TERMS & CONDITIONS
Permission: I grant Moss Hudson & their legal representatives the irrevocable & unrestricted right to use & publish photographs of me, or in which I may be included, for editorial, trade, advertising, educational, & any other purpose & in any manner & medium; to alter the same without restriction; & to copyright the same.
Use and Disclosure: I agree that Moss Hudson may use such photographs of me with or without my name & for any lawful purpose, including, but not limited to, publicity, illustration, advertising, & web content. * If I have preferences on what is shared, I must let Moss Hudson know within 48hrs of gallery delivery in writing detailing what file name(s).
Social Media Posting: I will tag & list @mosspdxphoto in every post. I will not alter the photographs delivered of me. * If I have preferences on how I want the photographs edited, I will let Moss Hudson know in writing within 48hrs after the photoshoot.
Release and Waiver: I release & discharge Moss Hudson from any & all claims & demands that may arise out of or in connection with the use of the photographs, including without limitation any & all claims for libel or violation of any right of publicity or privacy. I acknowledge that modeling can, in some circumstances, be risky. I acknowledge myself / any minor children are not obligated to perform any act the deemed dangerous or otherwise inappropriate. I agree to let Moss Hudson know if the I do not wish myself / minor children to perform or participate in any act suggested. While all reasonable precautions will be made to ensure the safety of all models, I acknowledge accidents may occur. I hereby agree to indemnify & hold harmless Moss Hudson (including Moss Hudon’s employees or business associates), from any injuries, damages, or other losses that may occur directly or indirectly as a result the session.
Ownership: I acknowledge & agree that I have no ownership rights to the photographs & that all copyright & ownership belongs to Moss Hudson.
Compensation: I understand required compensation is made up of: $100 non-refundable deposit, plus an hourly pay rate. Deposits are due upon booking & serve as securing the date & time. If the I fail to make the required deposit, the session date & time will not be secured. Session hourly rates are due in-person immediately after the photoshoot. Fees may include add-ons (makeup artist rate, studio rate & film options) and milage if outside of the Portland OR Metro Area.
Cancelations: In the event I cancel the session with less than 48 hours' notice, Moss Hudson will retain the non-refundable deposit of $100. Moss Hudson reserves the right to cancel the session due to unforeseen circumstances including, but not limited to: inclement weather, illness, emergency, or any other conditions which Moss Hudson deems may adversely affect the quality of the session. In the event Moss Hudson cancels the scheduled session, the $100 will be applied to a re-scheduled session that is agreed-upon by the parties. In the unlikely event Moss Hudson is unable to fulfill duties due to injury, illness, natural disasters, or for any other reason beyond the reasonable control of Moss Hudson, his sole and exclusive remedy is the return of any payments made. This includes the loss of images that is beyond the control, including, but not limited to: fire, theft, or malfunction of equipment.
Late Policy: I agree if I am late to a session, such time will be deducted from the time alloted for the session. If I am late by more than 15 minutes, Moss Hudson may cancel or reschedule the session at the his discretion and may require an additional session Deposit.
Personal Information: I understand my name may be used in connection with the use of the photographs. If I have a preference for how my name is shared, I must let Moss Hudson know in writing (ex. Instagram only, no names) within 48 hours after the session.
