Thank you for choosing to participate in the above activity with Tennis QLD (Activity). Your child is almost ready to get going. To be eligible to participate in the Activity the parent/guardian of the Participant must read and sign this consent. As a parent/guardian of the Participant you give your consent for the Participant to participate in the forementioned Activity on the conditions set out below, and agree to those conditions on the Participant’s behalf:
CONSENT TO PARTICIPATE AND RISK WARNING
You understand that the Activity will involve physical activity and that as a result of participating in the Activity there is risk of injury, and in rare or extreme cases, there is even a risk of serious injury or death. You consent to the Participant participating in the Activity. You acknowledge that the Participant will be exposed to certain risks when participating in the Activity as outlined above and you fully accept and agree to bear those risks.
DECLARATION OF FITNESS TO PARTICIPATE
You declare that the Participant is medically and physically fit and able to participate in the Activity. You will immediately notify Tennis QLD of any change to the Participant’s medical condition, fitness or ability to participate. You understand that Tennis QLD will rely upon this declaration as the basis of the Participant’s fitness and ability to participate.
CONSENT TO MEDICAL TREATMENT AND MEDICAL TRANSPORT
You authorise Tennis QLD to collect, use and disclose the medical information provided on this Consent Form for the purpose of obtaining any medical assistance, treatment and transport for the Participant, as deemed reasonably necessary. You acknowledge and agree that you will be responsible for any costs associated with any such medical treatment and/or transportation.
TRANSPORT AND ACCOMODATION
You understand that the Participant will need to travel to participate in the Activity. Where relevant, you consent to the State Tennis Body at which the Participant is based organising transport for the Participant. You acknowledge that this transport is organised on your behalf by Tennis and you are responsible for any costs associated. You also understand that the Participant may need to stay in accommodation while participating in the Activity. Where relevant, you consent to Tennis organising accommodation for the Participant. You agree to release Tennis from any liability related to these transport and accommodation arrangements.
CONDUCT OBLIGATIONS
You acknowledge and agree that whilst the Participant is participating in the Activity, the Participant must, and if you are attending the Activity with the Participant, you must comply with all Tennis Australia national policies which can be obtained at http://www.tennis.com.au/about-tennis-australia/reports-and policies/policies and follow any lawful instructions of Tennis QLD.
You agree that the Participant must conduct themselves in a responsible and courteous manner at all times during the Activity. You acknowledge that if you or the Participant breach any Tennis Australia national policy, fail to follow any lawful instruction of Tennis QLD or engage in any behaviour which, in the opinion of Tennis QLD, has the potential to bring, or brings you, the Participant, Tennis QLD, the Activity or the sport of tennis into disrepute, Tennis QLD may take action including, but not limited to suspending or dismissing the Participant from the Activity; and/or not selecting the Participant for future Tennis QLD programs, tours, camps or teams.
CONSENT TO USE IMAGE
You consent to Tennis QLD and its government and commercial partners taking the Participant’s image while the Participant is participating in the Activity. You agree that any such photographs or video footage may be used by the above organisations in resources and reports, and in promotional, advertising or marketing materials, without any further notice or payment to you or the Participant.
RELEASE AND INDEMNITY
To the fullest extent permitted by law, you agree to release and discharge Tennis QLD and its directors, officers, employees, volunteers and agents from all liability in respect of any loss or damage the Participant may suffer. Without limiting the foregoing, you also agree to release, defend, hold, harmless and indemnify Tennis QLD and its directors, officers, employees, volunteers and agents from and against any actions, proceedings, claims, demands, expenses (including legal expenses), damages and liabilities howsoever arising from or incurred as a result of or in connection with the Participant’s participation in the Activity.
WARNING UNDER THE AUSTRALIAN CONSUMER LAW
WARNING: You acknowledge that the Participant participates in the Activity at their own risk. If the Participant participates in the Activity your rights to sue the supplier under the Australian Consumer Law in the event that the Participant is killed or injured because the Activity was not supplied with due care and skill or was not reasonably fit for its purpose, are excluded, restricted or modified in the way set out in or on this form.
EXCLUSION OF GUARANTEES: The guarantees relating to the supply of services contained in Subdivision B of Division 1 of Part 32 of the Australian Consumer Law are hereby expressly excluded in respect of the provision of recreational services.
NOTE: The change to the Participant’s rights, as set out in or on this notice, does not apply if the Participant’s death or injury is caused by reckless conduct on the supplier’s part. “Reckless conduct” is defined in section 139A of the Competition and Consumer Act.
PRIVACY
To assist us in the provision of products and services, we need to collect personal information about you and the Participant. When you provide the personal information of you and the Participant you agree that this will be used by Tennis Australia and other Australian Tennis Organisations under the terms of this statement, and the tennis privacy policy located at www.tennis.com.au/privacy, which contains information about how you and the Participant may access and seek correction of the Participant’s and your personal information or complain about
a breach of the Participant’s or your privacy, and how we will deal with that complaint.
If you do not agree, you must not provide the Participant’s or your personal information, and you and the Participant may be unable to access all of our products and services. We may disclose the Participant’s and your personal information to other parties, including our related companies, other Australian Tennis Organisations, and third parties who provide us services. From time to time, these third parties may be located (and therefore your and the Participant’s personal information may be disclosed) overseas, including to the USA and the Netherlands. We may use and disclose your and the Participant’s personal information for direct marketing purposes regarding the products and services you and the Participant are signing up to receive, unless you opt-out (which you can do at any time in accordance with the tennis privacy policy).
If the participant is under 18 years of age, a parent / legal guardian must sign the following acceptance of terms of the Event Participant Behaviour Guidelines.
1. Behavioural standards expected of participants
1.1. As part of the Event, participants must show respect and generosity to other participants (of any age), tennis officials and instructors, public officials, other individuals on a tour, service staff and any supervising personnel.
1.2. Supervising personnel have been appointed to exercise responsibility for a participant’s care and supervision on behalf of Tennis QLD throughout the Event. As such, participants must follow all of the supervising personnel’s instructions.
2. Participant commitment
2.1. During the Event, participants must:
2.1.1. comply with all Tennis Australia national policies, including the rules of tennis, the Member Protection Policy, the Code of Behaviour, the Disciplinary Policy and the Social Media Policy;
2.1.2. contribute to creating a positive team environment.
2.1.3. be safe in the use of equipment and facilities.
2.1.4. be on time and ready for all activities;
2.1.5. be ready & prepared for tennis activities including warm up/down.
2.1.6. be prepared with adequate clothing/equipment, food and drink for activities;
2.1.7. only use mobile phones at the appropriate times.
2.1.8. ask for help – listen and be heard;
2.1.9. not smoke or consume alcohol;
2.1.10. act at all times in such a way that reflects their role within their family, school or community; and
2.1.11. always show good sportsmanship and leadership.
3. Medical Matters
3.1. While on tour, participants must notify supervising personnel immediately if they are suffering from any injury or sickness and must follow the supervising personnel’s instructions in relation to treatment.
Participants who fall short of these behavioural expectations will be the responsibility of the supervising personnel. Depending on the seriousness of the behaviour, supervising personnel may impose a reprimand or punishment or refer the matter to/consult with Tennis Australia’s Integrity Unit for further action (which may involve suspending the participant from participating in the Event or in extreme cases, sending the participant home)
