Purchaser agrees to pay:
30% non-refundable reservation deposit upon contract signing.
Remaining balance per agreed milestone or structured development schedule.
All payments made are NON-REFUNDABLE under any circumstance except as expressly provided in Section 9 (Replacement Provision).
Failure to complete payment does not entitle Purchaser to refund of prior payments.
3. Nature of the Dog
Purchaser acknowledges:
This dog has been trained in personal protection.
Protection training includes controlled bite engagement.
The dog is not a pet-only animal.
The dog may cause injury if mishandled, mismanaged, or placed in inappropriate circumstances.
Purchaser assumes full responsibility for management, handling, and control upon delivery.
4. Assumption of Risk & Release of Liability
Upon physical transfer of the dog:
All risk of loss, injury, illness, death, damage, or behavioral change transfers to Purchaser.
Breeder/Trainer shall not be liable for:
Injury to persons or animals
Property damage
Future behavioral changes
Health conditions arising after transfer
Death of the dog after transfer
Purchaser agrees to indemnify, defend, and hold harmless Breeder/Trainer from any and all claims, damages, lawsuits, or liability arising from ownership, possession, or handling of the dog after transfer.
5. No Guarantees of Future Performance
Breeder/Trainer makes no guarantees regarding:
Continued protection performance
Bite engagement reliability
Suitability for specific threat scenarios
Future temperament
Longevity
Health beyond date of transfer
Purchaser acknowledges that working dogs are living animals and future development cannot be guaranteed.
***Health Testing Disclaimer & Limitation of Liability***
Breeder/Trainer represents that all health testing disclosed to Purchaser, including but not limited to hip and elbow evaluations and genetic screening panels, was performed by licensed veterinarians and/or recognized third-party laboratories at the time of testing.
Purchaser acknowledges and agrees that:
Breeder/Trainer does not perform orthopedic or genetic evaluations personally and relies entirely upon the accuracy and integrity of third-party professionals and laboratories.
Health testing results reflect the condition of the dog only as of the date of evaluation and are not guarantees of future health, soundness, longevity, or working capability.
Orthopedic ratings, preliminary evaluations, genetic screenings, and laboratory reports are subject to professional interpretation and may later be revised, updated, or reclassified by the issuing organization.
Breeder/Trainer shall not be liable for errors, omissions, reinterpretations, laboratory inaccuracies, changes in diagnosis, or future health conditions not detectable at the time of testing.
Purchaser accepts the dog with full understanding that no guarantee is made regarding lifelong structural soundness, absence of genetic disease, or long-term orthopedic development.
6. No Refund Policy
All payments made under this Agreement are final.
No refunds shall be issued if:
Purchaser withdraws
Purchaser fails to complete payments
Purchaser changes circumstances
Dog becomes injured or dies after transfer
Purchaser relocates
Purchaser divorces or changes household structure
No emotional dissatisfaction constitutes grounds for refund.
7. Transfer of Ownership
Ownership transfers only when:
Dog is physically delivered
Full payment has been received
Until paid in full, dog remains sole property of Breeder/Trainer.
8. Post-Transfer Responsibility
Purchaser agrees to:
Maintain structured training
Use proper containment
Comply with local laws
Carry homeowner’s insurance covering working/protection dogs
Failure to manage the dog responsibly voids any replacement provision.
9. Suitability Replacement Provision
If, prior to transfer, the dog is determined by Breeder/Trainer to be unsuitable for the contracted protection level:
Breeder/Trainer shall have up to twelve (12) months to:
Provide a comparable replacement dog
OR
Continue development of a suitable candidate
No refunds shall be issued in lieu of replacement.
Replacement determination is at sole discretion of Breeder/Trainer.
10. Entire Agreement
This Agreement constitutes the entire agreement between the Parties and supersedes any prior representations.
No verbal statements shall modify this Agreement.
11. Governing Law
This Agreement shall be governed by the laws of the State of North Carolina.
Any disputes shall be resolved in the county of Breeder/Trainer’s principal place of business.
***Dispute Resolution & Good Faith Resolution Clause & Good Faith Resolution Requirement
Purchaser agrees that in the event of any dispute, concern, complaint, or claim arising out of or relating to this Agreement or the dog, Purchaser shall first notify Breeder/Trainer in writing and allow a reasonable opportunity to resolve the matter in good faith before initiating any legal action.
Purchaser agrees to communicate concerns directly with Breeder/Trainer and to make a genuine effort to resolve any disagreement through cooperative discussion prior to seeking involvement of courts, regulatory agencies, or third parties.
***Mandatory Mediation Prior to Legal Action
If the Parties are unable to resolve the dispute through good-faith discussion, the Parties agree to submit the matter to confidential mediation before filing any lawsuit.
Mediation shall occur in the county of Breeder/Trainer’s principal place of business unless otherwise agreed in writing.
Each Party shall bear its own legal fees and share mediation costs equally.
No legal action may be initiated until mediation has been attempted in good faith.
