Miracle League of Delray Beach/Palm Beach County
Participant & Volunteer Waiver and Release
1.Risk of Injury:
The risk of injury to any participant from the activities involved in these programs is significant, including the potential for permanent disability and death. While particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist.
2. Assumption of Risk:
I, for myself, my spouse, and my child/ward, knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my and my child/ward’s participation.
3. Compliance with Terms:
I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child/ward’s readiness and/or in the program itself, I will remove my child/ward/myself from participation and bring such attention to the nearest official immediately.
4. Release from Liability:
I, for myself, my spouse, my child/ward, and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby release and hold harmless The Miracle League of Delray Beach (MLPBC), its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releases”), with respect to any and all injury, disability, death, or loss or damage to person or property incident to my child/ward’s/my involvement or participation in these programs, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
5. Indemnification:
I, for myself, my spouse, my child/ward, and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby indemnify and hold harmless all the above releases from any and all liabilities incident to my child/ward’s/my involvement or participation in these programs, even if arising from their negligence, to the fullest extent permitted by law.
6. Volunteer Acknowledgment:
I understand and acknowledge that everyone who participates, whether as a player or volunteer, is a volunteer, and we do not hold any of them responsible for any incidents that may occur during the events and activities.
7. Consent to Use Likeness:
I hereby grant The Miracle League of Delray Beach/Palm Beach County (MLPBC), its affiliates, franchises, advertising and promotional agencies, and their agents, the irrevocable, unrestricted right to use, publish, display, and distribute materials bearing my name, voice, likeness, or any other identifiable representation of myself, my family members, including the above listed Miracle League player/child/participant. These materials may appear in any form, style, color, or medium whatsoever (including, without limitation, photographs, video tapes, films, sound recordings, software, drawings, prints, broadcast, internet, and electronic media). I agree that all material containing any identifiable representation of me and/or my child/participant (including without limitation, all negatives, plates, and masters of any photographs, files, prints or tapes) shall remain the sole and exclusive property of The Miracle League of Delray Beach/Palm Beach County (MLPBC).
8. Understanding of Risk:
I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulations, and accept them as a participant.
