Terms and Conditions of Enrolment
These enrolment terms and conditions apply to Jessica Brayshaw (ABN 54 292 924 493) trading as Dance School of Distinction Ballarat (DSD). These terms and conditions are to be read in conjunction with the annexed enrolment form (the Enrolment Form). By submitting an Enrolment Form, the student, or the parent/guardian where the student is under 18 years of age, agrees to the following terms and conditions.
1. Enrolment
1.1. Enrolment is confirmed upon:
a. submission of a signed and completed Enrolment Form in a form deemed acceptable by DSD; and
b. payment of class term fees as and when invoiced by DSD.
1.2. Enrolment is for the full calendar year unless otherwise specified.
1.3. DSD reserves the right to accept or refuse enrolment at its absolute discretion without providing any reason.
2. Fees and Payment
2.1. DSD will set the term fees for each dance class prior to the commencement of each year.
2.2. All fees must be paid by the due date specified on the invoice.
2.3. Fees are non-refundable except as required under Australian Consumer Law. Missed classes are not refundable or transferable.
2.4. Late or unpaid fees may result in suspension of classes until payment is received.
2.5. Any disputes regarding fees must be raised in writing within 14 days of the invoice date.
3. Withdrawals and Cancellations of Enrolment
3.1. Written notice is required for termination of enrolment of a student.
3.2. No refunds will be issued if enrolment is terminated after term has commenced.
3.3. DSD may cancel classes due to low enrolments or unforeseen circumstances, in which case DSD may issue a refund for the balance of the term after cancelation.
4. Student Attendance and Conduct
4.1. Students are expected to attend classes regularly, arrive on time, and behave respectfully.
4.2. All students will be required to comply with any DSD code of conduct in place from time to time.
4.3. Disruptive, unsafe, or inappropriate behaviour may result in removal from class or termination of enrolment without refund.
4.4. Harassment, bullying, intimidation, aggressive, or unreasonable conduct (in any form, including without limitation, spoken, written, by text message or via online or social media platforms) by students toward staff or other students will not be tolerated.
5. Parent and Guardian Conduct
5.1. DSD is committed to maintaining a safe and respectful environment.
5.2. All parents, guardians, visitors and associated persons will be required to comply with any DSD code of conduct in place from time to time.
5.3. Harassment, bullying, intimidation, aggressive, or unreasonable conduct (in any form, including without limitation, spoken, written, by text message or via online or social media platforms) by parents or guardians toward staff, students, or other families will not be tolerated, including in written, text message or online communication.
5.4. Concerns must be raised respectfully through appropriate channels. Serious or ongoing breaches may result in restricted communication or termination of enrolment.
6. Child Safety (Victoria)
6.1. DSD complies with the Victorian Child Safe Standards and has zero tolerance for child abuse. Parents and guardians are expected to support all child-safety policies in place from time to time.
6.2. Any child safety concerns must be reported to management and will be addressed in accordance with legal requirements. DSD may take immediate action where child safety concerns arise.
7. Staff and Volunteers
7.1. All staff and volunteers hold a valid Working with Children Check (Victoria) and are required to comply with child-safety practices, policies and procedures in place from time to time.
7.2. Breaches may result in disciplinary action or removal from participation in DSD activities.
8. Health and Safety
8.1. DSD will take reasonable care to ensure the safety and wellbeing of students while attending classes, rehearsals, performances, and related activities.
8.2. In the event of illness or injury requiring medical attention, and where a parent or guardian cannot be contacted, DSD is authorised to seek medical advice and arrange medical treatment as reasonably necessary.
8.3. Any costs associated with such treatment (including without limitation transport by ambulance) will be the responsibility of the parent or guardian.
8.4. DSD take no responsibility for students prior to or after dance classes that remain at the premises or are awaiting collection. Parents and or guardians are responsible for arranging collection of students promptly after class is complete.
9. Participation at Own Risk
9.1. Dance involves physical activity and inherent risk of injury. Students participate at their own risk.
9.2. The student and/or parent/guardian, is responsible for ensuring a student has the necessary fitness and ability to participate and for disclosing any relevant pre-existing or current medical conditions prior to undertaking any classes.
10. Intellectual Property
10.1. All choreography (including any improvements or modifications contributed by a student, parent/guardian or third party), music edits, costumes designs, and competition routines remain the intellectual property of DSD unless otherwise agreed in writing.
10.2. Recording, copying, teaching, performing, or sharing choreography without prior permission is prohibited and may result in termination of enrolment.
10.3. DSD reserves the right to pursue any person and commence legal action (as necessary) for any direct or indirect breach of intellectual property rights.
11. Indemnity
11.1. You hereby release DSD and all employees, volunteers, any other persons involved in the student’s participation in the classes from any suit, demand, action or claim for compensation whether for personal injury or damage to property arising from such participation. This clause survives completion or termination of enrolment.
12. Photography and Video
12.1. DSD may photograph or record classes and performances for promotional, educational, or marketing purposes unless written notice is provided withdrawing consent.
12.2. For child safety reasons, no film or photography of students or classes is permitted without express prior permission from DSD. In those limited circumstances where permission is provided to film or photograph a student or students, it is strictly for personal use and must not be distributed or made available online in any way.
13. Personal Property
13.1. DSD accepts no responsibility for lost, stolen, or damaged personal property.
14. Dress Code
14.1. Students must wear the required uniform or appropriate (and approved) dance attire. Students must comply with all reasonable directions provided by DSD staff in relation to attire and presentation.
14.2. Uniform pieces may be available to purchase from DSD at an additional cost.
14.3. Failure to comply with dress code requirements may result in removal from class.
14.4. This dress code extends to compliance with grooming standards (including but not limited to, hair, nails, jewellery and footwear).
15. Class Changes
15.1. DSD reserves the right to:
a. change class times, teachers, locations, or timetables where necessary; and
b. cancel classes due to public holidays, staff illness, performance schedules or unforeseen circumstances.
16. Privacy
16.1. Personal information is collected and managed in accordance with our privacy policy and the Privacy Act 1988 (Cth).
16.2. DSD reserves the right to reject any request for information relating to a student (including copies of any enrolment form) unless that request is made by:
a. the parent or guardian that completed the enrolment form; or
b. a person that has been noted or advised in writing as authorised to access that information.
17. Accuracy of Information
17.1. Students or parents/guardians must ensure all enrolment, contact, emergency, and medical information is accurate and kept up to date.
18. Use of Student Achievements
18.1. Students’ examination results, competition results, and other academic or performance achievements may be used at the discretion of the school for programs, newsletters, promotional materials, or other advertising purposes.
18.2. Written notice must be provided if a parent/guardian wishes to withdraw consent for such use.
19. Performances, Competitions, Casting and Selection
19.1. Students may be expected to participate in performances from time to time. Students will be required to wear prescribed costumes and pay the applicable costume hire fee to DSD (in addition to ordinary class term fees).
19.2. Students may be invited or encouraged to participate in competitions, workshops, masterclasses or similar activities. Those costs (including third party registration fees) and any additional costume hire, classes or tuition resulting from such participation must be paid in addition to ordinary class term fees.
19.3. Teaching staff have absolute discretion to determine the casting of performances and selection for private lessons, troupes, solos, and competitive events. Decisions are final, and no discussions or appeals will be entered.
20. Acceptance of Terms
20.1. Submission of an Enrolment Form constitutes acceptance of these terms and conditions. You acknowledge that you have read and agree to all the above conditions of enrolment.
20.2. These terms and conditions may be varied by DSD from time to time by written notice.
