By signing this document, I acknowledge that I am voluntarily participating in training, programs, activities, events, camps, clinics, rentals, and/or use of the facilities, equipment, and services provided by Toronto ProAthletix Lab (the “Facility”), located in Ontario, Canada.
1. Assumption of Risk
I understand and acknowledge that participation in athletic, fitness, and sports training activities involves inherent risks, including but not limited to: slips, falls, collisions, overexertion, equipment failure, contact with other participants, and the risk of serious injury, permanent disability, illness, or death. I further understand that these risks may be caused by my own actions, the actions or inactions of others, the condition of the facilities or equipment, or other foreseeable or unforeseeable causes.
I freely and voluntarily assume all such risks, both known and unknown, whether arising from negligence or otherwise, to the fullest extent permitted by law.
2. Release and Waiver of Liability
In consideration for being permitted to participate in activities at Toronto ProAthletix Lab, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and hold harmless Toronto ProAthletix Lab, its owners, directors, officers, employees, coaches, trainers, contractors, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, or liabilities arising out of or related to my participation or use of the Facility, including but not limited to claims for personal injury, illness, death, or property damage, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
3. Covenant Not to Sue
I agree that I will not sue or make any claim against the Released Parties for any injury, loss, or damage arising out of or related to my participation in activities at the Facility. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario and Canada.
4. Medical Condition and Fitness to Participate
I represent that I am physically and medically able to participate in the activities at Toronto ProAthletix Lab. I acknowledge that it is my responsibility to consult with a physician regarding my fitness to participate if I have any concerns. I agree to immediately stop any activity if I experience pain, dizziness, discomfort, or any unusual symptoms and to notify Facility staff.
5. Emergency Medical Treatment
In the event of an emergency, I authorize Toronto ProAthletix Lab and its representatives to obtain medical treatment for me if deemed necessary. I understand that I am solely responsible for any medical costs incurred as a result of such treatment.
6. Personal Property
I understand that Toronto ProAthletix Lab is not responsible for the loss, theft, or damage of any personal property that I bring onto the premises, including but not limited to clothing, equipment, valuables, or vehicles.
7. Photo and Video Release (Optional but Recommended)
I grant permission to Toronto ProAthletix Lab to use photographs and/or video recordings of me (or my child) taken at the Facility for marketing, promotional, and educational purposes, without compensation, unless I notify the Facility in writing otherwise.
8. Communicable Illness Acknowledgement (If You Want This Included)
I understand that participation in group athletic activities may expose me to communicable illnesses (including, but not limited to, colds, flu, or other viruses). I voluntarily assume this risk and agree that the Released Parties are not responsible for any illness I may contract in connection with my participation.
9. Minors – Parent/Guardian Consent
If the participant is under the age of 18, I represent and warrant that I am the parent or legal guardian of the minor participant. I consent to the minor’s participation in all activities at Toronto ProAthletix Lab and, on behalf of myself and the minor, agree to all terms of this Release, Assumption of Risk, and Waiver of Claims. I further agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor.
10. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
11. Acknowledgement and Understanding
I acknowledge that:
I have read and understood this agreement in its entirety.
I understand that by signing this, I am giving up substantial legal rights, including the right to sue.
I am signing this freely and voluntarily and intend this to be a complete and unconditional release of liability to the fullest extent permitted by law.
