  • Express assumption of risk: I, the undersigned, am aware that there are risks involved in the Student’s/Volunteer’s participation in activities with Slam the Stigma. These risks include but are not limited to: falls which can result in serious injury or death, injury or death due to negligence on the part of the Student/Volunteer. I am aware that the Student’s/Volunteer’s participation activities involve trips away from the Slam The Stigma facilities. I am aware that any of these above-mentioned risks may result in serious injury or death to the Student/Volunteer.

     

    Slam The Stigma activities and events are staffed by adult volunteers and staff members who have successfully passed a background check and have agreed to Slam The Stigma rules, regulations, and values. Slam The Stigma aims to have a minimum of two volunteers per activity/event. Slam The Stigma is unable to provide one-on-one direct supervision to participants. If a participant is in need of any level of increased supervision due to physical, emotional, and/or behavioral limitations/ concerns, the undersigned should contact Slam The Stigma directly to discuss if any accommodation can be arranged. If the participant has any legal restrictions regarding contact with any individual or group of individuals, the undersigned  must contact Slam The Stigma directly to discuss if any accommodation can be arranged. Therapy dogs will be on site on an occasional basis through You're Not Alone;, a partner organization of Slam The Stigma. If there are any issues or concerns with a therapy dog on site at Slam The Stigma, the undersigned must contact Slam The Stigma staff.

    I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity at Slam The Stigma. This express assumption of risk shall survive the termination of my participation in activities with Slam The Stigma.

  • I, the undersigned, acknowledge that I have no physical impairments or illnesses that I know of that will endanger myself or others.

  • Release: In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities available at Slam The Stigma, I, the undersigned hereby release Slam The Stigma, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in these activities attributed to the negligent acts or unintentional omissions of Slam The Stigma. This Release shall survive the termination of my participation in Slam The Stigma activities.

  • Indemnification: The Student/volunteer recognizes that there is risk involved in the types of activities offered by Slam The Stigma. Therefore, the Student/volunteer accepts financial responsibility for any injury that the Student/volunteer may cause either to him/herself or to any other Student/volunteer due to his/her negligence or due to the negligence of Slam The Stigma. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Slam The Stigma, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Slam the Stigma, or from the negligent acts of Slam The Stigma. This provision shall survive the termination of my participation in activities involving Slam The Stigma.

  • Photo/Video Release: I hereby grant Slam The Stigma permission to use my photograph/video image in any and all publications for Slam the Stigma, including web site entries, without payment or any other consideration in perpetuity.

     

    I hereby authorize Slam The Stigma to edit, alter, copy, exhibit, publish or distribute all photos and images. I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my photo appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph or video images.

     

    I hereby hold harmless and release and forever discharge Slam The Stigma from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf of on behalf of my estate which may have or may have by reason of this authorization.

  • Medical Treatment Permission: I authorize an adult, in whose care the student has been entrusted, to consent to any emergency x-ray examination, anesthetic, medical, surgical or dental diagnosis or treatment and hospital care, to be rendered to the Medical Practice Act on the medical staff or a licensed hospital or emergency care facility. The undersigned shall be liable and agrees to pay all costs and expenses incurred in connection with such medical and dental services rendered to the aforementioned student pursuant to this authorization.

  • Termination of Participation in Slam The Stigma Activities: Slam The Stigma reserves the right to terminate my participation in activities with Slam The Stigma at any time, with or without cause or advance notice. Participation is at the sole discretion of Slam The Stigma and any violation of the rules and regulations can result in cancellation of my ability to participate in activities of Slam The Stigma. I AGREE TO COMPLY WITH ALL SLAM THE STIGMA COMMUNITY EXPECTATIONS AND INTERNET ACCEPTABLE USE POLICY AS A CONDITION OF MY ABILITY TO PARTICIPATE IN ACTIVITIES WITH SLAM THE STIGMA WHICH ARE ATTACHED AS EXHIBIT A TO THIS RELEASE.

  • Competency: I am competent to contract in my own name. I have read this release, and I fully understand the contents, meaning, and impact of this release. The covenants contained in this release shall survive the termination of my participation in Slam The Stigma activities.

  • Binding Agreement: This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.  This provision shall survive the termination of my participation in activities with Slam The Stigma.

  • I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission or for the negligent or unintentional act or omission of Slam The Stigma. I understand that by signing this form I am waiving valuable legal rights. For the avoidance of doubt, this agreement and all of the covenants contained herein shall survive the termination of my participation in activities with Slam The Stigma.

     

  • ACKNOWLEDGEMENT OF RISKS BY PARENT/GUARDIAN [IF APPLICABLE]

     

    a.      Parent/Guardian understands the risks of participation in the activities described above in the Express Assumption of Risk.

     

    b.      Parent/Guardian will completely and fully discuss any concerns regarding these risks with staff prior to signing this Waiver and Release of Liability.

     

    c.      CONSENT TO PARTICIPATION BY MINOR; LIMITATIONS: Knowing and understanding the risks involved in participation in the activity, Parent/Guardian consent to Minor’s participation, subject to the following express exceptions:  [description of exceptions, if any].

     

    d.      Knowing and understanding the risks involved with participation in the activity, Parent/Guardian voluntarily and willingly assumes full and complete responsibility for all losses and damages, including injury, illness, and death, resulting from Minor’s participation in the activity, including transportation to and from the activity. Parent/Guardian agrees that Parent/Guardian is solely financially responsible for any losses and damages resulting from Minor’s participation in the activity as described in the Express Assumption of Risk above. This express assumption of risk shall survive the termination of Minor’s participation in activities with Slam The Stigma.

  • EXHIBIT A

    COMMUNITY EXPECTATIONS

     

    1. No use of illicit drugs or alcohol. 

    2. No sexual misconduct (defined as exposure, touching, or inappropriate reference to body areas normally covered by undergarments), including no sexual promiscuity/PDA. 

    3. Smoking, vaping, and the use of tobacco products are not allowed on the premises or to, from, or during any trip. 

    4. Students will not break any American laws in the United States or any other country. 

    5. Students will adhere to all internet rules and restrictions that have been set up by Slam The Stigma. 

    6. Students will be respectful, encouraging, and will maintain a positive attitude toward others at all times. 

    7. Students will be respectful of both our space and property as well as the property of others. 

    8. Students will avoid the use of foul language, cursing, or any speech (including “humor”) which puts down, makes fun of, or stereotypes other persons or groups. 

     

    INTERNET ACCEPTABLE USE POLICY

     

    The following activities are prohibited:

    1.      Sending or displaying offensive messages or pictures 

    2.      Harassing, insulting or attacking others 

    3.      Violating copyright laws 

    4.      Employing the network for commercial purposes 

    5.      Using another’s ID password 

    6.      Intentionally wasting limited resources (paper, ink, etc.) 

    7.      Sharing your personal information on the internet.
