    2026 Adelaide University Pedal Prix Racing Championship, conducted by the Australian International Pedal Prix Inc (AIPP) trading as Pedal Prix Racing (PPR)

    Each rider must submit a signed copy of this form before the first event entered. As part of this process, the rider (or guardian) will receive a copy, along with the Team Manager and PPR.

  • DEFINITIONS

    “Organising Body” referred to in this document is Pedal Prix Racing and includes all employees, agents, officers, volunteers and directors.

    “Event/s” referred to in this document is any of the events conducted by the Organising Body.

    “Claim” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising from or in connection with any Endurance Racing Activities, but does not include a claim by any person expressly entitled to make a claim under an insurance policy held by the Organising Body.

    “Endurance Racing Activities” means participating, competing or performing in any capacity, including as a member, in any authorised or recognised Organising Body activities, including by not limited to Endurance Racing, training in Endurance Racing, test driving a human powered vehicle, or otherwise driving or moving a human powered vehicle being used for or in connection with Endurance Racing and related activities.

    ‘Reckless Conduct’ has the same meaning as defined in s42 of the Fair Trading Act 1987 being a person’s conduct where the person is aware, or should reasonably have been aware, of a significant risk that his or her conduct could result in personal injury to another and the person engaged in the conduct despite the risk and without adequate justification.

    ‘Significant’ means not nominal, trivial or minor.

     

    IMPORTANT NOTICE

    The following information affects your legal rights and obligations. Please read these carefully and only sign if you fully understand their contents. For participants under the age of 18, these documents must be completed and signed by a parent or legal guardian.

  • PARTICIPANT’S WARRANTIES

    1. I am a rider in the 2026 Adelaide University Pedal Prix Racing Championship and have read and understood the rules of the Adelaide University Pedal Prix Racing Championship and will abide by such rules at all times.

    2. It is understood that I am participating in a competition to test or appraise the vehicle entered against others on a closed circuit designated by the Organising Body.   Such competition will be between two or more human powered vehicles (governed by the use of relevant construction specifications) running simultaneously on the same course and where the determining factor is the highest number of laps covered in a given time ("Endurance Racing").

    3. In exchange for being able to attend or participate in these events, I declare, acknowledge and agree -

    3.1 I am medically and physically fit and have sufficiently trained for the Event/s for which I am entered and have an appropriate level of physical fitness, conditioning and endurance to safely participate in the event and that I am not being prescribed any medications which may alter my reaction time or otherwise impair my judgement and/or there are no medical conditions or pre-existing injuries which may impact on my ability to safely participate and any necessary medical clearances and advice has been obtained from my treating medical specialists as to any risks associated with any medical conditions prior to entry into the event;

    3.2 to abide by the Organising Body’s rules and any direction or instruction given to me by the Organising Body, Event Director, Race Director, Chief Marshal, or any official Event Personnel including Track Marshals during the course of the Endurance Racing Activities;

    3.3 to all times wear and/or use any protective equipment given to me by the Organising Body or required to be used or worn by me by the Organising Body, including the safety belt or harness;

    3.4 I will not engage in any reckless, negligent or foolish behaviour or any other behaviour that is likely to cause injury to me, or any other participant or person;

    3.5 that if any action on my part, or on my team’s part is deemed by the Organising Body to be in breach of the Championship Regulations, Rules or Specifications, penalties may be applied to myself or the team at the sole discretion of the Organising Body;

    3.6 that if I suffer any injury or illness, the Organising Body may provide first aid or medical treatment or evacuation or transport to any hospital at my expense and that my acceptance of these terms and conditions constitutes my consent to such first aid, medical treatment and/or evacuation or transport to any hospital unless I expressly withdraw that consent at the time and are mentally fit to withdraw that consent; and

    3.7 that it is a pre-condition to me participating in any Endurance Racing Activities that I must not consume any alcohol or mind altering substance or be under the influence of any alcohol or mind altering during participating in the Endurance Racing Activities. I declare that I have not consumed any alcohol or mind-altering substance, or medication that may impact my judgment or physical capacity, before or at the time of participating in Endurance Racing Activities.

     

    RISK WARNING

    4. Endurance Racing is a Recreational Service as defined under the Australian Consumer Law, being the participation in a sporting or leisure activity or other activity where there is a significant degree of physical exertion or physical risk. Recreational Activities including Endurance Racing are dangerous and there are or may be inherent and obvious risks associated with participating in Recreational Activities. Accidents can and do happen and may result not only from your actions (including physical exertion) but also from the action, omission or negligence of others, including the Organising Body, which may result in:

    4.1 physical injury and/or psychological injury, or aggravating a physical or psychological injury;

    4.2 contracting a disease or illness;

    4.3 aggravating an existing condition that is harmful or could result in harm to the individual or community, which could in some circumstances be serious in nature and although unlikely, may even result in death.

    5. More specifically, the types of risks associated with attending or participating in Endurance Racing Activities (although not exhaustive) include:

    5.1 sporting injuries (including but not limited to soft tissue, bruising, sprains, strains, joint injuries and bone injuries or exacerbation of pre-existing injuries), fatigue and physical or mental exertion, dehydration and heat stress;

    5.2 unexpected medical episodes due to the physical and mental exertion and the endurance nature of the event, or unknown medical conditions or illnesses;

    5.3 human powered vehicles travelling at high speed and the reduced time to react/respond to control the vehicle in a certain way;

    5.4 loss of control of the human powered vehicle resulting in it losing balance and tipping or rolling over;

    5.5 human powered vehicles (or parts or them, or debris) colliding with other human powered vehicles, persons or property;

    5.6 parts of your human powered vehicle or a competitors human powered vehicle becoming damaged during the event or not operating correctly;

    5.7 driver error (my own and that of the other competitor on the track at the same time) or my decisions, or the decisions of the other competitor on the track at the same time as to how they control or manoeuvre their human powered vehicle;

    5.8 track conditions (such as substances or items on the track, or defect in the surface of the track), or a change in track conditions arising from the use of the track during the event, a substance unexpectedly coming onto the track or an unexpected weather event.

    6. Before participating in any Endurance Racing Activities, you should ensure that you are aware of all of the risks involved, including any risks associated with any health condition or medical history you may have, or any medication that you are being prescribed and seek expert medical advice in that regard.

    7. By Signing this Form 3, I hereby acknowledge, agree and fully understand and accept that:

    7.1 participating in Endurance Racing Activities may involve risk, including the type specifically set out above in '5.1 to 5.8';

    7.2 I agree and assume any such risk voluntarily and at my own risk;

    7.3 I further agree that this warning constitutes a ‘risk warning’ in accordance with relevant legislation.

  • EXCLUSION OF LIABILITY

    8. I agree to and unconditionally release, waive, discharge and forever hold harmless, the Organising Body or any of its employees, agents, volunteers, directors or officers from any claims as a result of any property damage or personal injury sustained, whether caused by the Organising Body’s wilful act or omission, breach of contract, breach of statutory duty, error, or otherwise in connection with or arising out of the Endurance Racing Activities to the fullest extent permitted by law except to the extent that any property damage or personal injury was caused or contributed to by any Reckless Conduct on the part of the Organising Body.

    9. I agree that the Organising Body will not be liable for any claims for property damage or personal injury that may be brought against it as a result of or in connection with any act, omission, default, failure or error on the part of the Organising Body and agree to indemnify the Organising Body in respect of any such claims except that the indemnity will be reduced proportionally to the extent that any such act, omission, default, failure or error on the part of the Organising Body constitutes Reckless Conduct.

     

     

    WAIVER

    10. Pursuant to s139A of the Australian Consumer Law 2010 (Commonwealth), a provider of a Recreational Service is permitted to seek to exclude, modify or restrict the consumer guarantees under s60 and 61 by agreement with a person who is seeking to participate in that Recreational Service (or by agreement with a person for whom or on whose behalf you are acquiring the services or activities).

    11. If you accept and sign this Form 3, you will be agreeing that your rights (or the rights of a person for whom or on whose behalf you are acquiring the Recreation Service) to sue the Organising Body in relation to Recreational Service or Recreations activities that you participate or engage in because the Recreational Service was not in accordance with the consumer guarantees are excluded, modified or restricted in the terms set out below.

    12. For Recreation Services or Recreational Activities to which the Australian Consumer Law (Cth), Civil Liability Act 1936 (SA) and Civil Liability 2002 (WA):

    12.1 You agree, by accepting and signing this Form 3, that the liability of the Organising Body in relation to the Recreational Service for any:

    12.1.1 death;

    12.1.2 physical or mental injury (including the aggravation, acceleration or recurrence of such injury which was pre-existing);

    12.1.3 the contraction, aggravation or acceleration of a disease; and

    12.1.4 the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs:

    12.1.4.1 that is or may be harmful or disadvantageous to you or the community;

    12.1.4.2 that may result in harm or disadvantage to you or the community, that may be suffered by you (or a person for whom or on whose behalf you are acquiring the services) resulting from the supply of recreational services or recreational activities,

     

    Is excluded except to the extent that any of the harm set out in paragraphs 12.1.1 to 12.1.4 above was caused by the Reckless Conduct on the part of the Organising Body including its servants and agents.

    Under section 42 of the Fair Trading Act 1987 (SA), the supplier of recreational services is entitled to ask you to agree to exclude, restrict or modify his or her liability for any personal injury suffered by you or another person for whom or on whose behalf you are acquiring the services (a third party consumer). For South Australian riders over the age of 18, you will be directed to the ‘Form 1 Recreational Services—Exclusion, restriction or modification of rights under the Australian Consumer Law (SA)’ provided under the Fair Trading Act 1987 (SA) on the next page.

    South Australian riders under the age of 18 will not be directed to the Form 1 as it stipulates that a child under the age of 18 cannot legally agree to exclude, restrict or modify his or her rights and a parent or guardian cannot legally agree to exclude, restrict of modify the child’s rights.

  • 14. Categories S1 to S3 - A Medical Declaration Form carrying relevant medical information to assist with emergency treatment as required for school excursions, or similar, has been completed and I am covered by adequate appropriate insurance (eg school insurance, ambulance cover).

    I have read this document and understand and acknowledge its contents and confirm that the minor is medically and physically fit and otherwise capable of safely participating in Endurance Racing Activities, that I have understood and acknowledge the Risk Warning and have explained the contents of this form and obligations on riders to the minor. I consent to the minor participating in Endurance Racing Activities on the terms and conditions set out in this Form 3 and there is no other information relating to the Rider which might impact on their ability to safely participate in the Endurance Race Activities which has not been disclosed by me to the Organising Body.

  • FOR SOUTH AUSTRALIA – FAIR TRADING ACT 1987

    Form 1—Recreational services—Exclusion, restriction or modification of rights under the Australian Consumer Law (SA)
  • Your rights:

    Under sections 60 and 61 of the Australian Consumer Law (SA), if a person in trade or commerce supplies you with services (including recreational services1), there is:

    • a statutory guarantee that those services will be rendered with due care and skill; and
    • a statutory guarantee that those services, and any product resulting from those services, will be reasonably fit for the purpose for which the services are being acquired (as long as that purpose is made known to the supplier); and
    • a statutory guarantee that those services, and any product resulting from those services, will be of such a nature, and quality, state or condition, that they might reasonably be expected to achieve the result that the consumer wishes to achieve (as long as that wish is made known to the supplier or a person with whom negotiations have been conducted in relation to the acquisition of the services).

     

    Excluding, restricting or modifying your rights:

    Under section 42 of the Fair Trading Act 1987, the supplier of recreational services is entitled to ask you to agree to exclude, restrict or modify his or her liability for any personal injury suffered by you or another person for whom or on whose behalf you are acquiring the services (a third party consumer).

    If you sign this form, you will be agreeing to exclude, restrict or modify the supplier's liability with the result that compensation may not be payable if you or the third party consumer suffer personal injury.

     

    Important

    You do not have to agree to exclude, restrict or modify your rights by signing this form.

    The supplier may refuse to provide you with the services if you do not agree to exclude, restrict or modify your rights by signing this form.

    Even if you sign this form, you may still have further legal rights against the supplier.

    A child under the age of 18 cannot legally agree to exclude, restrict or modify his or her rights.

    A parent or guardian of a child who acquires recreational services for the child cannot legally agree to exclude, restrict or modify the child's rights.

     

    Agreement to exclude, restrict or modify your rights:

    I agree that the liability of Pedal Prix Racing (the Organising Body) for any personal injury that may result from the supply of the recreational services that may be suffered by me (or a person for whom or on whose behalf I am acquiring the services) is:

    (a) excluded, except to the extent that it is established that any significant personal injury is suffered by you as a result of the Reckless Conduct of the Organising Body.

     

    Definitions

    1. ‘Recreational services’ are services that consist of participation in:

    • a sporting activity or similar leisure-time pursuit; or
    • any other activity that involves a significant degree of physical exertion or risk and is undertaken for the purposes of recreation, enjoyment or leisure.

    2. ‘Personal injury’ is bodily injury and includes mental and nervous shock and death.
