Pups Patio Dog Park & Bar Waiver and Release of Liability

Waiver, Release, and Indemnification Agreement

This Agreement is executed between the undersigned (“Participant” or “Patron”) and Pups Patio Dog Park & Bar, its affiliates, owners, employees, and agents (“Dog Park”). By entering or using the Dog Park and Bar premises, the undersigned agrees to the following:

1. Assumption of Risk
I understand that entering Pups Patio Dog Park & Bar involves certain risks, including but not limited to injury caused by dogs, other patrons, slips, falls, or accidents on the premises. I accept full responsibility for my safety, the safety of my dog(s), and my guests. I assume all risks associated with using the Dog Park, including any interactions with animals or other patrons, and agree to indemnify and hold harmless Pups Patio Dog Park & Bar from any and all claims of injury, damage, or loss that may occur.

2. Release of Liability
To the fullest extent permitted by law, I waive, release, and discharge Pups Patio Dog Park & Bar and its employees, agents, officers, and owners from any and all liability for personal injury, property damage, or death that I, my dog(s), or my guests may suffer while on the premises, regardless of the cause, including but not limited to the negligence or recklessness of the Dog Park, its employees, or any third parties.

3. Pet Ownership and Control
I affirm that I am the owner or handler of the dog(s) accompanying me to Pups Patio Dog Park & Bar. I agree to keep my dog(s) under control at all times and ensure they are on a leash when outside designated off-leash areas. I will follow all rules regarding dog behavior, including not allowing my dog(s) to be aggressive or disruptive toward other dogs, patrons, or staff.

4. Health and Vaccination Requirements
I certify that my dog(s) are up-to-date on all vaccinations, including rabies, distemper, and bordetella, and are in good health. I agree to immediately remove my dog(s) from the premises if they exhibit any signs of illness, aggression, or disruptive behavior.

5. Alcohol Consumption
I understand that Pups Patio Dog Park & Bar features a bar area where alcohol is served. I acknowledge that alcohol consumption can impair judgment and coordination, and I will not engage in any behavior that puts myself, my dog(s), or others in harm's way due to intoxication. I agree to comply with all applicable local laws and regulations related to alcohol consumption.

6. Damage to Property
I agree to take full responsibility for any damage caused by my dog(s) to the property of Pups Patio Dog Park & Bar, including but not limited to structures, furniture, or equipment. I will cover the cost of any necessary repairs or replacements.

7. Right to Refuse Entry
Pups Patio Dog Park & Bar reserves the right to refuse entry to any individual or dog that does not comply with its rules, or whose behavior is deemed dangerous, disruptive, or inappropriate. In such cases, no refund will be given for the entry fee.

8. Indemnity
I agree to indemnify and hold harmless Pups Patio Dog Park & Bar and its employees, agents, officers, and owners from any and all claims, liabilities, damages, costs, or expenses arising from my or my dog(s)’ actions, omissions, or behavior while on the premises.

9. Photographs and Media
I consent to the use of photographs, video, or audio recordings taken at Pups Patio Dog Park & Bar for promotional or educational purposes. I waive any right to compensation for the use of my image or likeness in such materials.

10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Florida.
By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms and conditions of this waiver and release of liability. I also acknowledge that I am responsible for ensuring that all guests accompanying me, including my dog(s), are informed of and adhere to these terms.

Minors

Any minor (under the age of 18) entering Pups Patio Dog Park & Bar must be accompanied and supervised at all times by a parent or legal guardian. The parent or legal guardian assumes full responsibility for the minor’s safety and behavior while on the premises. By signing this waiver, the parent or legal guardian agrees to release, indemnify, and hold harmless Pups Patio Dog Park & Bar from any and all claims, liabilities, damages, or injuries arising from or related to the minor’s presence or actions while on the premises.

Parent / Legal Guardian Acknowledgment (Required if Minor Present)
I am the parent or legal guardian of the minor(s) listed below and consent to their participation and presence at Pups Patio Dog Park & Bar. I have read and agree to all terms of this waiver on their behalf.
