On behalf of myself/my business in recognition of the risk of incident while participating in this event and as consideration for the right to participate, I hereby for myself, my heirs, executors, administrators, etc. knowingly and voluntarily enter into this waiver and release of liability and herby waive any and all rights, claims, or causes of action of any kind resulting from my participation in this event.
I hereby release and forever discharge the Madisonville Volunteer Fire Company (MVFC) and its directors, members, agents, attorneys, volunteers, representatives, etc., from any and all liability, claims, demands, damages, actions or causes of action existing or which may arise as a result of my participation in this event, whether injury is caused by negligence of the host, the negligence of myself or third parties, the conditions of the grounds or any other cause. This applies not only to myself but anyone who helps, assists, or is employed by me for the purpose of the unloading, setting up, selling, cleaning up or any other activity while attending this event.
I agree to indemnify and hold harmless the MVFC against any and all claims, suits, or actions of any kind for liability, damages compensation, or otherwise brought to me or anyone on my behalf, including attorney fees, if litigation arises on account of claims made by me or anyone on my behalf. I agree that if I use a pop up canopy tent, it will be staked and/or weighted down to the ground and I am responsible for any damages to MVFC property, other vendor property or persons at the event that may occur from my tent not being secure.
I declare, on behalf of myself and/or my business, that I/we are liable for any damage or destruction done by out participants at the event and the MVFC is not responsible for any damage to or loss of my merchandise. I understand that it is suggested that a waiver of Insurance liability be in place for the participation in this event.
Refunds will not be issued for cancellation by the vendor within 3 days of the event or if the event is moved due to weather and the vendor cannot make the rain date.
I acknowledge that this agreement is the entire agreement between MVFC and myself and this agreement cannot be modified or changed in any way by representations, or statements of MVFC or me. I hereby declare that I have read and fully understand this agreement in its entirety and that by signing below, I agree to all the terms and conditions contained in this agreement.
