PART A: ACKNOWLEDGEMENT OF RISKS & INFORMED CONSENT:
1. Acknowledgement of Terms of Sale - I, the undersigned CUSTOMER confirm that I have read and agree to be bound by the Terms of Sale of Thread and Chain, as in force at the time of service. I acknowledge that this Authorisation is to be read together with, and does not replace, the Terms of Sale.
Description of Service & Welding Acknowledgment: I, the undersigned CUSTOMER (and Parent/Guardian on the CUSTOMER’S behalf), acknowledge that I am voluntarily electing to receive a permanent jewellery service. This service involves the use of a specialised arc welding machine to safely solder a delicate chain closed. This procedure is a form of permanent body modification and is irreversible without cutting the chain.
2. Acknowledgment of Inherent Risks: I understand and acknowledge that despite the technician taking all reasonable care and skill, the procedure involves inherent risks. I acknowledge that once welded, the jewellery is intended to be permanent and may only be removed by cutting (in line with the Self-Removal instructions provided by Thread and ChaiN or by professional removal.
I accept these risks on behalf of the minor, including but not limited to:
- Heat/Welding Risk: Potential for minor heat exposure, pinching, or brief, superficial burns if the Client moves suddenly or does not follow safety instructions.
- Allergic Reaction: Potential for an allergic reaction, contact dermatitis, or irritation to the metal (e.g., gold, sterling silver) used in the jewellery.
- Injury & Loss: Potential for the chain to snag, stretch, break, or cause minor injury (scratch/tear) if pulled with extreme force. The Business is not responsible for loss.
- Removal Requirement: The need for the jewellery to be removed permanently for medical procedures (e.g., MRI, X-ray, surgery) or security checks (e.g., airport).
- DOES NOT have a known allergy to GOLD, STERLING SILVER.
- DOES NOT have a pacemaker, internal defibrillator, or any other implanted medical device that could be negatively affected by the welding equipment.
- DOES NOT have any open cuts, wounds, or severe skin conditions (e.g., active eczema, dermatitis) in the area of the procedure.
- Safety Instructions; I confirm the technician has provided clear verbal instructions and I will ensure the minor remains completely still and does not look directly at the welding light/spark during the procedure.
PART B: PARENT/LEGAL GUARDIAN AUTHORISATION & DECLARATION
FOR MINORS UNDER 16 YEARS OF AGE:
I, the undersigned Parent/Legal Guardian: confirm I have the legal authority to act on behalf of the minor named above.
- I give my explicit, informed consent for the minor to undergo the permanent jewellery service as described.
- I confirm that I have read and understand the Acknowledgment of Risks (Section B) and voluntarily accept all associated risks on behalf of the minor.
- I declare, as per Australian state legal requirements, that I am the Parent or Legal Guardian and I am providing this consent in person at the time of the procedure.
PART C: WAIVER, RELEASE & INDEMNITY (TO THE EXTENT PERMITTED BY LAW)
I, the undersigned Parent/Legal Guardian (on my own behalf and on behalf of the minor):
- RELEASE OF LIABILITY: Hereby release, indemnify, and hold harmless the Business, its employees, agents, and representatives ("The Releasees") from any and all claims, demands, or causes of action arising from or in connection with the minor's participation in the service, including (but not limited to) injury, loss, or damage, that may occur as a result of the inherent risks of the permanent jewellery procedure.
- AUSTRALIAN CONSUMER LAW (ACL) ACKNOWLEDGEMENT: I acknowledge that this waiver does not exclude or limit the liability of the Releasees for gross negligence or a breach of the statutory consumer guarantees under the Australian Consumer Law (ACL), including the guarantee that the services will be rendered with due care and skill.
