LIABILITY WAIVER, RELEASE, AND PAYMENT AGREEMENT
By signing below, I acknowledge and agree to the following terms and conditions:
1. Assumption of Risk
I understand that participation in veterinary clinics, examinations, handling of animals, and related activities involves inherent risks, including but not limited to injury to myself, my animal(s), or others, as well as property damage. I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable.
2. Release and Waiver of Liability
I hereby release, waive, discharge, and covenant not to sue the Borzoi Club of America (BCOA), Courtyard by Marriott Omaha Bellevue, Beardmore Event Center, Marriott Bonvoy, all licensed veterinarians, veterinary technicians, volunteers, event staff, helpers, sponsors, and affiliated individuals or entities involved in the clinic (collectively referred to as “Released Parties”) from any and all claims, demands, causes of action, liabilities, losses, damages, or expenses of any kind.
This release includes, but is not limited to, claims arising from negligence, personal injury, illness, death, property damage, or loss, arising out of or related to participation in the clinic or presence at the event premises.
3. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, liabilities, suits, injuries, demands, obligations, losses, settlements, judgments, damages, fines, penalties, costs, and expenses (including reasonable attorney’s fees) arising from or related to my participation, my animal(s), or any breach of this agreement.
4. Veterinary Services Disclaimer
I understand that veterinary examinations and services provided at this clinic are offered as limited services and may not replace full veterinary care. I acknowledge that no guarantee or warranty is made regarding diagnosis, treatment, or outcome.
5. Payment Obligation
By signing this agreement, I acknowledge that I am obligated to pay the applicable clinic fee owed to the Borzoi Club of America (BCOA) within three (3) days of signing up through this form. Failure to submit payment within this timeframe will result in forfeiture of my reserved spot in the clinic, without further notice.
6. Binding Agreement
I acknowledge that I have read and fully understand this agreement. I understand that by signing, I am giving up certain legal rights, including the right to sue. This agreement shall be binding upon me, my heirs, executors, administrators, and assigns.
I affirm that I am at least 18 years of age and legally competent to sign this agreement.
