WAIVER AND RELEASE FROM LIABILITY IMAGE RELEASE AND CONSENT PARTICIPANT'S GENERAL RELEASE By signing my name below and in consideration of my participation in the activities at The Well Network Summit West (“Summit”)), to be held at the location(s) and on the date listed above, I understand the nature of the activities that I will be involved in, including but not limited to event set-up and break-down, guest registration, speaker wrangling, stage running, greeting Summit attendees, and general production assistance (together the “Activities”), I acknowledge that it is a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, or property loss. I HEREBY ASSUME THE RISKS OF PARTICIPATING IN ANY ACTIVITY ASSOCIATED WITH the Activities.I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns: a) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, claims, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of my property, arising from or in connection with my participation in, or my traveling to and from in the Activities THE FOLLOWING PERSONS OR ENTITIES: The Well Network ("TWN"), including its officials and employees; and b) I AGREE NOT TO SUE any of the persons or entities mentioned above for any of the claims or liabilities that I have waived, released or discharged herein. Being fully aware of the risks inherent in participating in the Activities, I hereby elect voluntarily to engage in such activity, follow any directions given by staff and the persons or entities mentioned above and assume all risk of loss or injury that I may sustain in connection with the Activities. I understand that my participation in the Activities at the Summit is limited to a volunteer position and that no compensation is expected in return for my participation in the Activities. I hereby authorize any licensed physician, emergency medical technician, hospital or other medical or health care facility to treat me herein for the purpose of attempting to treat or relieve any injuries arising out of or relating to the Activities. I authorize any such medical provider to perform all procedures deemed medically advisable in attempting to treat or relieve such injuries. I realize and appreciate that there is a possibility of complications and unforeseen consequences in any medical treatment, and I assume any such risk. In signing this General Release, I hereby acknowledge that I have read the foregoing release and fully understand that this is a release of liability that will legally prevent me or any other person from filing suit or making any other legal claims. I nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon me, my heirs, assigns and legal representatives. I understand that TWN may wish to use my name, voice, image (still or otherwise) (collectively and individually, my “Likeness”) for any and all legal purposes, or anyone acting on its behalf. I hereby release and consent to the following terms: a) For good and valuable consideration, the receipt of which is hereby acknowledged, I grant the TWN, perpetually and irrevocably, the right throughout the world to use the Likeness in connection with the Licensed Use. It is understood and agreed that such rights include the right to use and to promote the images in any format now known or hereafter devised. I hereby waive any right of inspection or approval of the images for the Licensed Use. b) I agree to release and discharge TWN including its officials and employees, from any and all claims, demands or causes of action that I may now have or hereafter have for libel, defamation, invasion of privacy, right of publicity, infringement of copyright, trademark or violation of any other right arising out of or relating to any use of the rights granted in this Release and Consent or based on any failure or omission to make use of rights granted in this Release and Consent. c) I understand and agree that someone other than myself shall retain the ownership of the copyright of the photograph or other recording which contains the Likeness. I understand that the photograph or other recording which contains the Likeness may be used by the TWN in such manner and for such purposes as the TWN deem advisable, in whole, in part or in modified form, in all formats now known or hereafter to become known without further permission from me.I grant full rights to the TWN in any website content, photos, images, videos, or other materials or works I may create in the course of my Activities at the Summit, and any intellectual property rights in or derivatives of such materials.If any provision of this waiver is deemed void by law or unenforceable, the remaining provisions shall continue in full force and effect.I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OR OLDER, AM PHYSICALLY FIT TO PARTICIPATE IN THE ACTIVITIES AND I HAVE READ THIS DOCUMENT, AND I UNDERSTAND ITS CONTENTS.*
