  • Arizona Vehicle Rental Agreement

  • 1. Eligibility and Representations

  • Renter represents that all information provided is accurate, holds a valid driver's license, and is legally qualified to operate the Vehicle. No other person may drive unless approved in writing by the Company.

  • 2. Term and Return

  • Renter agrees to return the Vehicle on or before the stated end time in the same condition as received, ordinary wear excepted. The vehicle will be inspected upon return for damages, excessive wear, or violations of rental terms.

  • Renter acknowledges that the full rental amount is due upon approval of the booking and will be paid through the Stripe payment link provided by the Company. Renter authorizes Company to charge the payment method provided for any additional amounts owed under this Agreement, including but not limited to:
    • Physical damage to the vehicle (interior or exterior) beyond normal wear and tear
    • Mechanical damage caused by negligence, misuse, or unauthorized modifications
    • Excess mileage fees
    • Late return penalties
    • Cleaning fees for excessive dirt, stains, or odors
    • Loss or damage to accessories (keys, remotes, GPS, chargers, etc.)
    • Tolls, citations, impound fees, and administrative processing fees
    • Loss of use
    • Diminished value
    • Fuel charges
    • Any breach of this Agreement
  • The company does not place a temporary hold on the renter's card; all charges are processed as actual payments.
  • Renter remains financially responsible for all charges owed, including any amounts exceeding the initial rental payment.
  • Failure to provide required documentation (valid driver's license, insurance, and completed forms) will result in cancellation of the rental.

  • 4. Permitted Use

  • The vehicle is for lawful personal transportation on paved public roads within approved geographic limits.

  • 5. Prohibited Use

  • Renter shall not use the Vehicle for racing, speed contests, burnouts, drifting, off-road driving, towing, ride sharing, subleasing, or illegal purposes. Violation constitutes a material breach.

  • 6. Mileage

  • Mileage allowance and excess charges are defined in the rental confirmation.

  • 7. Responsibility for Damage

  • Renter is responsible for all damage regardless of fault, including damage caused by third parties, unless otherwise prohibited by Arizona law. Responsibility includes:
    • Wheels, tires, glass, interior, undercarriage, and mechanical components
    • Physical damage, cosmetic or structural
    • Mechanical damage caused by improper operation
    • Loss or damage to accessories
    • Damage not immediately visible at return ("latent damage")
  • Renter remains financially responsible for all charges owed under this Agreement, including any amounts exceeding the initial rental payment.

  • 8. Damage Assessment and Payment

  • Damage and fee assessments will be determined by the Company upon inspection of the vehicle at return.
    Companies may use professional repair estimates to calculate costs.
    Renter agrees to pay any outstanding balance within 10 business days of notification.
    Failure to pay may result in collection actions and additional legal remedies.

  • 9. Insurance Priority

  • Renter's insurance shall be primary. Any insurance maintained by the Company shall be excess.

  • 10. Indemnification

  • Renter agrees to indemnify and hold Company harmless from claims, liabilities, losses, and attorney fees arising from the rental or operation of the Vehicle.

  • 11. Accidents and Reporting

  • Renter must notify law enforcement and Company immediately and cooperate with investigation and claims.

  • 12. Loss of Use and Diminished Value

  • Renter agrees to pay the daily rental rate for the time the Vehicle is unavailable plus any reduction in market value.

  • 13. Telematics, Risk, and Repossession

  • The vehicle may contain GPS and monitoring systems. Company may repossess the Vehicle without prior notice if Company believes the Vehicle is at risk or this Agreement has been violated.

  • 14. Traffic Violations and Tolls

  • Renter is responsible for all citations, tolls, impound fees, and administrative costs.

  • 15. Fuel and Cleaning

  • The vehicle must be returned with the same fuel level and in clean condition. Additional charges may apply.

  • 16. Late Return

  • Late return may result in additional rental charges and may constitute unauthorized possession.

  • 17. No Waiver

  • Failure of Company to enforce any provision shall not constitute a waiver.

  • 18. Electronic Signatures

  • Electronic signatures shall have the same force and effect as originals.

  • 19. Governing Law and Venue

  • This Agreement is governed by Arizona law. Any action shall be brought in Maricopa County, Arizona.

  • 20. Jury Trial Waiver

  • Where permitted by law, the parties waive the right to a jury trial.

  • 21. Entire Agreement

  • This document contains the entire agreement between the parties and supersedes all prior discussions or supplemental forms.
