1. NATURE OF THE ACTIVITY & ASSUMPTION OF RISK I acknowledge that participation in activities at Top Kids Gym & Sports ("Top Kids"), including gymnastics, tumbling, ninja, camps, and special events such as Foam/Bubble Parties, involves inherent risks. I fully understand these risks may include, but are not limited to: Physical injury (sprains, fractures, etc.) or death.
Specific Foam Party Risks: Slippery floors, limited visibility, skin/eye irritation from soap, nausea from ingestion, and damage to clothing or footwear due to water/foam exposure.Exposure to loud music, strobe lights, and contact with other participants.I voluntarily assume full responsibility for all risks, known and unknown, including those resulting from the ordinary negligence of Top Kids or its staff.
2. RELEASE OF LIABILITY & INDEMNIFICATION In consideration for allowing the participant(s) to engage in these activities, I hereby waive, release, and hold harmless Top Kids, its owners, employees, and agents from any claims, demands, or causes of action arising out of my/minor’s participation.
Indemnification: I agree to indemnify and defend Top Kids against any claims arising from my/minor’s participation, including any injuries my child may cause to others.
Venue: I agree that this waiver is governed by the laws of the State of Texas and any legal proceedings shall take place within Texas.
3. MEDICAL AUTHORIZATION In an emergency, I authorize Top Kids to secure medical treatment for my child at my expense. I hold Top Kids harmless in the execution of this action.
Inhaler Policy: If my child requires an inhaler, I understand I am required to stay with them or provide a doctor’s release allowing them to carry it.
4. PHOTO/VIDEO RELEASE I grant Top Kids permission to photograph or video my child during activities. I authorize Top Kids to use these images for marketing (website, social media, print) without compensation or further approval.

I AFFIRM THAT I AM OF LEGAL AGE AND AM FREELY SIGNING THIS AGREEMENT. BY ACKNOWLEDGING AND SIGNING BELOW, I AM DELIVERING AN ELECTRONIC SIGNATURE THAT WILL HAVE THE SAME EFFECT AS AN ORIGINAL MANUAL PAPER SIGNATURE. THE ELECTRONIC SIGNATURE WILL BE EQUALLY AS BINDING AS AN ORIGINAL MANUAL PAPER SIGNATURE.
