📝 INDEMNITY, ASSUMPTION OF RISK & LIABILITY WAIVER
The Blue Collar Cat Hotel – Lenasia
This agreement is entered into between The Blue Collar Cat Hotel (“the Facility”) and the undersigned cat owner or authorised representative (“the Owner”).
By signing this document, the Owner confirms that they have read, understood, and agreed to all terms and conditions contained herein.
1. Acknowledgement of Risk
I acknowledge that the boarding of cats involves inherent risks, including but not limited to stress, illness, injury, escape, behavioural changes, or death. I understand that these risks may occur despite all reasonable care, supervision, and precautionary measures taken by The Blue Collar Cat Hotel.
2. Indemnity & Release of Liability
I hereby fully indemnify, release, and hold harmless The Blue Collar Cat Hotel, its owners, employees, agents, and representatives from any and all claims, demands, losses, liabilities, damages, costs, or expenses (including legal fees) arising from or related to:
Illness, disease, infection, or medical conditions that occur during or after boarding
Injury to my cat, whether self-inflicted or caused by another animal
Escape, disappearance, loss, or running away of my cat
Death of my cat due to natural causes, stress-related conditions, pre-existing conditions, or unforeseen events
Damage caused by my cat to property, equipment, staff, or other animals
This indemnity applies regardless of cause, except in cases of proven gross negligence or intentional misconduct.
3. Escape & Loss Clause
I understand that while The Blue Collar Cat Hotel takes reasonable precautions to prevent escapes, cats are naturally agile, curious, and unpredictable.
I therefore accept that The Blue Collar Cat Hotel cannot be held responsible for any cat that escapes, goes missing, or runs away during the boarding period.
4. Health & Behaviour Disclosure
I declare that all information provided regarding my cat’s health, vaccination status, temperament, and behaviour is true, complete, and accurate.
I confirm that my cat:
Is fully vaccinated and treated for ticks and fleas prior to check-in
Is free from contagious or infectious diseases
Is not aggressive and is accustomed to gentle handling
I understand that failure to disclose any medical, behavioural, or health conditions releases The Blue Collar Cat Hotel from any related liability.
5. Pre-Existing Conditions
I acknowledge that The Blue Collar Cat Hotel shall not be held responsible for the worsening of any pre-existing medical or behavioural condition, whether known or unknown at the time of admission.
6. Medical Treatment & Emergency Care
In the event that my cat becomes ill or injured, I authorise The Blue Collar Cat Hotel to seek veterinary treatment if deemed necessary.
I understand and agree that:
Every reasonable effort will be made to contact me before treatment
Emergency treatment may be administered without prior consent if I cannot be reached
All veterinary, medication, transport, and related costs shall be for my own account
7. No Guarantee of Health or Outcome
I understand that no guarantees can be made regarding my cat’s health, behaviour, temperament, or condition during or after boarding.
The Blue Collar Cat Hotel does not guarantee immunity from illness, stress, injury, or behavioural changes.
8. Right of Refusal or Removal
The Blue Collar Cat Hotel reserves the right to refuse admission or remove any cat that is deemed aggressive, uncontrollable, severely stressed, ill, or a danger to itself, other animals, or staff.
Any associated costs or alternative arrangements will be the responsibility of the Owner.
9. Governing Law
This agreement shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
10. Binding Agreement
I confirm that I am the lawful owner or authorised caretaker of the cat(s) listed below and that this agreement is binding upon me, my heirs, executors, and assigns.
