I, the undersigned parent or legal guardian of the above-named minor child (the "Participant"), hereby acknowledge and agree to the following terms and conditions for the Participant's involvement in activities organized by Bridgeland Lady Bears Flag Football (the "Organization"), a youth sports program located in Texas. This Waiver and Release of Liability (the "Waiver") is intended to be as broad and inclusive as permitted by the laws of the State of Texas.
1. Acknowledgment and Assumption of Risk
I understand and acknowledge that participation in flag football and related activities (including but not limited to practices, games, tournaments, travel, conditioning, and team events) involves inherent risks, including but not limited to: physical injury, sprains, strains, fractures, concussions, or other harm. These risks may arise from the Participant's actions or inactions, the actions or inactions of others (including coaches, volunteers, other participants, spectators, or third parties), equipment failure, field conditions, weather, or other unforeseen circumstances.
I voluntarily assume all such risks on behalf of the Participant, whether known or unknown, and affirm that the Participant is physically fit and sufficiently trained to participate in these activities. I agree that the Organization, its officers, directors, coaches, volunteers, agents, sponsors, affiliates, and any related entities (collectively, the "Released Parties") shall not be responsible for any injury, loss, or damage resulting from these risks.
2. Release of Liability
In consideration of the Participant being permitted to participate in the Organization's activities, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, causes of action, damages, costs, expenses, or compensation whatsoever, whether in law or equity, arising out of or related to the Participant's participation in the Organization's activities. This release includes, but is not limited to, claims for negligence, gross negligence, intentional misconduct, strict liability, breach of contract, or any other theory of liability, except for acts of willful misconduct or intentional torts that are not permitted to be waived under Texas law.
This release extends to any claims for personal injury, wrongful death, emotional distress, property damage, medical expenses, lost wages, or any other losses sustained by the Participant or myself, even if such claims arise from the negligence or fault of the Released Parties.
3. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees), or judgments arising out of or related to the Participant's participation in the Organization's activities. This includes claims brought by third parties, such as other participants, spectators, or medical providers, as well as any claims asserted on behalf of the Participant.
I further agree to reimburse the Released Parties for any expenses incurred in defending against such claims, including but not limited to court costs, expert witness fees, and settlement amounts.
4. Medical Authorization and Insurance
I authorize the Released Parties to seek and obtain emergency medical treatment for the Participant if, in their judgment, such treatment is necessary. I understand that the Released Parties are not medical professionals and will not provide medical advice or treatment beyond basic first aid. I agree to be solely responsible for all medical expenses incurred, including transportation, hospitalization, and follow-up care.
I affirm that the Participant has adequate health insurance coverage for any injuries that may occur during participation. If the Participant does not have insurance, I accept full financial responsibility for all medical costs.
5. Photo, Video, and Media Release
I grant the Organization permission to use the Participant's name, likeness, image, voice, and/or appearance in photographs, videos, or other media captured during activities for promotional, educational, or archival purposes. This includes use on websites, social media, newsletters, or other publications. I waive any right to compensation or royalties for such use and release the Released Parties from any claims related to privacy, publicity, or defamation arising from such use.
6. Severability
If any provision of this Waiver is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid one that most closely achieves the original intent.
7. Entire Agreement and Acknowledgment
This Waiver constitutes the entire agreement between the parties and supersedes any prior understandings. I have read this Waiver carefully, understand its terms, and sign it voluntarily without duress. I am at least 18 years old and have the legal authority to execute this Waiver on behalf of the Participant. If the Participant is under 18, I affirm that I am the parent or legal guardian with authority to bind the Participant.
I acknowledge that by signing this Waiver, I am giving up substantial legal rights, including the right to sue the Released Parties.
