1. "As-Is" Acknowledgment
I, the undersigned customer, understand that the technology services, repairs, or installations provided by Mae Kowalke/Tech Mae-Day ("Technician") are performed on an "as-is" basis, without any warranties or guarantees, either expressed or implied. I hereby release and hold harmless Technician from any and all liability, claims, demands, or causes of action that may arise from the performance of these services, including but not limited to any damages, losses, or injuries that may occur as a result of the services provided.
2. Assumption of Risk
I understand that IT services (including hardware repair, software installation, and data migration) carry inherent risks, including, but not limited to:
- Data loss or corruption.
- Irreparable damage to older, fragile, or non-standard equipment.
- System instability or incompatibility with existing software/hardware.
- Voiding of manufacturer warranties.
- I voluntarily assume all risks associated with this service.
3. Data Backup Responsibility
I acknowledge that it is my sole responsibility to back up all data before services commence. The Technician is not responsible for any lost, damaged, or corrupted data, files, or programs.
4. Release of Liability & Indemnification
In consideration of the services provided, I hereby release, waive, and hold harmless Tech Mae-Day, its owners, and employees from any and all claims, damages, liabilities, or expenses (including attorney fees) arising from:
- Damage to equipment during troubleshooting or repair.
Loss of data.
System downtime.
5. Governing Law
This agreement shall be governed by the laws of the State of Ohio, and shall remain in effect for any and all tech services performed for me, the undersigned customer, for 12 months from date of signing.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY.
