Adoption Agreement

This Adoption Agreement (hereby known as “Agreement”), executed by   First Name*   Last Name*   (hereby known as “Adopter”) to adopt    Adoptive Animal's Name*   (hereby known as “Adoptive Animal” per the information above on this document) from Notorious D.O.G Dog Rescue, an Alabama non-profit, its directors, officers, employees, agents, representatives, successors, and assigns, located at 210 Stokes Street NW, Huntsville, AL 35805 (hereby known as “NDR”). 

Age. Adopter certifies that they are of legal age to enter in a contract.Initials*   

Submission Accuracy. Adopter certifies that all information submitted on their application to adopt remains correct and true. Adopter will inform NDR of any changes in contact information (e.g. phone number, email address, and home address). Initials*   

Ownership. Adopter hereby takes possession of Adoptive Animal and Adopter is responsible for all aspects of care in accordance with this Agreement and all state, county, city, or other municipal laws and regulations related to the welfare of companion animals. Initials*   

Donation. The Adopter agrees to make a non-refundable donation of $150.00, which covers the cost of this adoption. This Adoption shall not be considered effective until funds have cleared. In the event of non-sufficient funds (NSF), Adopter agrees to pay the non-refundable donation of $50.00 to cover the fees associated with NSF, which shall be payable by cash or credit card only. NDR accepts donations via check made payable to Notorious D.O.G. Dog Rescue, PayPal @notoriousdogrescue, Venmo @notoriousdogrescue, Cash App to $Notoriousdogrescue, or Zelle to 256-470-6699. Records. Adopter will given the records for Adoptive Animal at the time of adoption. Initials*   

Microchip. Adopter agrees to update Adoptive Animal’s microchip information upon completion of adoption and will keep all information up to date. Adopter will be given the information to update the microchip for Adoptive Animal at the time of adoption. In the event Adopter cannot keep Adoptive Animal for any reason, Adopter will immediately update Adoptive Animal’s microchip to reflect that NDR is the current owner. Initials*   

History. Adopter understands that NDR has rescued animals whose complete history is not always known and who may be anxious, frightened or unpredictable due to trauma and other changes in their circumstances. Adopter has been made aware of any known health or behavioral issues, however, NDR makes no guarantee as to the health of Adoptive Animal and that Adoptive Animal may have medical needs, socialization problems, and may not be housebroken. Identification. Adopter shall ensure Adoptive Animal has a properly fitted collar and identification tag attached to the collar. Initials*   

Care. Adopter agrees to provide adequate food, water, shelter, veterinary care, and humane treatment for Adoptive Animal at all times. Adopter agrees that Adoptive Animal is to be kept inside the home and not in a garage, shed or other structure or outdoors. Veterinary care includes but is not limited to routine exams, vaccinations, flea/tick/heartworm preventatives, and emergency care when needed. Initials*   

Treatment. Adopter agrees that Adoptive Animal is to be a companion animal, not a guard animal, and Adopter shall ensure Adoptive Animal is socially, mentally, and physically healthy to the best of their ability. Initials*   

Alteration of Appearance. Adopter agrees not to alter in any way the appearance of Adoptive Animal, this includes but is not limited to, cropping of ears or tails. Initials*   

Spay or Neuter. Adopter agrees to have Adoptive Animal spayed or neutered as soon as possible, or by 6 months of age. If an appointment has been made for Adoptive Animal for a spay or neuter, Adopter agrees to ensure Adoptive Animal is transported to that appointment, and Adopter agrees to take all measures possible to prevent Adoptive Animal from breeding with other dogs until the spay or neuter is complete. Containment. Adopter agrees to keep Adoptive Animal on a leash or in a fully fenced area whenever Adoptive Animal is outdoors. Initials*   

Transportation. Adopter agrees to crate or tether Adoptive Animal inside the cabin of a vehicle to protect Adoptive Animal and all persons inside the vehicle whenever transporting Adoptive Animal. Initials*   

Transfer. Adopter shall not under any circumstance, give or gift, sell, re-home, adopt out, or otherwise transfer possession of Adoptive Animal to anyone outside of NDR for any reason. If Adopter can no longer care for Adoptive Animal for any reason, refer to Return paragraph below. Initials*   

Training. Adopter understands that each dog is an individual and acclimation to a new environment can generally take 30 days but may take longer. During and after this period, unwanted behaviors may worsen or new behaviors may emerge. Adopter agrees to seek out a professional dog trainer to help them manage these behaviors and will contact NDR for recommendations. Initials*   

Return. Adopter agrees to contact NDR immediately if they can no longer care for Adoptive Animal for any reason and at any time, regardless of duration of adoption. Adopter will contact NDR immediately in writing to notoriousdogrescue@gmail.com. Initials*   

Euthanasia. Adopter agrees to contact NDR prior to euthanizing Adoptive Animal for any reason other than old age or a diagnosis by a veterinarian of a terminal medical condition. Initials*   

Notification. Adopter shall notify NDR immediately in the event of the loss, theft, or death of Adoptive Animal. Initials*   

Welfare. Adopter understands that NDR retains the right to visit the home to perform a welfare check on Adoptive Animal. Adopter agrees to make arrangements for and shall grant NDR permission to visit Adopter’s premises. Initials*   

Termination. If Adopter is found to be in violation of any provision of this Agreement, NDR retains the right to terminate this Agreement and Adopter shall be required to return Adoptive Animal named in this agreement and all other animals adopted from NDR by Adopter to NDR immediately. If Adopter does not return Adoptive Animal, Adopter consents to grant NDR access to Adopter’s premises if necessary to facilitate the return of Adoptive Animal. If NDR is forced to undertake legal action to enforce this provision of the Agreement, Adopter agrees to indemnify NDR for all court costs and attorney's fees connected with such an action. Guarantees. Adopter understands that NDR makes no guarantee as to the health of Adoptive Animal and that Adoptive Animal may have medical needs, socialization problems, and may not be housebroken. Initials*   

Photographic Release. Adopter agrees that NDR may use images and recordings, whether audio or visual of both, of Adopter taken during or in connection with the adoption process as it sees fit in its sole discretion to benefit and promote NDR and Adopter does not expect monetary compensation, remuneration, or a fee of any kind in exchange for allowing NDR to use such images and recordings. Adopter does hereby grant and convey unto NDR all right, title, and interest in any and all photographic images and video and audio recording made by NDR during the adoption process, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings and Adopter acknowledges and agrees that all artistic control is in the hands of NDR. Adopter further releases NDR from any recourse or action due to the nature or content of this production. Initials*   

Information Release. Adopter understands the information on this form may be submitted to any party with a legal interest and I release NDR and its officers and employees from any liability whatsoever for supplying such information. Initials*   

Assumption of Risk. Adopter agrees to take all reasonable precautions and to safeguard all persons and other animals from possible unpredictable actions by Adoptive Animal and to immediately report any bite incidents involving people or other animals to NDR. Adopter acknowledges and agrees that animal bites or other injuries to humans and other animals do occur, and that all animals can carry and transmit diseases, including diseases that can be transferred from animals to humans. Adopter understands that NDR will not be responsible for any damage an animal may inflict on any person, another animal, or any property, or for the transmission or transfer of any disease or parasite to other animals or people, and no attempt will be made by Adopter, or anyone on Adopter’s behalf, to hold NDR responsible for such damages. Adopter hereby expressly and specifically assumes the risk of injury or harm resulting from Adopter caring for Adoptive Animal. Initials*   

Waiver and Release. Adopter does hereby, voluntarily, and without duress execute this Agreement. Adopter does hereby release and forever discharge NDR from any and all actions, causes of action, suits, debts, liabilities, claims, and demands of whatever kind or nature, either in law or in equity, which have arisen now or may hereafter arise from Adopter caring for Adoptive Animal. Adopter understands that this Agreement discharges NDR from any liability or claim that Adopter may have against NDR with respect to any bodily injury, personal injury, illness, death, property damage, or any other damages that may result from Adopter caring for Adoptive Animal. Indemnification. Adopter agrees to indemnify and hold NDR harmless from any damages, loss, cost, or liability (including reasonable legal fees and the cost of enforcing this indemnity) arising out of or in any way resulting from Adopter caring for Adoptive Animal. Initials*   

Enforceability. If any provision of this Agreement is found to be unenforceable in any way, it shall be enforced to the maximum extent possible and all other provisions of this Agreement shall remain in full force and effect. Initials*
