RELEASE OF LIABILITY AND HOLD HARMLESS (“AGREEMENT”) / RENUNCIA Y LIBERACIÓN DE RESPONSABILIDAD ("ACUERDO")
1. In consideration for my participation in remote cooking with knives, gardening, in person work at the farmers market, and other facilities during this school year (the “activities”), I agree to assume all risks and hereby release, waive, discharge and covenant not to sue Foodwise, its directors, officers, agents, and employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to death, injury loss, or property damage, including, but not limited to medical bills, lost wages, pain and suffering and attorney fees and costs that I may sustain as a result of my participation in such activities, event though such may arise from the negligence on the part of the persons or entities being released, or because of their possible liability without fault, or through no fault of my own.
2. To the best of my knowledge, I am not aware of any disability or health-related reasons or problems that would preclude or restrict my participation in these activities. I am fully aware of the risks and hazards connected with the activities, including, but not limited to those arising from exposure to: uneven, overgrown, and/or slippery terrain; bees and other insects; operation of tools and heavy machinery; farm animals; and the elements such as sun, cold, wind and rain, and I hereby elect to voluntarily participate in said activities, knowing that the activities may be hazardous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death that I may sustain as a result of being engaged in such activities.
3. I agree to indemnify, defend and hold harmless Foodwise, its directors, officers, agents, and employees, from any loss, liability, damage or costs, including court costs and attorneys' fees that may be incurred, due to my participation in said activities.
4. I expressly intend that this Agreement shall bind my family, heirs, successors, assigns and personal representative and, on behalf of each of the foregoing, shall be deemed as a release, waiver, discharge and covenant not to sue Foodwise, its directors, officers, agents, and employees. I hereby further agree that this shall be construed in accordance with the laws of the State of California.
I have CAREFULLY read THIS AGREEMENT, FULLY UNDERSTAND ITS CONTENTS, and i am signing it voluntarily. No oral representations, statements, or inducements have been made in connection with my signing the Agreement. I am aware that this is a contract between me and Foodwise. If I am under eighteen (18) years of age, or I am not legally competent to sign on my own behalf, my legal guardian has completely reviewed this Agreement and understands and consents to its terms and authorizes my participation in the activities by his/her signature below.
THIS IS AN IMPORTANT LEGAL DOCUMENT. READ IT CAREFULLY BEFORE SIGNING BELOW.

1. En consideración de mi participación en excursiones en granjas y mercados de agricultores (las "actividades") durante este año escolar, estoy de acuerdo con asumir todos los riesgos y por la presente libero, renuncio, descargo y pacto de no demandar a Foodwise, sus directores, funcionarios, agentes y empleados de cualquier y toda responsabilidad, reclamos, demandas, acciones y causas de acción que surjan de o en relación con la muerte, la pérdida de lesión o daño a la propiedad, incluyendo, pero no limitado a las cuentas médicas, salarios perdidos, dolor y el sufrimiento y honorarios de abogados y costos que puedan sufrir como resultado de mi participación en estas actividades. Aunque tal acontecimiento puede surgir de la negligencia por parte de las personas o entidades involucradas, o por su posible responsabilidad sin culpa, o no por mi culpa.
2. Segun mi leal saber y conocer yo no tengo conocimiento de ninguna discapacidad o razones relacionadas con la salud o problemas que impidan o restrinjan mi participación en estas actividades. Soy plenamente consciente de los riesgos y peligros relacionados con las actividades, incluyendo pero sin limitarse a los derivados de la exposición a: terreno irregular y con mucha vegetación, y / o resbaloso, abejas y otros insectos; funcionamiento de las herramientas y la maquinaria pesada, los animales de la granja; y los elementos como el sol, frío, viento y lluvia. Por la presente opto a participar voluntariamente en las actividades dicha sabiendo que las actividades pueda tener peligros para mí y mi propiedad. Yo asumo voluntariamente toda la responsabilidad por cualquier riesgo de daños a la propiedad perdida, o lesiones personales, incluyendo la muerte que yo pueda sufrir como resultado de haber sido involucrado en estas actividades.
3. Acepto indemnizar, defender y eximir a Foodwise, sus directores, oficiales, agentes y empleados, de cualquier pérdida, responsabilidad, daño o costos, incluyendo los costos judiciales y honorarios de abogados que se pueda incurrir debido a mi participación en las actividades dichas.
4. Yo tengo la firme intención de que este acuerdo será vinculante para mi familia, herederos, sucesores, cesionarios y representantes personales y en nombre de cada uno de los anteriores, se considerará como una liberación, renuncia, despido y el pacto de no demandar Foodwise, sus directores, funcionarios, agentes y empleados. Ademas estoy de acuerdo con que esta se interpretará de acuerdo con las leyes del Estado de California.
HE LEÍDO CUIDADOSAMENTE ESTE ACUERDO ENTENDIENDO COMPLETAMENTE SU CONTENIDO Y LO FIRMO VOLUNTARIAMENTE. No hay representaciones orales, declaraciones o incentivos que se han hecho en relación con mi firma del Acuerdo. Soy consciente que este es un contrato entre yo y Foodwise. Si soy menor de dieciocho (18) años de edad o no soy legalmente competente para firmar en el mío propio, mi tutor legal ha revisado completamente este acuerdo y entiende y acepta los términos y autoriza mi participación en las actividades con su firma abajo.
