THE ARMORY – ATHLETIC PARTICIPATION LIABILITY WAIVER & RELEASE
This Liability Waiver and Release of Claims (“Agreement”) is entered into by the undersigned participant (or the participant’s parent or legal guardian, if under 18) in favor of THE ARMORY, its employees, agents, contractors, affiliates, and representatives (“THE ARMORY”).
By signing electronically below, I acknowledge and agree to the following:
1. PROGRAM SCOPE
This Agreement applies to participation in any and all sports performance activities offered by THE ARMORY, including but not limited to:
Personal and Small Group Training
Online Training
Group Fitness Classes
Pilates
Strength and Conditioning
Basketball Training
Volleyball Training
Field Hockey Training
Football, Punting, and Kicking Sessions
In-Person or Virtual/Online Instruction
One-on-One Sessions, Semi-Private Small Groups, and Large Group Training
Camps, Clinics, Workshops, and Special Events
2. VOLUNTARY PARTICIPATION & ASSUMPTION OF RISK
I understand and acknowledge that participation in athletic training and related physical activities involves inherent risks, including but not limited to:
Muscular and skeletal injuries
Cardiac events
Falls or collisions
Equipment malfunction or misuse
Environmental conditions (indoor and outdoor)
I affirm that I (or my child) am voluntarily participating and that I assume all risks, known and unknown, associated with these activities, even if arising from the negligence of THE ARMORY or others.
3. HEALTH CERTIFICATION
I certify that the participant is in good health and physically able to engage in exercise and sports performance activities. I understand that it is my responsibility to consult with a physician prior to participation. I agree to notify THE ARMORY staff of any relevant health conditions or limitations.
4. RELEASE OF LIABILITY & INDEMNIFICATION
In consideration for participation, I hereby release, waive, and discharge THE ARMORY and its affiliates, officers, staff, volunteers, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, injury, disability, or death that may occur during or resulting from participation in any program, regardless of fault.
I agree to indemnify and hold harmless THE ARMORY from any claims brought by me or on behalf of the participant related to such participation.
5. EMERGENCY AUTHORIZATION
In the event of an emergency, I authorize THE ARMORY staff to secure emergency medical care deemed necessary. I understand that I am responsible for all medical expenses incurred. I affirm that my personal health insurance will be the primary coverage in such instances.
6. MEDIA RELEASE (VIDEO & IMAGE CONSENT)
I understand that during training sessions, events, or related activities, photographs, audio recordings, and video footage may be taken by THE ARMORY staff or authorized representatives for purposes including, but not limited to:
Training analysis and feedback
Marketing, promotional, and educational materials
Social media, website, and print publications
By signing below, I grant THE ARMORY the unrestricted right and permission to capture, use, reproduce, edit, publish, and distribute my (or my child’s) likeness, voice, and image without compensation. I understand that these materials may be used in perpetuity for lawful purposes and waive any rights to review or approve their final form.
If I do not wish to have my (or my child’s) image or likeness used for marketing or promotional purposes, I will notify THE ARMORY staff in writing prior to participation.
7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
