WAIVER RELEASE ASSUMPTION OF RISK
INDEMNIFICATION AND COVENANT NOT TO SUE
PARENT AND LEGAL GUARDIAN AGREEMENT FOR MINOR
COMMONWEALTH OF PENNSYLVANIA
I am the parent or legal guardian of the minor participant. I have full legal authority to execute this agreement on behalf of the minor and on my own behalf. I understand that by signing this agreement I am giving up substantial legal rights on behalf of myself and the minor.
I acknowledge and agree that ice skating ice hockey and related activities are inherently dangerous and involve significant risks including but not limited to serious bodily injury permanent disability paralysis traumatic brain injury property damage and death. These risks exist whether or not protective equipment is used and regardless of the care taken by the Club.
I knowingly and voluntarily permit the minor to participate in all camps clinics practices games programs events training sessions off ice activities travel and any other activities conducted organized hosted supervised or associated with WBS Knights USPHL LLC Revo Ice Academy LLC and all subsidiaries affiliates owned or controlled companies interest owners co lessees contractors and their officers directors partners coaches employees volunteers and agents collectively referred to as the Club.
I expressly assume on behalf of myself and the minor all risks of participation whether known or unknown foreseeable or unforeseeable including risks arising from ice conditions boards glass equipment facility conditions weather negligent acts or omissions of other participants negligent acts or omissions of the Club inadequate supervision improper instruction transportation medical response or emergency care.
TO THE FULLEST EXTENT PERMITTED BY PENNSYLVANIA LAW I HEREBY KNOWINGLY AND VOLUNTARILY WAIVE RELEASE DISCHARGE AND HOLD HARMLESS THE CLUB FROM ANY AND ALL CLAIMS DEMANDS CAUSES OF ACTION LIABILITIES DAMAGES LOSSES COSTS OR EXPENSES OF ANY KIND ARISING OUT OF OR RELATED TO THE MINOR’S PARTICIPATION INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE CLUB.
I further agree on behalf of myself and the minor that I WILL NOT SUE OR COMMENCE ANY LEGAL ACTION AGAINST THE CLUB for any claim arising out of the minor’s participation including claims sounding in negligence.
I agree to INDEMNIFY DEFEND AND HOLD HARMLESS the Club from and against any and all claims demands damages losses liabilities judgments costs and expenses including attorneys fees arising out of or related to the minor’s participation any claim brought on behalf of the minor or any breach of this agreement by me or the minor.
I acknowledge and agree that the Club does not guarantee supervision at all times and has no duty to provide constant or individual supervision. I accept full responsibility for monitoring the minor’s condition conduct and readiness to participate.
I represent and warrant that the minor is in good health physically able and medically cleared to participate. I agree that if I or the minor believe conditions to be unsafe participation will immediately cease.
I grant permission for the Club to obtain emergency medical treatment for the minor if deemed necessary. I understand that I am solely responsible for all medical costs incurred and that the Club assumes no responsibility for medical care decisions or outcomes.
I acknowledge that participation may involve transportation including travel to and from facilities games or events. I assume all risks associated with transportation whether provided by the Club or third parties and release the Club from any related liability.
The minor agrees to comply with all rules policies codes of conduct and instructions issued by the Club whether written posted or verbal. This agreement remains fully enforceable regardless of the presence or absence of posted rules or signage.
I agree that this agreement applies to all present and future participation by the minor unless revoked in writing and acknowledged by the Club.
This agreement shall be governed by and construed exclusively under the laws of the Commonwealth of Pennsylvania. Any legal action arising from this agreement or the minor’s participation shall be brought exclusively in the state or federal courts located within Pennsylvania and I consent to personal jurisdiction and venue.
I acknowledge that this agreement may be executed electronically including through online registration and payment systems and that electronic acceptance constitutes a legally binding signature.
I HAVE READ THIS AGREEMENT IN ITS ENTIRETY FULLY UNDERSTAND ITS TERMS AND INTENTIONALLY AND VOLUNTARILY AGREE TO BE BOUND BY IT. I UNDERSTAND THAT I AM WAIVING AND RELEASING SUBSTANTIAL LEGAL RIGHTS ON BEHALF OF MYSELF AND THE MINOR TO THE MAXIMUM EXTENT PERMITTED BY LAW.
If any provision of this agreement is held invalid or unenforceable the remaining provisions shall continue in full force and effect.
