Description of Volunteer Activities

As a volunteer with Legacy Land Conservancy (“Legacy”), I may participate in a variety of volunteer activities throughout the year, including but not limited to: - Stewardship and land care activities such as removing invasive species, planting, watering, or maintaining trails; - Photomonitoring, data collection, and property visits on public or private conservation lands; - Independent or group volunteer workdays and long-term EcoSteward projects; and - Outreach, educational, or event support.

These activities may occur on public or private lands, including Legacy preserves and conservation easements. Volunteers may use hand or power tools, drive or walk across uneven terrain, and are responsible for arranging their own transportation.

1. Acknowledgment and Assumption of Risk

I understand that participation in Legacy’s volunteer activities involves inherent risks, including but not limited to: - Exposure to severe weather and extreme temperatures; - Use of hand tools, sharp objects, or power equipment; - Uneven or unstable terrain, falling branches, or other natural hazards; - Contact with toxic or allergenic plants, herbicides, and wildlife (including ticks, stinging insects, and other animals); - Risk of contagious disease (including, but not limited to, COVID-19); - The acts, omissions, or ill health of other volunteers or participants; and - The presence of hunting activity on certain preserves during legally permitted seasons.

I understand that some Legacy preserves allow regulated hunting in designated areas and at specific times of year. I acknowledge that it is my responsibility to remain alert, observe posted signage, and wear visible clothing (such as blaze orange) during hunting seasons. I agree to follow all safety guidance provided by Legacy staff or posted at preserve entrances.

I knowingly and voluntarily assume all such risks, including those that may result in personal injury, illness, property damage, or death. I agree that: - I will follow all instructions from Legacy staff or authorized representatives. - I will only use equipment I know how to operate safely. - I will not perform any activity I feel unqualified or unfit to complete. - I will take reasonable precautions to protect myself, others, and property. - I will immediately stop participating if I feel unwell or believe conditions are unsafe. - I will not participate while under the influence of drugs or alcohol.

2. COVID-19 Certification and Assumption of Risk

I have reviewed the COVID-19 symptoms listed by the U.S. Centers for Disease Control and Prevention (CDC) and certify that, within the past 14 days, I have not experienced these symptoms, tested positive, or knowingly been exposed to anyone with COVID-19. I understand that COVID-19 is contagious and may spread in any environment, including outdoor settings. I assume all risk of exposure and agree to follow CDC and Legacy safety guidelines.

3. Waiver, Release, and Indemnification

In consideration of being allowed to participate in volunteer activities with Legacy, I hereby release, discharge, and covenant not to sue Legacy Land Conservancy, its officers, directors, employees, agents, contractors, and volunteers (“Released Parties”) from any and all claims, demands, or causes of action for injury, illness, damage, or death arising out of or connected to my volunteer participation, whether caused by negligence or otherwise.

I further agree to indemnify and hold harmless the Released Parties from any and all claims, damages, or expenses (including attorney’s fees) arising from my participation or conduct during volunteer activities.

4. Medical Treatment and Insurance Responsibility

I consent to receive emergency medical treatment as deemed necessary during volunteer activities. I agree that I am solely responsible for any medical costs incurred. I understand that I am not an employee of Legacy and am therefore not eligible for workers’ compensation or employer-provided insurance coverage. I acknowledge it is my responsibility to maintain my own medical and health insurance coverage.

5. Equipment Use and Responsibility

I understand that I may use my own tools or equipment (including but not limited to hand tools, power tools, chainsaws, or other personal property) while volunteering. I acknowledge that: - I am fully responsible for the safe condition, operation, maintenance, and transport of any equipment I bring or use; - I will not hold Legacy Land Conservancy responsible for any loss, theft, damage, or malfunction of my personal tools or equipment; and - If my personal equipment causes injury or damage, I agree to indemnify and hold harmless Legacy Land Conservancy from any related claims or liabilities.

Legacy Land Conservancy makes no warranties or guarantees regarding the suitability, safety, or condition of any equipment (whether provided by Legacy or used personally) and assumes no responsibility for its maintenance or performance.

6. Photography and Media Release

I grant Legacy Land Conservancy the right to use any photographs, videos, or audio recordings taken of me (or my minor child) during volunteer activities for promotional, educational, or fundraising purposes without compensation or further approval.

7. Duration of Agreement

This Waiver and Release shall remain in effect for the duration of my involvement as a volunteer with Legacy Land Conservancy, unless I revoke it in writing. This waiver applies to all volunteer activities, whether one-time or recurring, conducted on behalf of Legacy.

8. Choice of Law and Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. If any provision of this Waiver is held invalid, the remaining provisions shall remain in full force and effect.

9. Survival

The terms of this Waiver—including the release of liability, assumption of risk, indemnification, and photographic release—shall survive the conclusion of my volunteer service and remain binding upon me, my heirs, assigns, and personal representatives.

10. Complete Agreement

This document constitutes the entire agreement between me and Legacy Land Conservancy regarding volunteer participation. No oral representations, promises, or inducements not contained herein shall be binding.

Acknowledgment of Understanding*

I have carefully read and fully understand this Waive rand Release of Liability. I acknowledge that I am giving up substantial legal rights, including the right to sue Legacy Land Conservancy. I sign this document voluntarily, intending it to be a complete and unconditional release of all liability to the fullest extent permitted by law.
