financial, its services, employees, or any affiliates. Should the Client post or distribute negative, false, or misleading information that defames the reputation of Legacy Financial, the Company reserves the right to pursue legal action for damages, including but not limited to reputational harm, business loss, and emotional distress. This clause applies to any form of public communication, including but not limited to social media, online reviews, and direct communications with others.
13. Additional Terms:
Client Acknowledgment: By signing this agreement, the Client acknowledges that they have read, understood, and agree to the terms outlined herein, including the non-refundable fee policy.
