ACCIDENT WAIVER AND RELEASE OF LIABILITY

(Valid for One (1) Year from Date of Signature Unless Revoked in Writing)

This Accident Waiver and Release of Liability (“Waiver”) applies to all visits, activities, volunteering, programs, or events conducted by Healing Hooves Ranch, Inc., a Florida nonprofit organization (“Healing Hooves Ranch”), for a period of one (1) year from the date signed unless revoked in writing.

PARTICIPANT AND MINOR PARTICIPANT ACKNOWLEDGMENT

I, the undersigned adult (“Participant”), voluntarily choose to participate in activities, visits, volunteering, or events conducted by Healing Hooves Ranch.

If applicable, I further acknowledge that this Waiver applies to my minor child(ren) listed below (“Minor Participant(s)”), for whom I am the parent or legal guardian or otherwise have full legal authority to execute this Waiver and Release on their behalf.

ASSUMPTION OF RISK

I understand and acknowledge that activities at Healing Hooves Ranch involve inherent risks, including but not limited to: interaction with animals (including goats, donkeys, pigs, chickens, quail, and other livestock), unpredictable animal behavior, bites, kicks, scratches, uneven terrain, fencing, barns, gates, tools, equipment, physical labor, weather conditions, insects, allergens, outdoor hazards, and travel to and from the ranch.

I knowingly, voluntarily, and expressly assume all risks, known and unknown, foreseeable and unforeseeable, for myself and for any Minor Participant(s).

RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate, to the fullest extent permitted by Florida law, I hereby waive, release, and discharge Healing Hooves Ranch, Inc., and its directors, officers, employees, volunteers, agents, representatives, successors, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, actions, or liabilities, whether arising from negligence or otherwise, for injury, illness, disability, death, property damage, or loss arising out of or related to participation in ranch activities.

This release includes claims brought by or on behalf of any Minor Participant(s).

PARENT OR LEGAL GUARDIAN CONSENT, RELEASE, AND INDEMNIFICATION FOR MINORS

If I am signing on behalf of a Minor Participant, I hereby:

Consent to the Minor Participant’s participation in all Healing Hooves Ranch activities, including volunteering;
Acknowledge and assume all risks on behalf of the Minor Participant;
Release, waive, and discharge the Released Parties from any and all claims that may be brought by or on behalf of the Minor Participant; and
Agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, costs, or expenses (including attorney’s fees) arising from the Minor Participant’s participation, including claims brought by the Minor Participant or any third party.

I certify that I am the parent or legal guardian of the Minor Participant(s), or otherwise legally authorized to execute this Waiver on their behalf.

INDEMNIFICATION (ADULT PARTICIPANTS)

I agree to indemnify, defend, and hold harmless the Released Parties from any claims arising out of my participation in Healing Hooves Ranch activities.

MEDICAL CONSENT

I authorize Healing Hooves Ranch to obtain emergency medical treatment for myself and/or any Minor Participant(s) if deemed necessary. I understand and agree that I am solely responsible for all medical costs and expenses incurred.

PHOTO AND VIDEO RELEASE

I understand that photographs and/or video recordings may be taken during activities. I grant permission for Healing Hooves Ranch to use images or recordings of myself and/or Minor Participant(s) for nonprofit, educational, or promotional purposes without compensation, unless I revoke such permission in writing.

GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, and enforced to the maximum extent permitted by law.

SEVERABILITY

If any portion of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT AND ELECTRONIC SIGNATURE

By signing electronically or physically below, I certify that I have read and fully understand this Waiver, that it is a legally binding release of liability, and that I am voluntarily giving up substantial legal rights, including the right to sue.
