GEAR Day Entry Form

The following waiver will form part of the "sign on" process on the day of the event.

As a condition for the acceptance of this entry application, I hereby acknowledge that:

1.        GEAR Inc. have invited me to seek independent legal advice before signing any documentation associated with the above listed event;

2.        I have received, read, understood and accepted the contents of the Supplementary Regulations pertaining to the above event and agree that I am bound by them;

3.        I have received, read, understood and signed the Waiver of Liability pertaining to the above event, which has been provided on the back of this document;

4.        I will be attending the Participant’s Briefing, held immediately prior to the commencement of the abovementioned event;

5.        I am aware that there is driver’s personal accident insurance cover for this event;

6.        I am not aware of any personal health problems that would put myself and/or others at any risk, while participating in the event.

RELEASE AND WAIVER OF LIABILITY ASSUMPTION OF RISK AND INDEMNITY AGREEMENT will be available to sign at "sign on" on the day of the event.

Motor Racing is Dangerous and accidents can and do happen at events.  It is warranted that all care is taken to protect you but you are warned that there is a possibility of an accident causing injury, death or property damage.
Subject to that warranty and in consideration of being permitted to compete, officiate, observe, work for, or participate in any way in the event(s) or being permitted to enter for any purpose any restricted area (defined as any area requiring special authorization, credentials, or permission to enter, to which admission by the general public is restricted or prohibited), the undersigned, for himself/herself, his/her personal representatives, heirs and next of kin, attest that they:

1.        are fully aware that the dangers associated with motorsport include, but are not limited to machinery, equipment or vehicle failure, other competitors' unskilled driving, track conditions and the like;

2.        agree that, if at any time before, during or after an event, they are in or about restricted areas and they consider anything to be unsafe, they will immediately advise the officials of such and will leave the restricted areas and/or refuse to participate further in the event(s);

3.        hereby release, waiver, discharge, indemnify and covenant not to sue the following Releasees, being One Raceway., Golden Era Auto Racing Club Inc. (GEAR) and their respective members, the landowners, promoters, participants, racing associations, sanctioning organizations or any subdivision thereof, track operators, officials, car owners, drivers, pit crews, rescue personnel, any persons in any restricted area, promoters, sponsors, advertisers, owners and lessees of premises used to conduct the event(s), premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions or instructions, or engage in risk evaluation or loss control activities regarding the premises or event(s) and each of them, their directors, officers, agents and employees, from all liability to the undersigned, in relation to injury to the person or property, or any action resulting in death of the undersigned, arising out of or related to the event(s), whether caused by the negligence of the Releasees or otherwise;

4.        hereby assume full responsibility for any risk of bodily injury, death or property damage arising out of or related to the event(s) however caused;

5.        hereby acknowledge that the activities of the event(s) are very dangerous and involve the risk of serious injury and/or death and/or property damage and that injuries received may be compounded or increased by the selection and/or negligent rescue operations or procedures of the Releasees;

6.        hereby assume full responsibility for the preparation and safety of the vehicle to be used and further give an assurance that the vehicle has been checked for safety prior to the event date, is in a condition fit to be used for motor racing and will be re-checked on the day of the event;

7.        acknowledge that participating in a car without rollover protection means they are placing themselves at potentially greater risk than other participants and accept the consequential responsibility without reserve or recourse to any parties named in this waiver, without reserve or recourse to any Releasee;

8.        hereby attest that they have discussed this release and waiver with their spouse or partner, if any, and he/she is fully aware of and accepts the commitment they are making;

9.        hereby acknowledge and agree to comply with both the conditions and the spirit of the Supplementary and Event Regulations and to be bound by such Supplementary and Event Regulations; and 

10.     accept full responsibility for their own physical safety and for any property damage they may suffer arising as a direct, or indirect, result of their participation, in any manner, in the event.

ENTRY FEE: $250 (after closing date entry is $300)

Sending a Cheque it must be received by the closing date, made payable to “GEAR Inc.” Allow 1 week for mail delivery.
I have read this release and waiver of liability and fully understand its terms, understand that I have given up substantial rights by signing it, and will sign it freely and voluntarily without any inducement, assurance or guarantee being made to me.  I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
