• ARTIST BOOKING AGREEMENT

  • THIS AGREEMENT is made as of

  • 1. ENGAGEMENT

  • The Purchaser engages the Artist to perform at the event described herein, and the Artist agrees to perform for the Purchaser under the terms and conditions outlined in this Agreement.

  • 2. PERFORMANCE DETAILS

  • The Purchaser agrees to pay the Artist a non-refundable honorarium of:

  • 4. TRAVEL ARRANGEMENTS

  • The Purchaser agrees to cover all travel expenses as follows:

  • 4.1 Airfare

  • Airline: Southwest Airlines (required) or Delta if Southwest doesn't fly to the destination.
    Flight Type: 2 (TWO) Nonstop, round-trip
    Booking: Presenter shall book and pay for airfare directly, OR provide advance payment for the Artist to book

  • Note: Only nonstop, round-trip flights are acceptable. Any deviation requires prior written approval.

  • 4.2 Ground Transportation

  • The Purchaser shall provide or reimburse the Artist for:

  • 5. HOTEL ACCOMMODATIONS

  • The Purchaser agrees to provide or pay for hotel accommodations as follows:

  • Hotel Standard: Single room, business-class accommodations (equivalent to 3-4 star)

  • Cost: Presenter covers 100% of room charges, taxes, incidentals and resort fees

  • Note: The Purchaser shall arrange and confirm all hotel reservations in advance and provide Artist with confirmation details at least 7 days prior to travel.

  • 6. Per Diem

  • Unless otherwise agreed in writing:
    • The Purchaser shall provide $50 (fifty) 
    • All incidental expenses related to the performance shall be covered by the Purchaser

  • 7. PERFORMANCE REQUIREMENTS

  • 7.1 Artist's Responsibilities:
    • The Artist shall perform professionally and in accordance with the performance description outlined in Section 2
    • The Artist shall provide all necessary accompaniment and backing tracks as agreed

  • 7.2 Purchaser's Responsibilities:

    • The Purchaser shall provide a professional venue with appropriate sound equipment
    • The Purchaser shall ensure proper stage setup, lighting, and technical support
    • The Purchaser shall provide a professional sound technician during the performance
    • The Purchaser shall provide a green room for the Artist
    • The Purchaser shall provide 1 (one) table for merchandise
  • 7.3 Technical Requirements:

  • 8. CANCELLATION POLICY

  • 8.1 Cancellation:

    • All parties agree to reschedule or reach a mutual agreement.

  • 9. NON-DISCLOSURE AND CONFIDENTIALITY

  • 9.1 Definition of Confidential Information

  • The parties acknowledge that in the course of this engagement, confidential and proprietary information may be shared. "Confidential Information" includes, but is not limited to:

    • Unpublished musical compositions, lyrics, melodies, and arrangements
    • Performance techniques, vocal methods, and proprietary processes
    • Business information, including pricing, rates, and contractual terms
    • Client lists, contact information, and relationship details
    • Event schedules, dates, locations, and performance details
    • Personal and private information disclosed during professional interactions

  • Exclusions: The following shall NOT be considered Confidential Information:

    • a) Information already in the public domain through no breach of this Agreement
    • b) Information rightfully received from a third party without confidentiality obligations
    • c) Information required to be disclosed by law, court order, or government authority

  • 9.2 Obligations of Receiving Party

  • The Purchaser agrees to:

    • Maintain all Confidential Information in strict confidence using reasonable care
    • Not disclose Confidential Information to any third party without prior written consent
    • Not use Confidential Information for any purpose other than the performance engagement
    • Immediately notify the Artist of any unauthorized disclosure or use
    • Return or destroy all Confidential Information upon request or termination of this Agreement

  • 9.4 Recording and Media Rights

  • Recording is permitted / Recording is NOT permitted without written consent

  • If permitted, the Purchaser grants the Artist the right to use recordings of the performance for promotional purposes

  • If permitted, Artist shall receive a copy of the final recording

  • 9.5 Intellectual Property

  • The Artist retains all intellectual property rights to performances, compositions, and any creative work. This Agreement does not grant the Purchaser any ownership interest in the Confidential Information or intellectual property.

  • 9.6 Remedies for Breach

  • The Purchaser acknowledges that breach of this confidentiality provision would cause irreparable harm to the Artist. The Artist shall be entitled to seek injunctive relief and equitable remedies, in addition to any monetary damages, to prevent disclosure or misuse of Confidential Information.
