This contract (the "Contract") is entered into between Diana's DIY Designs LLC (hereinafter referred to as the "Artist," "We," or "Our") and

(hereinafter referred to as the "Client," "You," or

(the "Effective Date").

The Artist agrees to provide balloon decorating services (the "Services") for the Client's event as described below:

. The final bill will be issued on the day of the event.

The agreed date and Services will be locked in once the Contract is signed and the non-refundable deposit is paid. Any remaining balance will be due on the date of the event before the Services are completed and delivered.

The deposit can be paid via cashapp, venmo, apple pay, zelle, paypal or cash. The remaining balance will be paid on the date of the event via either payment method mentioned above.

The Client shall be responsible for any additional fees or expenses incurred beyond the scope of the original Services outlined in this Contract. Such fees may include but are not limited to, last-minute changes, transportation fees, and parking. Where such costs are incurred, they will be added to the final bill due on the day of the event. Travel within 15 min from Whiteville, NC will be free of charge. Any location beyond that will have a travel fee. All fees will be discussed as soon as possible.

The Client agrees to provide the Artist with unrestricted access to the event venue at least 2 hours prior to the scheduled start time of the event. The Client also agrees to schedule a minimum of 2 hours for breakdown. Breakdown and haul-away services are provided as part of this Contract. The required setup and breakdown time, along with the start time of the setup and the pickup time, may vary depending on the event and will be discussed prior to the signing of this Contract.

In the event that the Client fails to provide timely access to the venue, resulting in delays or insufficient time for setup, the Artist shall not be held responsible for any resulting limitations or compromises in the Services.

The Artist retains ownership of all decor equipment provided, unless stated otherwise. The Client shall be responsible for any damages, losses, or theft of the decor equipment that occurs during the event. The Client shall reimburse the Artist for the full cost of repair or replacement of any damaged, lost, or stolen decor equipment.

The Artist guarantees that all materials used in the balloon decorations, including balloons, ribbons, and any other components, will be of high quality and suitable for their intended purpose. If a manufacturer discontinues the product or changes its material type, the Artist has the right to make any changes, including but not limited to substituting the product for one of like kind and quality.

The Client agrees that during the agreed-upon event date and time, they will not engage or hire any other third-party contractors or providers for balloon decorating services at the same venue or location without prior written consent. The Artist reserves the right to leave the job site if a breach of contract occurs.

The Artist shall take reasonable precautions to ensure the safety of individuals and property during the provision of the Services. However, in the event of any accidents, damages, or injuries that occur during the setup, installation, or removal of the balloon decorations, the Artist shall not be held liable, except in cases of gross negligence or willful misconduct.

The Artist acknowledges that outdoor events are subject to weather conditions. In the event of adverse weather conditions, including but not limited to heavy rain or strong winds, the Artist reserves the right to modify or adjust the Services as necessary. In the event that the Services are unable to be provided due to weather conditions, the Artist will work with the Client to reschedule the event, subject to availability. If a mutually agreeable alternative date cannot be reached, a refund will be provided, minus any non-refundable deposit or expenses incurred up to that point.

If the Client requests outdoor balloon decorations, the Artist will make reasonable efforts to ensure their durability and stability in normal weather conditions. However, the Client acknowledges that outdoor environments are subject to unpredictable factors, such as wind, rain, and sunlight, which may impact the lifespan and integrity of the balloon decorations. To maintain the integrity of the decor, please keep the decor in the location and position they are ordered for. Do not place indoor decor outdoors, and vice versa.

The Artist reserves the right to photograph the balloon decorations they provide at the Client's event for promotional and marketing purposes, including but not limited to a website, social media, portfolio, and advertising materials. The Client grants the Artist the irrevocable and unrestricted right to use these photographs without any compensation or approval.

The Artist agrees to treat all the information provided by the Client as strictly confidential. The Client's personal information will not be shared without any expressed agreement.

Any changes to the event date, venue, or Services must be requested in writing and agreed upon by both parties. Additional fees may apply for significant changes to the Services. This booking arrangement cannot be changed once the Artist arrives at the event.

The Client may request to reschedule the event to a mutually agreed-upon date and time, subject to the Artist's availability. Any rescheduling request must be made no later than 14 days prior to the original event date or the Client will be responsible for paying the full amount stated in the Contract. In the event of a cancellation, the deposit paid is non-refundable.

Once the Client has made full payment for the Services as specified in this Contract, no refunds shall be provided.

If a breach of contract occurs, the Artist reserves the right to terminate the contract immediately, and all monies given are non-refundable. By signing below, both parties acknowledge and agree to the terms and conditions stated in this Contract.
