In consideration of being permitted to rent and use the facilities of The Peralta Foundation dba House of Hustle(“House of Hustle”) for a private party or rental event, I, the undersigned renter, on behalf of myself and all participants, guests, invitees, and minors attending my event, acknowledge, understand, and agree to the following:
1) Assumption of Risk
I understand that participation in activities at House of Hustle, including but not limited to open basketball play and use of athletic facilities, involves inherent risks, including the risk of serious bodily injury, permanent disability, paralysis, or death. I acknowledge that these risks may arise from activities, equipment, facility conditions, or the actions or inactions of myself or others.
2) Full Responsibility for Guests and Participants
I knowingly and freely assume all risks, both known and unknown, associated with my rental and event, including risks arising from the actions of my guests, participants, or invitees, whether minors or adults. I accept full responsibility for supervising all attendees during the rental period.
3) Release and Waiver of Liability
On behalf of myself, my heirs, assigns, personal representatives, and next of kin, I hereby release, waive, discharge, and covenant not to sue The Peralta Foundation dba House of Hustle, its officers, directors, employees, contractors, volunteers, agents, sponsors, and facility owners or lessors (“Releasees”) from any and all liability, claims, demands, losses, or damages arising out of or related to my rental, event, presence, or use of the facility, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
4) Indemnification
I agree to indemnify and hold harmless the Releasees from any and all claims, damages, costs, or expenses (including attorney’s fees) arising from my rental, my event, or the actions of my guests or participants, including any injury, death, or property damage.
5) Compliance with Rules and Safety
I agree to comply with all House of Hustle policies, safety rules, and staff instructions. If I observe any unsafe condition or hazard, I will immediately stop participation and notify House of Hustle staff.
6) Acknowledgment and Voluntary Agreement
I acknowledge that I have read and fully understand this Release of Liability and Assumption of Risk Agreement. I understand that by agreeing to this waiver, I am giving up substantial legal rights. I sign this agreement freely and voluntarily, without inducement.
